Dereliction of Duty: The Consequences of Failing to Invoke the 25th Amendment

The Vice President of the United States swears an oath to “support and defend the Constitution,” and part of that duty involves safeguarding the functionality and integrity of the Executive Branch. The 25th Amendment offers a constitutional process to remove a president who can no longer discharge the powers and duties of the office. If a president becomes incapacitated—whether physically, mentally, or otherwise—and the Vice President fails to act, it could be seen as a grave dereliction of duty.

By not invoking the 25th Amendment in such a situation, the Vice President allows a diminished leader to remain in power, endangering the nation’s security and economic well-being. It raises serious questions about their commitment to their oath of office. Even worse, it left in office an incapacitated President to compromise the nation’s national security and economic stability.

A Vice President who hesitates or refuses to act in such a critical moment shows a dangerous inability to prioritize the national interest over personal loyalty or political calculation. This type of inaction erodes public trust and should also be seen as a disqualifying factor for future presidential aspirations. If they cannot rise to the occasion as the nation’s second-in-command, how can the American people trust them to handle the full weight of the presidency?
