MEDIA MOGULS AND TECH TYRANTS BUYING LEGISLATORS TO BYPASS ANTI-TRUST LAWS

Once again, we see big companies purchasing legislators to empower large mainstream media and secure an advantage over smaller media outlets and independent content creators.

Size matters…

(2) NEWS CONTENT CREATOR.—The term ‘‘news content creator’’ means—

(A) any print, broadcast, or digital news organization that—

(i) has a dedicated professional editorial staff that creates and distributes original news and related content concerning local, national, or international matters of public interest on at least a weekly basis; and

(ii) is marketed through subscriptions, advertising, or sponsorship; and

(B)

(i) provides original news and related content with the editorial content consisting of not less than 25 percent current news and related content; or

(ii) broadcasts original news and related content pursuant to a license granted by the Federal Communications Commission under title III of the Communications Act of 1934 (47 U.S.C. 301 et seq.).

(3) ONLINE CONTENT DISTRIBUTOR.—The term ‘‘online content distributor’’ means any entity that—

(A) operates a website or other online service that displays, distributes, or directs users to news articles, works of journalism, or other content on the internet that is generated by third party news content creators; and

(B) has not fewer than 1,000,000,000 monthly active users, in the aggregate, of all of its websites or online services worldwide.

CNN, MSNBC, The New York Times, The Washington Post, and other major media companies to form an alliance to collectively bargain with Big Tech platforms to promote and, more importantly, protect and limit their  content

Once again, the media moguls and tech tyrants unite to legislatively strengthen their control over what a user may discover, see or hear.

And, not so coincidentally, protect the big social media platforms from being broken up due to their quasi-monopolies in today’s information marketplace.

Who are the initial GOP sell-outs of this progressive communist democrat legislation?

S.673 - Journalism Competition and Preservation Act of 2021

This bill creates a four-year safe harbor from antitrust laws for print, broadcast, or digital news companies to collectively negotiate with online content distributors (e.g., social media companies) regarding the terms on which the news companies' content may be distributed by online content distributors.

(1) the negotiations with the online content distributor—

(A) are not limited to price;
(B) are nondiscriminatory as to similarly situated news content creators;
(C) directly relate to the quality, accuracy, attribution or branding, and interoperability of news; and
(D) pertain to terms that would be available to all news content creators;

(2) the coordination between the news content creators is directly related to and reasonably necessary for negotiations with an online content distributor that are otherwise consistent with this Act; and

(3) the negotiations do not involve any person that is not a news content creator or an online content distributor.

Bottom line…

This is only part of the source consolidation and censorship/cancellation push. The next part is the modification of copyright legislation.

Why should some of the big social media players like Facebook, Twitter, and Instagram be given an antitrust exemption after lying to the public about the Russia hoax, the Ukraine hoax, the suppression of the Hunter Biden laptop information, and, most of all, the manipulation of the COVID-19 narrative and cheaper alternative therapeutics?

Enough is enough!

We will be so screwed if we allow our bought-and-paid-for politicians to ignore their constituencies and pander to the special interests as important election cycles approach.

THE GOP. THE WASHINGTON GENERALS OF POLITICS?

A reader asked me what was wrong with the GOP and why did the establishment wing of the GOP look and sound like Democrats?

This is the best analogy I can think of…  GOP-METAPHOR

How many people "of a certain age" remember the Washington Generals, often the faux opposition to the greatest basketball exhibition team ever, the Harlem Globetrotters, and its outstanding "star player" Meadowlark Lemon.

"While the Globetrotters play tricks and spectacular displays of skill for the crowd, the Generals attempt to play a 'normal' game of basketball. The Generals' games involve playing genuine basketball at times, but also not interfering in the Globetrotters' tricks. Almost every game has ended in a resounding win for the Globetrotters. Despite their losses, the Generals' roster consists of relatively competent players."

So it seems with the GOP. With the progressive communist democrats running up the score, and the “loyal opposition” making suitable noises and pocketing their share of the gate.

It is impossible to believe that any effort headed by three black, radical, racist, progressive communist democrat Obamacons whose Marxist viewpoint demands divisions between whites (oppressors) and minorities (Oppressed victims) can produce an unbiased report useful for anything other than demanding more government regulation of the housing market.

The real estate valuation industry…

Residential real estate valuations are produced either by automated systems using recently-sold comparables or a deeper appraisal by an individual appraiser who looks at other factors in addition to recent comparables. It is a disjointed industry rife with fraud. Like the corrupt rating agencies, the appraisers are typically selected and approved by the mortgage originator or lender. The trick is to secure the highest appraisal supporting the highest loan – with the loan risk passed from the mortgage originator to an investor in the secondary market as the mortgage is securitized. Underwriting criteria and appraisals will be more conservative in the case of a portfolio lender who will own the loan.

But no matter how an appraisal is produced, there is an underlying truth: the immediate area where the property is located pretty much determines its value. Therefore, it would be expected that a property in a decaying inner-city location situated on a block with ramshackle properties will not and cannot be accurately appraised to support higher loan risk levels on a racial basis.

Therefore, it appears that the federal government wants to take over the appraisal industry to ensure diversity, inclusion, and equity – an apt acronym, DIE!

This Action Plan to Advance Property Appraisal and Valuation Equity (PAVE) (“the Action Plan”) is the blueprint for how all Americans can benefit fairly from the equity built through homeownership.

Specifically, this Action Plan:

  1. Outlines the historical role of racism in the valuation of residential property;
  2. Examines the various forms of bias that can appear in residential property valuation practices; and
  3. Describes affirmative steps that federal agencies will take to advance equity in the appraisal process, and outlines further recommendations that government and industry stakeholders can initiate.

New studies validate appraisal bias in the U.S. housing market

Researchers have observed a market value gap between majority-Black and majority-white neighborhoods for decades. On average, homes in majority-Black neighborhoods are valued at less than half of those in neighborhoods with few or no Black residents. Statistical analyses show that accounting for neighborhood and property characteristics and amenities—such as the age of the property or its proximity to public transportation—does not explain the entire disparity. Recent research has identified appraisals as one of the drivers of the gap.

[OCS: There is little doubt in my mind that flawed statistical analysis by progressive-biased researchers produces flawed studies. Drive through almost any poor neighborhood, black or white, and you see mostly decaying homes in decaying neighborhoods where the funds needed to maintain or improve the property are allocated to life’s necessities. In some areas, vandals will deliberately deface freshly painted surfaces or destroy property improvements – sort of a visual statement of equity or jealousy.]

New research from Freddie Mac (2021) using census data finds 12.5 percent of appraisals for home purchases in majority-Black neighborhoods and 15.4 percent in majority-Latino neighborhoods result in a value below the contract price (the amount a buyer is willing to pay for the property, compared to only 7.4 percent of appraisals in pre-dominantly white neighborhoods. This research corroborates prior observations that a neighborhood’s average appraised property value tends to decrease as the share of historically marginalized populations increases.

[OCS: Both Fannie Mae and Freddie Mac are two corrupt quasi-governmental, Democrat-created, and dominated institutions that control the residential loan market. Like the CFPB (Consumer Financial Protection Bureau), they are highly politicized and are aligned with the progressive communist democrat agenda.]

The research the progressive communist democrats ignore…

The proximate cause of racial disparities can be correlated to the government’s misguided and mismanaged efforts to address actual or imagined disparities using welfare programs, school quality initiatives, criminal justice reform, developer-driven special interest urban renewal, and public housing creation and management. All of which are rife with corruption and incompetence.

Consider the progressive communist democrat’s efforts to destroy the nuclear family when it is a statistical fact that married couples have higher homeownership rates than single individuals -- regardless of race. Perhaps the government should incentivize marriage in minority communities and promote individualism and financial responsibility.

A blatant power grab to control the housing market... 

This flawed report will drive the House Financial Services Committee hearings, under the Chairmanship of the corrupt, disgraced Maxine Waters (D-CA),  on the proposed Fair Appraisal and Inequity Reform Act, which would hand over the nation’s entire home valuation process to a new agency known as the FVA (Federal Valuation Agency.)

Bottom line…

The goal of the progressive communist democrats is three-fold: to extend the government’s control over the housing markets through valuations and loans, to financially compel citizens to migrate to easily-controlled dense inner-city population centers with freedom-limiting mass transit, and to eliminate private property. A model developed in Beijing and Moscow.

How many people watch large corporations like Black Rock buying up swaths of real estate through real estate investment companies to create continuing rental cash flows?

Letting the government control the housing market is as dangerous as letting them control healthcare, the energy industry, the financial industry, and food production.

GUN CONTROL: THE GRIFT CONTINUES

Life-saving action to end gun violence cannot wait. Every day, more than 110 people in America are killed by guns and hundreds more are wounded. And one mass shooting after another has shattered families and shaken our nation, while weak gun laws continue to allow violent “criminals to exploit loopholes in our background check laws and flood our streets with guns.

[OCS: You will notice that they almost never break down the number with particularity: suicides, accidents, deaths in the commission of a crime or at the hand of law enforcement, and gun deaths in minority communities caused by drugs or a “macho” culture.

Of course, there is also the big lie. Guns do not kill people; they are killed by people using guns, including criminals, crazies, and terrorists.

There will always be “mass” shootings. However, the word “mass” is a rhetorical trick by the statisticians and the media to add drama to situations bound to occur in a nation of 320 million people with extraordinary freedom of action.

Likewise, the endless 24/7 repetition of the news and endless chatter from the talking heads amplifies the event beyond its expected low probability (except in the inner cities) occurrence.

We do not have weak gun laws; we have weak politicians and prosecutors who provide passes to minorities to jigger incarceration rates and to allow plea bargaining down gun charges to secure career-affirming conviction numbers. Funny, the minority community is awash in guns, yet minorities rarely are involved in school shootings; not so for white, middle-class children on or off their prescribed psychotropic medications to control their aberrant behavior.

And, notice how they almost always never mention an estimate of the number of innocent lives that might have been saved by the proper use of firearms.]

For decades, change has been thwarted by the NRA’s dangerous efforts to spread fear and disinformation to stop life-saving gun laws - and by the elected leaders who refused to take common-sense steps to save lives.

[OCS: No other organization has promoted gun safety and the prudent use of firearms like the NRA.

They are about teaching gun safety and protecting the Second Amendment -- and the gross punishment of law-abiding for the acts of a relatively few criminals, crazies, and terrorists.

Truth be told, the regime is more worried about armed regime change in response to dictatorial tyranny than criminal activities. There are but a few common-sense steps to save lives: fully prosecute gun-related crime, lock up the offenders, teach gun familiarization and safety, and allow those with training and desire to carry to do so without restriction.

Just how many criminals, crazies, and terrorists belong to the NRA. Full disclosure: I am a life member (Patron Level) of the NRA and want to keep my freedoms intact and be free from government molestation.]

But Everytown is changing all that. We’ve built a movement strong enough, smart enough, and determined enough to take on the NRA and win. With more than 8 million supporters, we’ve brought about massive change.

[OCS: In my opinion, Everytown is just another progressive communist democrat grift to advance the Democrat Party and feather the nests of its leadership. Notice they talk about taking on the NRA, not implementing crime control. I have yet to see any “massive change” that can be attributed to the organization.]

Last year, President Joe Biden took executive action to stop the proliferation of deadly and untraceable ghost guns, increase funding for community violence intervention programs, confront firearm trafficking, and more.

[OCS: There is no such thing as a “ghost gun” -- it's a media term. The facts: all guns are deadly including those legally produced, possessed, and those that remain unregistered guns -- and all of their owners and users are subject to the same existing criminal laws.

Violence intervention programs – you mean paying progressive communist democrat outreach groups to pay off gangbangers – when they are not “getting out the Democrat vote?”

Firearms trafficking? Do you know that the Obama Administration was trafficking in arms during the “Fast and Furious” scandal? Or the Obama Administration was caught red-handed trafficking military weapons to Islamic terrorists in Benghazi?

We are all concerned about illegal gun ownership, especially by criminals, crazies, and terrorists – but these individuals do not abide by any laws. They do not (cannot) purchase guns legally.

BTW: Joe Biden is a cognitively-impaired buffoon who will sign anything placed before him if he is promised an ice cream cone before his nap.]

And that’s not all. In 2021, we passed more than 30 gun safety laws in the states, from regulating ghost guns in New York and strengthening background checks in Illinois to demanding police reform in New Mexico and requiring secure firearm storage in Oregon.

[OCS: Who is “we?” I never heard of your organization until I received your fundraising letter.]

With determination and resolve, we defeated 90% of the gun lobby’s agenda for the sixth year in a row, with states rejecting dozens of extreme bills that would have allowed guns in schools, armed teachers, nullified federal gun safety laws, and more.

[OCS: Again, with the unproven “we.” Not allowing properly trained school safety officers and teachers only produces an effective child shooting gallery until the police arrive, assemble, coordinate, and count the dead bodies.]

For those who do not recognize the organization’s name or its Democrat provenance…

In February 2010, John Feinblatt, now the President of Everytown for Gun Safety, was appointed chief advisor for policy and strategic planning to then New York Mayor Michael Bloomberg. As the mayor’s advisor, Feinblatt worked on criminal justice issues and as a liaison to the state court system, the city’s five elected District Attorneys, and the state criminal justice system. In 2011, Feinblatt and his longtime partner, Jonathan Mintz, were married by Bloomberg at Gracie Mansion, the mayor’s official residence. Mintz was previously the longest-serving Commissioner in the history of the New York City Department of Consumer Affairs.

After Bloomberg left office at the end of 2013, the former mayor began working more on his anti-gun violence campaign, Mayors Against Illegal Guns. In 2014, the group merged with a similar organization to form Everytown for Gun Safety. <Source>

From its 2019 IRS Form 990, we find the organization contributing money to groups such as National LGBTQ Task Force, Tides Center, Congressional Black Caucus Foundation, and the Congressional Hispanic Leadership Caucus Institute; with the two most significant contributions going to their own lobbying group, Everytown For Gun Safety Educational and Action Fund Inc [501(C)(4)] -- $1,000,000 and supporting the March For Our Lives Foundation [501(C)(3)] – $3,803,650.

2019 Income: $33,870,690; Expenses: $32,373,455; Net Assets $ 31,315,579

How fast can a situation turn toxic?

More than 1,000 well-heeled virtue-signaling Hollywood progressive communist democrat elites joined millions of viewers to enjoy the  94th Academy Awards ceremony, presented by the Academy of Motion Picture Arts and Sciences (AMPAS).

What they saw was a wealthy top-tier actor physically assaulting a wealthy top-tier comic host over a rather innocuous joke about his actor wife with a violent slap to the face in the presence of armed security officers caught off-guard. Had this actor possessed a gun, who knows what might have happened? Yet, these are the very people who would disarm the entire United States to prevent a single gun death -- an unrealistic fantasy. Personally, I find it ironic that the actor is ok with people talking about his wife's many open marriage affairs on-air, but is somehow offended by a joke he initially laughs at before she gives him the stink-eye.  

Of course, the Academy is refusing to hold the actor accountable for his violent assault and battery over the type of joke found at most awards shows. And, the actor issued the obligatory apology written by his crisis managers on his public relations team.

“Violence in all of its forms is poisonous and destructive. My behavior at last night’s Academy Awards was unacceptable and inexcusable. Jokes at my expense are part of the job, but a joke about Jada’s medical condition was too much for me to bear and I reacted emotionally,” Smith wrote. “I would like to publicly apologize to you, Chris. I was out of line and I was wrong. I am embarrassed and my actions were not indicative of the man I want to be. There is no place for violence in a world of love and kindness.”

The post continued, “I would also like to apologize to the Academy, the producers of the show, all the attendees and everyone watching around the world. I would like to apologize to the Williams Family and my King Richard Family. I deeply regret that my behavior has stained what has been an otherwise gorgeous journey for all of us. I am a work in progress.”

Another example of our two-tier justice system. 

Bottom line…

Another one of those professional charities run by professional, politically-connected hacks. Perhaps this is the new growth industry – create your own job selling a line of bullshit.

At the very end of the donation form, they note, "Everytown for Gun Safety Action Fund is a 501(c)(4) non-profit organization" and go on to say "Your contribution is not tax-deductible as a charitable contribution or as a business expense under IRC Section 162(e)." Adding, "Your contribution will not be earmarked for any purpose and will generally support our work to prevent gun violence and save lives." 

Nobody dismisses the severity of crime in America, made worse by the progressive communist democrats and their pandering to minorities to build their coalition base.

For the umpteenth time, crime control, not gun control, is the appropriate response. Lock the miscreants away and protect society.

If this organization wants to do good, let them concentrate on resolving mental health issues. With the minor exception of idiots wanting to get high as a diversion from their lives, most addicts take drugs to relieve pain: psychic and physical, intending to feel “normal” or blunt the effects of trauma. These people deserve our understanding, respect, and assistance. For the young and hip crowd – eff them and their drug dealers.

Support your local NRA chapter – not the parent organization until they dump their corrupt leadership, but the good people in your local chapter and at the range.

Support the Second Amendment, which guarantees your other inalienable freedoms.

WARNING: NOTHING A POLITICIAN SAYS IS LIKELY TO BE TRUE AFTER THEY WIN THEIR SEAT

Uncle-sam-dollarsUnfortunately, it is a fact of life that politicians on both sides of the aisle will do or say anything to get themselves elected to office—starting their reelection campaigns and prodigious fundraising efforts the day after the election—courting local, state, and national special interests over local constituents.

Also, unfortunately, rogues, scoundrels, grifters, poverty pimps, and race hustlers outweigh, and outvote, a patriotic minority that may be willing to put national interests before self-interest.

As for those promised investigations, prosecutions, and punishments of corrupt political evildoers, don't hold your breath. The name of the game is "delay 'em," using lawyers and claims of attorney-client privilege to delay being held accountable for clearly criminal actions until the statute of limitations expires.

And then, there is professional courtesy where the majority party forgives the offenders in able to "move on and put this distasteful episode behind us – in the best interests of the nation," of course.

The GOP – a particular brand of cowardice…

There is little doubt in my mind that the GOP may not rise beyond its usual feckless behavior and is most likely to revert to "establishment" politics.

If the GOP had cojones, everybody on the January 6 committee and House Speaker Nancy Pelosi would be brought before Congress and expelled for their clearly illegal and unconstitutional activities in fomenting a coup and torturing political prisoners who rot in jail without having their speedy trial – or even access to all of the prosecution's evidence.

Bottom line…

I am not sure that our premier intelligence and law enforcement agencies are not coercing, extorting, or blackmailing candidates on behalf of the deep state. Since former President Obama, Attorney General Eric Holder, and CIA Director John Brennan -- this might be a valid assumption.

(e.g., it is unlikely for a physically weak person to become an Olympian. Virtually any living being with a high school diploma can attend their local community college -- and transfer upward, grades and scholarships willing.]

  • If you can expect time off from work to celebrate your religious holidays, you have Christian privilege.

[OCS:  Considering the historical role of religion and its influence on culture, it would be reasonable to accept the notion that the creation of holidays of any kind would be conditioned by a majority opinion and ratification.]

  • If you can use public bathrooms without stares, fear, or anxiety, you have cisgender privilege.

[OCS: Interesting when considering that biological males and biological females have always been treated differently. Ask any teenage boy, of whatever persuasion, about being forced into using communal urinals’ or showers. Allowing self-declared men, especially with intact male appendages, to use women’s facilities is likely to produce stares, fear, and anxiety in the majority of women.]

  • If you don’t have to worry about how to get into a store, you have able-bodied privilege.

[OCS:  The vast majority of buildings and facilities were designed when the less-abled were less mobile and unlikely to be using such facilities.]

  • If you don’t have to explain that your spouse is of the same gender, you have heterosexual privilege.

[OCS:  The issue is one of semantics, with one group attempting to co-opt the traditional nomenclature and language of the majority to force integration and acceptance. This is the tyranny of the minority. Going beyond the conventional definition of marriage does not preclude civil partnerships nor the use of the term life-partner. For a man to refer to another man as his wife or husband is an “in your face” denial of traditional historical, cultural roles.]

  • If you’re confident that the police exist to protect you, you have white privilege.

The truth is that individuals have different abilities, environments, circumstances, and realities. They owe it to themselves to use their assets, overcome or minimize their deficits, to behave in their self-interests.

To the  extent that some Democrats want to alter historical or traditional understandings to force certain behaviors or perpetuate a permanent underclass is a sign of a malignant power grab. 

If, as some say, “racism is racial prejudice + power,” what does it say about the Democrats, the party of slavery, segregation, Jim Crow, the KKK, and the fight against civil rights legislation? What does it say about the Democrats who govern the inner cities, stealing billions of dollars while perpetuating illiteracy, poverty, disease, and crime while demanding more political power to implement “social justice?”

In the final analysis, ask yourself why blacks from Africa and foreign countries prosper in America while American blacks wallow in victimhood with their hands out for government handouts? Could it be that non-American blacks do not buy into the Democrat bullshit as they go about improving their lives and those of their next generation?

DARK MONEY: THE SCHIFF SHOW CONTINUES

Federal Election Commission, 558 U.S. 310 (2010), was a landmark decision of the Supreme Court of the United States concerning the relationship between campaign finance and free speech. It was argued in 2009 and decided in 2010. The court held that the free speech clause of the First Amendment prohibits the government from restricting independent expenditures for political campaigns by corporations, including nonprofit corporations, labor unions, and other associations.

Today, Congressman Adam Schiff (D-Calif.) introduced a constitutional amendment to overturn the Supreme Court’s Citizens United decision, and once again allow for reasonable restrictions on corporate campaign contributions and other spending.
In 2010, the Supreme Court ruled in Citizens United v. Federal Election Commission that corporations and special interest groups could spend nearly unlimited funds on election campaigns. In the decade since , outside groups spent more than $4.4 billion in federal elections – nearly $1 billion of which was untraceable “dark money” – with some of the biggest contributors coming from Wall Street, the pharmaceutical industry, and the NRA. <Source>

Like all legislation, the devil is in the details…

(1)  This is an unconstitutional amendment that limits unfettered free speech.

(2)  There is no definition of what might be construed as reasonable or viewpoint-neutral regarding free speech limitations.

(3)  There is no authority designed as an arbiter or enforcer of the legislation other than the politically-compromised judiciary, limiting judicial redress and remedy to the wealthy and well-connected.

(4)  There is no specific mention of the most significant contributor to public and political corruption – public and private unions with their vast sum of coerced donations and massive voting bloc.

(5)  As we have seen over the last decade, celebrities and wealthy individuals are now entering politics, some for the recognition, some for the access to funds that can be used to purchase cushy positions for those destined to lose their respective political races. Some vying for a chance at the golden ticket leading to future wealth, perpetual recognition, and perks and privileges only enjoyed by royalty, dictators, and billionaires. To allow these wannabes to use public campaign funds is to incentivize negative behaviors and results.

How do we know the legislation is corrupt?

RUSH LIMBAUGH: A LESSON FROM HEAVEN

Rush Limbaugh, the iconic broadcaster who used bombast and absurdity to highlight important truths, and incidentally set the unmatchable gold standard for talk radio, sent us a message from heaven.

Perhaps the most important thing Rush Limbaugh did in life was to effortlessly entertain while educating an entire generation on building their own common sense framework that could be used to analyze anything from the absurdity of politicians and poseurs to the critical aspects of life.

In essence, the Rush Limbaugh show was a master class in critical thinking and how to build your own bullshit detector. And he did it in front of a mega-audience with “half his brain tied behind his back.” A man who single-handedly saved AM talk radio and earned hundreds of millions in the process. He was a humble, kind, and thoughtful man whose bombast was an entertainment schtick to grow and retain his massive audience. At the very least, he was a cultural icon as a voice artist who painted word pictures that did not require a Ph.D. to interpret.

All that as opposed to Dana Gould, a 57-year-old washed-up wannabe progressive communist Democrat who describes himself as a stand-up comedian, actor, writer, and voice artist, yet remains virtually unknown to the public, not even as a z-lister.

Bs-gouldAs a general observation, perhaps the reason why I find progressive comedy so pathetic is that it is rooted in unreality, presenting commentary on a paradoxical world that does not exist, can not exist, and, God willing, will never exist. One need only turn to verifiable historical records to see the absurdity of preaching about a perfect world while killing more than one hundred million dissidents who surely must be standing in the way of progress.

Bottom line…

Yes, Rush has sent us a lesson – beware of ill-informed, self-righteous buffoons who are about tearing down cultural icons and replacing their memory with hate-filled anger – primarily at their own lack of achievement.

If nothing else, Rush found a way to pursue the craft he loved while being profoundly deaf in his later years. At a time when he could have retreated to a mega-mansion and lived in unimaginable splendor, he arose every day, almost to the day he passed away, to entertain and educate his audience in the absurdity and dangers of progressivism while defining conservative values.

Perhaps Dana Gould is trolling Rush for continuing relevance and attention; or perhaps, he is the prototypical unfunny progressive comedian who is so self-unaware as to be the unintended butt of his own joke.

While Rush remains a diamond in the firmament, Dana Gould is destined to remain an unremarkable grain of sand on an endless beach of time.

WHAT HAS HAPPENED TO THE UNITED STATES NAVY?

With critical emergent threats from China and Russia, the mission readiness of the United States Navy is of paramount importance.

Yet, we are finding that something is radically wrong within the fleet. Experienced leaders and warfighters are aging out of service, refusing to re-enlist, or resigning in disgust. Following the demands of their civilian leaders, senior officers are more interested in “woke” social engineering than maintaining operational readiness.

In what rational universe do we find a United States District Court Judge for the Middle District of Florida, Steven Merryday, curtailing the operation of a fleet warship?

Destroyer can’t deploy because CO won’t get COVID vaccine, Navy says

An ongoing legal battle over whether the military can force troops to get vaccinated against COVID-19 has left the Navy with a warship they say they can’t deploy because it is commanded by an officer they cannot fire.

[OCS: How does a District Court Judge insert himself into a military command decision. At the very least, the Navy brass can re-assign and replace the officer until there is a case disposition as a matter of national security.]

It’s a standoff the brass are calling a “manifest national security concern,” according to recent federal court filings.

The issues stem from a lawsuit filed in the U.S. District Court for the Middle District of Florida late last year alleging servicemembers’ rights are being infringed upon by the COVID vaccine mandate because their religious beliefs prevent them from taking the vaccine.

Judge Steven D. Merryday issue an order last month banning the Navy and Marine Corps from taking any disciplinary action against the unnamed Navy warship commander and a Marine Corps lieutenant colonel for refusing the vaccine.

[OCS: Re-assignment of billets due to operational considerations is neither disciplinary nor punishing.]

In the process, the case has raised questions about the lines between military good order and discipline, and the legal rights of servicemembers as American citizens.

Merryday’s injunction is “an extraordinary intrusion upon the inner workings of the military” and has essentially left the Navy short a warship, according to a Feb. 28 filing by the government.

“With respect to Navy Commander, the Navy has lost confidence in his ability to lead and will not deploy the warship with him in command,” the filing states.

The Feb. 28 filing alleges that the commander has already disregarded Navy regulations after he “exposed dozens of his crew to COVID-19 when he decided not to test himself after experiencing symptoms.”

[OCS: If the officer refused orders to test himself, a non-invasive test procedure, and possibly served as a disease vector for his crew, this is a far more serious matter than refusing to be vaccinated, which is a body-invasive procedure with potentially life-threatening consequences.]

The government’s Feb. 28 filing also argued that, even if the court found the CO credible, he can’t lead and crew a warship “given the breach of the relationships with both his commanding officer and his subordinates.”

A commanding officer can’t enforce orders to his 320-sailor crew if he does not abide by those orders himself, the filing argues.

“By forcing the Navy to keep in place a commander of a destroyer who has lost the trust of his superior officers and the Navy at large, this Order effectively places a multi-billion-dollar guided missile destroyer out of commission,” defense attorneys wrote. <Source>

What’s wrong with this?

(1)  A federal judge has no place or authority in the military chain of command.

(2)  The officer should have conscientiously resigned his commission or voluntarily placed himself on inactive duty rather than impact his ship’s operational readiness.

(3)  The CNO, through the fleet command, should have ignored any civilian order not endorsed by the Commander-in-Chief or the Secretary of Defense and deployed the destroyer.

Even though scientific reports are suggesting the current (experimental) vaccines (correctly, some are not vaccines) may not be as effective as promised, of shorter therapeutic duration, carry life-threatening side effects, or have negative efficacy on the immune system, the matter is one of conscience that should not compromise the nation’s national security.

GUN CONTROL: THE ANSWER IS INTUITIVELY OBVIOUS

Let us consider some commonsense truths…

(1)   Guns, like power tools, are inanimate objects and, except for product defects, are subject to the will, intent, and motivation of the individual in control.

(2)   Society must be willing to accept and tolerate some degree of adverse gun-related activity as it is impossible to detect, prevent, or interdict the activities of criminals, crazies, terrorists, and those under the influence of chemical substances as these individuals have no respect for our laws and are unlikely to follow any law on the books. Suicides are almost impossible to prevent and should be a given in society. Likewise, accidents are random events due to carelessness and unforeseen circumstances.

(3)  The vast majority of individuals who have received gun familiarization and training and who own guns are likely to use firearms prudently as they are familiar with weapons.

(4)  To be effective, punishment must be widely known, certain, swift, equally administered, and proportionate to the crime.

(5)  When it comes to weapon usage, the greatest threats to society are attorneys and the politicization of gun-related investigations, prosecutions, and judgments. Forgiving gun use during criminal activities should not be subject to dismissal or plea bargains, especially to secure guaranteed arrests or convictions for those keeping score or those wishing to manipulate minority incarceration rates for political purposes. Soft-on-crime prosecutors, diversion programs, and the refusal to prosecute certain minorities contribute to the problem.

(6)   Strict and nonsensical gun laws impact the law-abiding citizens who are being denied their God-given right to self-defense against a more powerful aggressor when law enforcement authorities are unavailable. The old saying that you cannot outrun a bullet and that law enforcement has no legal duty or responsibility to protect or defend individuals other than protecting the regime and maintaining general order should inform legislative decisions.

(7)   Those who want to abolish or amend the Constitution’s Second Amendment do not fear hunters, target shooters, gun-collectors, criminals, crazies, or terrorists per se – they fear an armed rebellion that could result in regime change if the populace encounters a tyrannical regime. The ultimate check and balance to prevent a catastrophic dictatorship or incursion by a foreign sovereign power.

(8)   Although there are no restrictions regarding certain weapons in the Second Amendment, it would be reasonable to conclude that no individual should possess certain weapons like Gatling-style machine guns, grenades, rockets, guided missiles, or atomic weaponry. As for fully-automatic pistols and rifles, these should be strictly controlled. As for suppressors and other sound-deadening accessories, these can be grossly useful in preventing hearing loss. As for armor-piercing ammunition or incendiary ammunition and tracers, these too should be controlled. However, given the rise of personal body armor, one may need to rethink armor-piercing ammunition in the future.

(9)  The FBI’s crime statistics are often garbage as data collection is unreliable, and communities have been known to fudge results – especially when relying on conviction data rather than pre-plea bargain charging data. The political class refuses to allow illegal aliens to be correctly counted and categorized. The same goes for gun-related crime.

(10)  Do not release criminals who used guns into the community – no parole, no good-time credits, and sentences cannot be affected by judge-ordered prison population reductions.

What’s wrong with California?

The progressive communist democrats who rule the State do not want you to know the truth about politics and gun crime, especially as politicians pander to minorities with disproportionate criminal activity.

  • AB 109 weakened parole requirements and implemented prison “diversion” rules.
  • Prop. 47 downgraded many felony crimes to misdemeanors,
  • Prop. 57 made dangerous felons, including repeat offenders, eligible for release after serving just a portion of their sentences.
  • Weakened three-strikes laws.

Bottom line…

The answer to gun control is intuitively obvious: crime control -- punish criminals, not law-abiding citizens.

As the 2022 midterm elections approach, it is time for Californians to get gas prices, taxes, and crime under control.

We are so screwed.
