CALIFORNIA: HURRICANE HILARY -- BE VIGILANT, BE SAFE

If you believe the progressive communist democrats can keep this nation militarily safe and secure or respond quickly to natural disasters, you will be screwed.

Just think how taxes and public policies will mitigate hurricanes they falsely claim are attributable to global warming.

Hurricane Hilary is not a product of climate change but an El Niño climate pattern …

El Niño is a climate pattern that describes the unusual warming of surface waters in the eastern equatorial Pacific Ocean. El Niño arrived in June and is anticipated to continue through the Northern Hemisphere winter (with a greater than 95% chance through December 2023 -February 2024).

Warm sea surface temperatures are a key influence on hurricanes, so El Niño events favors increased hurricane activity in the central and eastern tropical Pacific Ocean and tend to suppress Atlantic hurricane activity.

Additionally, during El Niño events, wind patterns in the tropical Atlantic tend to change, creating stronger upper-level winds or wind shear, the change in wind speed and direction with altitude. Higher wind shear can disrupt the development and intensification of hurricanes, making it more difficult for them to form and strengthen.

Now ask how many climate scientists understand El Niño-La Niña events well enough to incorporate them into climate models. Or even predict their occurrence. Answer: none!

The two primary reasons the U.S. West Coast doesn't see many hurricanes are the cold ocean temperatures and currents, plus the direction of the trade winds. Hurricanes need ocean temperatures to be warmer than 79 degrees. Hilary is currently sitting in 85-degree water and will remain in those warm waters through today. As Hilary moves closer to Baja California, ocean temperatures will quickly cool into the 70s and eventually the 60s along the California coast, where its energy continues to dissipate.

Bottom line…

Watch closely for the Rahm Emanuel effect of "never letting a crisis go to waste." It suggests that during times of crisis or upheaval, there are opportunities for politicians to advance their agendas and implement significant changes that might not be possible during more stable times. It implies that crises create a sense of urgency and public willingness to accept changes or reforms they might resist in normal circumstances.

Observe those handling the government’s response to natural disasters at the local, state, and federal levels. See which political hacks are chosen for their political connections or academic credentials rather than their experience and competence. Demand their replacement immediately.

There is no doubt in my mind that entrepreneur Elon Musk is a financial P.T. Barnum, a promoter par excellence whose accomplishments are truly amazing. However, he lives in a precarious financial condition with cross-collateralized enterprises and is deeply indebted to the government as he relies on contracts, grants, subsidies, and regulatory and tax relief.

So, it is natural for my cynical self to wonder if X, formerly known as Twitter, will continue to interfere with the 2024 election and Administration initiatives.

Yaccarino worked for Turner Entertainment for close to 20 years, becoming executive vice president and chief operating officer of ad sales where she helped develop new advertising and marketing strategies. Yaccarino joined NBCUniversal in October 2011. As the head of NBCUniversal's advertising sales, she played a key role in the launch of Peacock streaming service.

Yaccarino joined the Ad Council in 2014. 2018 President Donald Trump appointed her to the President's Council on Sports, Fitness, and Nutrition. Yaccarino became chair of the Ad Council's board of directors in January 2021, for a term that ran until June 30, 2022. As chair, Yaccarino partnered with the Biden administration in 2021 to create a coronavirus vaccine campaign that featured Pope Francis. She also chaired the Future of Work task force for the World Economic Forum (WEF). <Source>

Musk's X seeks job applicants to stop disinformation, promote 'credible' election stories

X is seeking job applicants for two positions on its threat disruption team who are "passionate about protecting users from global disinformation" and "helping people find credible information online" in the context of elections.

Team leader Aaron Rodericks not only touts his profile on X rival BlueSky in his X bio, but is actively recruiting applicants through a subscription newsletter on disinformation that includes unflattering coverage of Musk, raising the question how involved the mercurial South African remains in his company.

Critics of the allegedly coercive relationship between social media companies and federal agencies quickly flagged the jobs as "censorship positions," in the words of former State Department cyber official Mike Benz, whose Foundation for Freedom Online critically researches public-private efforts against purported misinformation.

Social media analyst Kristen Ruby, whom Benz agrees first brought the job listings to wider attention, noted in February that Musk-owned Twitter still had its recently renamed civic integrity misleading information policy.

It authorizes X to remove, throttle and label "content that may suppress participation" as well as "mislead" about civic processes, cause "confusion" or contain "satirical or humorous elements."

Certainly, Twitter is guilty of censoring information that clearly suppressed participation when it killed stories about Hunter Biden’s laptop, including significant information that a presidential candidate was a foreign agent—and promoted false and misleading stories that branded another candidate as a foreign agent—all with the assistance of “government sources” and Twitter employees with former government positions.

Bottom line…

There is no doubt in my mind that the progressive communist democrats will repeat part of the 2020 election playbook, including a medical panic that keeps people home and voting by mail rather than in-person. They are already using so-called non-partisan non-profits to register voters in heavily Democrat precincts and to harvest ballots after the fact.

ARE YOU READY TO GET UGLY?

It’s black and white: good versus evil…

Under the leadership of former President Obama and his cadre of radical communist followers, the Democrat Party has blatantly implemented various measures to infiltrate and manipulate institutions and infrastructure to consolidate political power and suppress any opposition.

This has led to a virulent wave of political repression and the legal persecution of 2024 opposition frontrunner Donald Trump. Their pseudo-legal reign of terror seems unbounded as Attorney General Merrick Garland refuses to abide by existing federal law and continues to protect the sitting president from legitimate charges relating to high crimes and misdemeanors, including bribery and treason.

Let us not forget Joe Biden’s and Hillary Clinton’s criminal activities occurred under Barack Obama’s watch, as did domestic spying on American citizens and significant subversion of the law.

We are faced with questions that must be answered.

  • Will the Democrat’s extreme methods and policies become unpopular and controversial enough to spark an electoral uprising that will see unassailable Republican majorities in Congress and a GOP capture of the Presidency?

  • Will the normally feckless Republicans put aside their differences and unite under a strong leader willing to punish Democrat transgressions and begin the brutal reform necessary to return America to a constitutional republic?

  • Will Republican leadership punish and expel those who jump the aisle to vote with the opposition?

  • Will Americans, many of whom openly supported the Democrat Party, coalesce behind a rebuild America agenda likely to see mass firings of government employees and the prosecutions of those who have pushed America over the abyss?

  • Will Americans recognize Barack Obama for the radical, law-breaking communist he is and put aside his carefully constructed persona to realize he is a monster who nearly destroyed the United States, including using his puppeteers in the Biden Administration to continue his nefarious activities?

  • Will the corporatized media be held accountable for their gross interference in previous elections and their efforts to censor or cancel dissent?

Bottom line…

We no longer live in a world of differing opinions; we live in a world of differing realities. We are no longer on the precipice; we are in the abyss and falling faster than was previously believed possible.

We can no longer sit back and let others “do the work.” We must increase voter registration in heavily Republican districts, using “walk lists” to identify those who voted Republican in previous elections and remained dormant in 2020. We must use every advantage available. We must weaponize Republican Attorneys General to file charges against those who refuse to uphold federal and state statutes.

Unpleasant as it might seem, we must forgo the civility of a Dole, McCain, Bush, or Romney and get ugly. War is ugly, and, like it or not, we are engaged in a war to preserve America.

Most people want to hide and ignore the darkening shadows cast by progressive communist democrats and many of us spend a lot of time denying, deflecting, or dismissing their evilness.

THE COURTS NOW BECOME THE ARBITER OF SCIENCE

In what is being hailed as a landmark victory for environmentalists, Montana State District Judge Kathy Seeley ruled that Montana officials violated Montana’s highly protective constitution by refusing to consider the impacts of greenhouse gas emissions when they’ve approved coal mines, oil drilling, and new power plants.

Essentially, a group of young environmental activists used Montana’s State Constitution, which guarantees that residents have “the right to a clean and healthful environment,” to force the State to consider climate change when dealing with fossil fuel-related projects having an environmental impact.

ORDER

  1. Based upon the foregoing Findings of Fact and Conclusions of Law the Court determines and declares that:

  2. The Youth Plaintiffs have standing to bring the claims addressed herein.

  3. Montana's GHG [greenhouse gas] emissions have been proven to be fairly traceable to the MEPA [Montana Environmental Policy Act] Limitation.

  4. Montana's GHG emissions and climate change have been proven to be a substantial factor in causing climate impacts to Montana's environment and harm and injury to the Youth Plaintiffs.

  5. This judgment will influence the State's conduct by invalidating statutes prohibiting analysis and remedies based on GHG emissions and climate impacts, alleviating Youth Plaintiffs' injuries and preventing further injury.

  6. By prohibiting analysis of GHG emissions and corresponding impacts to the climate, as well as how additional GHG emissions will contribute to climate change or be consistent with the Montana Constitution, the MEPA Limitation violates Youth Plaintiffs' right to a clean and healthful environment and is unconstitutional on its face.

  7. Plaintiffs have a fundamental constitutional right to a clean and healthful environment, which includes climate as part of the environmental life-support system.

  8. The 2023 version of the MEPA Limitation, Mont. Code Ann.§ 75-1-201(2)(a), enacted into law by HB 971, is hereby declared unconstitutional and is permanently enjoined.

  9. Mont. Code Ann.§ 75-l-201(6)(a)(ii), enacted into law by SB 557 from the 2023 legislative session, is hereby declared unconstitutional and is permanently enjoined because it removes the only preventative, equitable relief available to the public and MEPA litigants.

  10. In addition to the findings, conclusions, and declarations set forth above, injunctive relief is appropriate, prohibiting Defendants from acting in accordance with the statutes declared unconstitutional.

  11. Judgment is hereby found in favor of the Plaintiffs as prevailing parties.

Procedural difficulties…

The court erred in granting general standing to the young activists without the legal necessity of proving specific individual damage. You do not obtain standing because you are a resident and don’t like a particular law that might theoretically damage you. In granting general standing the Court accepted that:

  • “Olivia expressed despair due to climate change.”

  • “Badge is anxious when he thinks about the future that he, and his potential children, will inherit.”

  • “Grace … is anxious about climate change.”

  • “Mica gets frustrated when he is required to stay indoors during the summer because of wildfire smoke.”

This is clearly a political issue that should be determined by a legislative process.

And the court cannot adequately determine the science when scientists themselves cannot directly measure the influence of anthropogenic global warming on a chaotic climate system with natural variability or generally agree about its impacts.

According to renowned climate expert Dr. Judith Curry, a leading climatologist and former chair of the School of Earth and Atmospheric Sciences at the Georgia Institute of Technology …

This report responds to the Plaintiffs’ claims that:

  • the release of greenhouse gases from fossil fuel emissions into the atmosphere is already triggering a host of adverse consequences in Montana;

  • the threats posed by fossil fuels and the climate crisis are existential;

  • Montana’s energy system should transition to a portfolio of 100% renewable energy by 2050.

My report provides evidence that supports the following conclusions:

  • The climate-related concerns observed by the Plaintiffs are well within the range of historical natural weather and climate variability, with worse occurrences of weather and climate extremes observed during the early 20th century.

  • Plaintiffs’ concerns about climate change in the 21st century are greatly exaggerated, and not consistent with the most recent assessment reports and research publications.

  • In 2021, Montana ranked 10th among U.S. states in terms of the share of electricity generated from renewables, about 52%. There are significant problems with a portfolio of 100% renewable energy for Montana by 2050.

  • Emissions from fossil fuels generated in Montana provide a miniscule contribution to global greenhouse gas emissions and do not influence directly Montana’s weather and climate. <Source>

Montana plans to appeal…

The Montana attorney general’s office said the state would appeal, sending the case to the state Supreme Court.

“This ruling is absurd, but not surprising from a judge who let the plaintiffs’ attorneys put on a weeklong taxpayer-funded publicity stunt that was supposed to be a trial,” Emily Flower, a spokeswoman for the attorney general, Austin Knudsen, said in a statement. “Montanans can’t be blamed for changing the climate.”

"This “same legal theory has been thrown out of federal court and courts in more than a dozen states. It should have been here as well, but they found an ideological judge who bent over backward to allow the case to move forward and earn herself a spot in their next documentary.” <Source>

Bottom line…

Does anyone really believe if Montana allows oil drilling, it will have a catastrophic effect on the climate and may kill or injure Montana’s children? More than the pollution in Beijing is killing Chinese children.

It is absurd to believe that a Court and attorney-advocates can be the arbiters of science, especially science they cannot possibly understand.

In commenting on the case, the progressive communist democrat media propagandists at the AP reported, “The ruling following a first-of-its-kind trial in the U.S.” and “adds to a small number of legal decisions around the world that have established a government duty to protect citizens from climate change.”

Huh? Where in the U.S. Constitution does it claim that the federal government has a duty to protect its citizens from climate change? Melting glaciers? El Niño or La Niña? Hot summers or cold winters? Hurricanes?  Scientists know that ENSO (El Niño–Southern Oscillation) has a significant effect on the weather but can't explain or forecast its occurrences.

THE FALLACY OF PROGRESSIVE CHOICE

One might assume that in a nation as large as the United States, the two major political parties could find at least a few qualified, experienced, competent, well-educated, well-spoken, and somewhat telegenic candidates who did not hate America, especially when faced with a rematch between two unpopular nominees, one of which may have sold out the United States to foreign hostile powers.

It is not uncommon in today’s elections to find ourselves facing decisions where the candidates range from bad to worse and where the choice between unfavorable options can be both tempting and deceptive, highlighting the fallacy of assuming that choosing the lesser of two evils is a step towards the preservation of our nation’s core values. But it is all a sad illusion masking our endorsement of an undesirable outcome.

When faced with an electoral choice between bad and worse, we become trapped in a tunnel that only considers the immediate consequences rather than long-term needs as we focus on avoiding the immediate pain of knowing we are screwing ourselves and our nation.

It is essential that we recognize that while one option might be slightly less odious, it doesn't necessarily mean that it aligns with our need for honest representation.

Bottom line…

Everybody is wondering whether a corrupt, traitorous President Joe Biden and his cadre of Obama-selected progressive communist democrats can survive the climate catastrophe of a category-five shitstorm.

The chattering class suggesting that the Democrats would embrace either former First Lady Michelle Obama or a more “moderate” California Governor Gavin Newsom. They present people with a choice between a radical communist with deep ties to the scandal-ridden Obama Administration or the man completing former Governor Jerry Brown’s destruction of California. Both would be disasters.

Utah roads are maintained using taxes from gasoline sales. As vehicles become more fuel efficient and the number of electric vehicles grows, the Utah Department of Transportation and Division of Motor Vehicles is changing to a per-mile fee as a way for drivers to pay their portion of roadway operations and maintenance.

Utah’s Road Usage Charge Program is voluntary for electric vehicle owners. UDOT and DMV have contracted with emovis to operate the program. The choice is yours.

[OCS: The loss of your rights almost always starts as a voluntary program supported by government bureaucrats, the corporatized media, unions, foundations, vendors, and useful idiots. The choice is usually between pay me now or pay me later.]

During the 2018 Legislative session, lawmakers instituted an alternative fuel vehicle fee to cover a portion of those vehicles’ contribution to building and maintaining Utah’s transportation system. ​This fee is in addition to the annual vehicle registration fee assessed on all vehicles in the State​. Utah’s Road Usage Charge provides a choice for owners of alternative fuel vehicles to pay by the mile in lieu of paying the alternative fuel vehicle fee.

  1. Enroll -- To enroll, you will create an account with emovis, the third-party commercial account manager. You will need your vehicle information and a valid credit or debit card to set up a prepaid wallet. You will sign a user agreement with emovis and they will send you a device to place in the vehicle to report mileage.

    [OCS: Fascism is where the government exercises significant control over the economy, often in collaboration with or through the manipulation of private companies. You will provide an interest-free loan to the government or emovis as your funds will be sequestered in an electronic wallet – the beginning of government-regulated currency. The government could change the rates, implement retroactive charges, or drain your account without notice. Notice they do not mention fines, penalties, and withdrawal details. Emovis is not an American company but incorporated under the laws of France – and outside of U.S. law.]

  2. Install -- When you receive the OBD mileage reporting device, install it in the OBD port of your vehicle to fully activate your account. You will also need to download a smartphone app to record an initial odometer reading. You will create an account in the app separate from the online portal with emovis.

    [OCS: The device they send is a black box, so you do not know what data they collect and transmit. Additionally, you will be required to use a smartphone app that further uploads information and represents a clear and present security threat.]

  3. Drive -- You will pay 1.00 cents per mile, deducted from the prepaid wallet, up to the amount of the flat fee. Enrolling in Utah’s Road Usage Charge program gives you access to DriveSync® for Utah DOT an app that makes your driving safer and more productive through trip tracking and driving reports.

    [OCS: It is not unreasonable to believe that insurance company lobbyists will pay off the legislature to access this information and possibly your speed/braking habits to set rates. Or automated speeding tickets, congestion pricing for specific areas, etc. Notice that emovis has several products, including toll-tracking and enforcement.]

Utah is not the only state flirting with grabbing your money and personal data. Oregon, Washington, California, and Michigan are some of the states on the bandwagon. Several insurance companies are now using OBD (On-board diagnostics) systems to monitor your driving and set rates.

Hidden Dangers of Mandatory Electronic Systems in Vehicles.

How many people remember when General Motors' On-Star division lied to the public regarding privacy issues and their system’s capabilities? Only after they were caught in a court battle did we find that On-Star systems could activate in-car microphones to monitor your private conversations—a capability known and used by law enforcement for surveillance. 

While the Fourth Amendment of the U.S. Constitution protects against unreasonable searches and seizures, ensuring that individuals have a reasonable expectation of privacy in their "persons, houses, papers, and effects," its interpretation relative to modern technology and data collection, including uploaded GPS location data, is murky at best.

The glitch lies in the concept of the "third-party doctrine" When individuals voluntarily share information with third parties, they automatically lose some expectation of privacy in that information. The doctrine" has been cited in several cases related to electronic data collected and stored by service providers. And then there are those unilateral “terms of service” agreements where you waive all of your rights, even if a company is knowingly negligent and causes you material harm.

The ongoing real-time transmission of location data from vehicles equipped with mandatory GPS systems places this data in the hands of third parties, such as service providers or government agencies tasked with managing traffic, and thus may not be constitutionally protected, leading to surveillance without a warrant based on probable cause.

Bottom line…

There is no doubt in my mind that the progressive communist democrats who rule the State of California with an iron fist want to eliminate private vehicles and force everyone to live in dense housing clusters. They refuse to repair or build out our freeway system as they implement more and more surveilled toll roads to generate "vehicle-related" tax revenues.

We need stronger privacy laws that severely punish government agencies, employees, and their designated agencies for illegally accessing or using your personal and private data – with the penalty money flowing to individuals, not back into the state or federal treasury. Likewise, we need to nullify those arbitration clauses that protect large companies from class-action lawsuits.

We are undoubtedly living in a corrupt police surveillance state where the Constitution and the rule of law are nearly dead.

We must bring corrupt politicians to heel – and curb the government’s encroachment on our freedoms.
