MERRICK GARLAND AND THE DOJ ATTEMPT TO SUBVERT ELECTION INTEGRITY IN GEORGIA

Thank you for keeping Merrick Garland off the Supreme Court bench...

I would like to thank Senate Minority Leader Mitch McConnell and all GOP Senators who kept Obama’s nominee, Judge Merrick Garland, from being confirmed as an Associate  Supreme Court Justice. As the United States Attorney General, he has revealed his hyper-partisan nature and questionable knowledge of the law. Either his knowledge of the U.S. Constitution and existing law is woefully deficient, or he deliberately has chosen to ignore the law as he pursues a progressive communist democrat agenda.

Department-of-injusticeThat being said, let us take a look at the U.S. Department of Justice under Merrick Garland as he attempts to sidestep the 10th Amendment (States’ Rights) as the DOJ files a lawsuit to subvert the State of Georgia’s election integrity law that was Georgia Senate Bill 202, that was signed into law in March 2021.

U.S. Constitution -- Amendment X  “The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.”

Known as Georgia Senate Bill SB 202, the legislation attempts to restore and curtail many of the emergency election provisions we put into place during the pandemic. Considering the ongoing Fulton County audit and the recent rejection of Democrat Voting Legislation S.1 (known colloquially as the Democrats Forever Voting Act), the DOJ action is ill-timed and ill-considered. It is a blatant progressive communist democrat ruse.

Why this announcement is ill-times is because there is already a major voting rights challenge before the Supreme Court that would have a material effect on this particular issue. In Mark Brnovich, Attorney General of Arizona, et al., Petitioners v. Democratic National Committee, et al., (Docket 19-1257), the questions presented are:

1. Does Arizona's out-of-precinct policy violate Section 2 of the Voting Rights Act?
2. Does Arizona's ballot-collection law violate Section 2 of the Voting Rights Act or the Fifteenth Amendment?

"At issue here are two such provisions: an "out-of- precinct policy," which does not count provisional ballots cast in person on Election Day outside of the voter's designated precinct, and a "ballot-collection law," known as H.B. 2023, which permits only certain persons (i.e., family and household members, caregivers, mail carriers, and elections officials) to handle another person's completed early ballot."

Essentially, the Court is being asked if the two Arizona rules disproportionately hurt minority voters. And it is consequently because 47 other states have or are about to enact their own version of election integrity laws.

The real, and unasked question, is: are minorities unable, incapable, or unwilling to follow the laws which apply to ALL citizens?

Justice Department Files Lawsuit Against the State of Georgia to Stop Racially Discriminatory Provisions of New Voting Law

The U.S. Justice Department announced today that it filed a lawsuit against the State of Georgia, the Georgia Secretary of State, and the Georgia State Election Board over recent voting procedures adopted by Georgia Senate Bill 202, which was signed into law in March 2021. The United States’ complaint challenges provisions of Senate Bill 202 under Section 2 of the Voting Rights Act.

[OCS: "Section 2 of the Voting Rights Act of 1965 prohibits voting practices or procedures that discriminate on the basis of race, color, or membership in one of the language minority groups identified in Section 4(f)(2) of the Act."]

The right of all eligible citizens to vote is the central pillar of our democracy, the right from which all other rights ultimately flow,” said Attorney General Merrick B. Garland  “This lawsuit is the first step of many we are taking to ensure that all eligible voters can cast a vote; that all lawful votes are counted; and that every voter has access to accurate information.” 

[OCS: The first question that should be considered is a simple one. How does a state ensure that only eligible citizens vote in an election? The answer is also simple; an eligible citizen should be required to prove their identity and eligibility, including residency. The second question involves voting in a prescribed manner, including the timely submission of ballots and any required sworn declarations or affidavits such as those required of provisional voters.]

“The right to vote is one of the most central rights in our democracy and protecting the right to vote for all Americans is at the core of the Civil Rights Division’s mission,” said Assistant Attorney General Kristen Clarke for Justice Department’s Civil Rights Division. “The Department of Justice will use all the tools it has available to ensure that each eligible citizen can register, cast a ballot, and have that ballot counted free from racial discrimination. Laws adopted with a racially motivated purpose, like Georgia Senate Bill 202, simply have no place in democracy today.”

[OCS: Rather than conduct a legitimate investigation after an election and provide testimony and documentary evidence to a court of competent jurisdiction, it appears that the DOJ has summarily concluded that the Georgia law is discriminatory and passed with a racially motivated purpose.

Considering that the alleged (unaudited) results of the 2020 presidential election indicate a record turnout of minority voters, sometimes in excess of those votes cast for Barack Obama, the 2020 election cannot inform the DOJ regarding the new law. And thus, unable to prove harm, the DOJ suit should be summarily dismissed for lack of standing and the failure to demonstrate a cause of action.]

“One of the fundamental rights of our democracy is the right to vote.  That right should be protected for every citizen of our district, regardless of race,” said Acting U.S. Attorney Kurt R. Erskine for the Northern District of Georgia. “The United States Attorney’s Office for the Northern District of Georgia is committed to protecting the rights of all Americans to vote.”     

The United States’ complaint contends that several provisions of Senate Bill 202 were adopted with the purpose of denying or abridging the right to vote on account of race.  The Justice Department’s lawsuit alleges that the cumulative and discriminatory effect of these laws—particularly on Black voters—was known to lawmakers and that lawmakers adopted the law despite this.

[OCS: Amazingly, the DOJ now purports to read minds to determine the intent of those who created, debated, voted, and signed the legislation into law.]

The United States’ complaint challenges several provisions of Senate Bill 202, including a provision banning government entities from distributing unsolicited absentee ballot applications; the imposition of costly and onerous fines on civic organizations, churches and advocacy groups that distribute follow-up absentee ballot applications; the shortening of the deadline to request absentee ballots to 11 days before Election Day; the requirement that voters who do not have identification issued by the Georgia Department of Driver Services photocopy another form of identification in order to request an absentee ballot without allowing for use of the last four digits of a social security number for such applications; significant limitations on counties’ use of absentee ballot drop boxes; the prohibition on efforts by churches and civic groups to provide food or water to persons waiting in long lines to vote; and the prohibition on counting out-of-precinct provisional ballots cast before 5 p.m. on Election Day. The complaint asks the court to prohibit Georgia from enforcing these requirements.

[OCS: There is no constitutional authority for the federal government to regulate the eligibility and distribution of absentee ballots, especially since a ballot dump may compromise the integrity of the election.

It is well known that progressive organizations conduct voter registration drives, statistically inuring to one party, and allowing these same organizations to selectively distribute absentee ballots further compromise the integrity of the election.

As for timelines associated with voting, other than Constitutionally mandated election dates, the federal government appears to be unconstitutionally usurping states’ rights.

The manner in which the state determines eligibility is not a federal issue. To tacitly assume members of a minority cannot adhere to the same rules as the majority is racist and insulting.

The use of uncontrolled absentee ballot drop boxes is a precursor to election fraud and may compromise the integrity of the election.

The provision of food or water to voters waiting in line close to voting places is acceptable as long as there is no connection of the food and water to a candidate, proposition, or a partisan group. This is a specious allegation and is patently false.

Again, the timeline for counting ballots is not a federal matter.

The goal is to get a partisan judge to issue a restraining order to prevent the provisions from being used – regardless of the lawsuit’s merit – while the court hears the matter.] 

Deputy Attorney General Lisa O. Monaco also issued a memo to United States Attorneys and FBI Field Offices today on investigating and prosecuting threats to election officials. To assist with this important effort the department will also establish an intra-Departmental task force to address the rising threats

[OCS: Lisa Monaco should have never been confirmed by the Senate due to her role in promoting the Trump/Russia hoax based on the bogus Steele dossier. She is rabidly partisan and cannot be trusted to provide an honest legal opinion on any matter related to politics.

Considering Monaco’s past involvement with corrupt intelligence and law enforcement agencies, I cannot take anything with her signature at face value.]

Today’s announcements follow Attorney General Garland’s recent commitment to expand the Justice Department’s efforts to safeguard voting rights.  <Source>     

Governor Brian Kemp’s response…

Now, they are weaponizing the U.S. Department of Justice to carry out their far-left agenda that undermines election integrity and empowers federal government overreach in our democracy. As Secretary of State, I fought the Obama Justice Department twice to protect the security of our elections - and won. I look forward to going three for three to ensure it’s easy to vote and hard to cheat in Georgia." <Source>

Bottom line…

The Biden Administration attempted to federalize all voting requirements to the detriment of states’ rights. That having failed, we see the Garland DOJ attempt to do the same thing with state-by-state lawsuits.

Other than the  Tenth Amendment constitutional challenge, the next greatest obstacle to be overcome by the DOJ is that many of these election rules and regulations or similar ones exist unchallenged in other states.

It appears the DOJ is all about progressive communist democrat narrative and not so much about protecting our elections from those who would steal votes.

We are so screwed.

A little reminder that America is so much more than San Francisco, New York, and Washington, D.C. Time to remember that college degrees do not make you smart. And all the race-baiting name-calling does not make you pure of heart. Time to quit wallowing in the misery created by the politicians and other hucksters and build up your own lives. Forget being a hyphened-American victim and return to being an American living in the most exceptional and diverse nation on the planet. PISSED OFF: DISSIDENT OLYMPIC ATHLETES SHOULD NOT REPRESENT THE UNITED STATES

The Olympic athletes that compete under the banner of a nation on the world stage should honor, or at least not disrespect, that nation and its citizens…

Gwen Berry — who qualified for her second U.S. Olympic team during the trials — shifted to face the stands rather than the flag before holding up a black shirt that read, “Activist Athlete.”

“I feel like it was a set-up, and they did it on purpose,” Berry said of the anthem being played. “I was pissed, to be honest. “They had enough opportunities to play the national anthem before we got up there,” Berry said in Oregon, where the trials are being held. “I was thinking about what I should do. Eventually I stayed there and I swayed, I put my shirt over my head.

Despite her own questionable antics while her nation’s anthem played, Berry called out the Olympic trial organizers as being inappropriate — to her. “It was real disrespectful,” she said. ‘”I didn’t really want to be up there,” she said. “Like I said, it was a setup. I was hot, I was ready to take my pictures and get into some shade.”

“They said they were going to play it before we walked out, then they played it when we were out there,” Berry said. “But I don’t really want to talk about the anthem because that’s not important. The anthem doesn’t speak for me. It never has.”

“My purpose and my mission is bigger than sports,” Berry said. “I’m here to represent those … who died due to systemic racism. That’s the important part. That’s why I’m going. That’s why I’m here today.”

This isn’t the first time Berry has caused controversy.

US Olympic athletes were prohibited in January 2020 from making political statements during anthems, after Berry was put on probation for raising her fist during the Pan-American Games in Peru in August 2019.  US Olympic and Paralympic Committee in April reversed course, allowing kneeling and other forms of protests during the national anthem. <Source>

Bottom line…

It is not a free speech issue. 

If Berry is not proud to be an American, kick her unpatriotic, attention-seeking, racist ass off the U.S. Olympic Team and suggest she compete for another nation of her choice. Being a U.S. Olympic Team member is a privilege, not a right.

How do you describe and remedy a reality that you do not like and cannot accept?

Water mismanagement – It’s a man-made drought. California is governed by progressive communist democrats who are captives of communist-infiltrated environmental groups who have stopped the build-out of water containment structures and delivery systems that provide adequate water availability in times of cyclical drought. Likewise, while progressive communist democrats speak of water conservation, water is diverted from farming areas and flushed into the ocean to benefit declining species used as an excuse to advance their toxic political agenda. The truth is that we have approximately the same water storage we had 40 years ago, with more than twice the population today—criminal political malfeasance. And the progressives fight water desalination plants with the same fervor they oppose refineries and nuclear energy plants.

Electrical grid mismanagement – Power outages are not political; they affect everybody, with a disproportionate impact on the poor. It appears that California’s energy operators are engaging in an Enron-style management scheme based on manipulated outages, reductions in reliable energy sources in favor of costly and subsidized green power, and the shut down of electrical grid segments in hot weather to prevent wildfires.

Petroleum production mismanagement – While we can accept that we need special fuel blends for winter and summer, why have no new refineries been built in decades to deal with the rising demand for gasoline? To allow for scarcity pricing when a refinery is taken offline for routine maintenance?

Forest and wilderness mismanagement – There is no doubt that the politicians have abandoned common sense to adopt the irrational de-growth policies of radical communist environmentalists or engage in special interest pandering favored by the special interest unions, developers, and other entities pursuing a toxic agenda.

Why are we ignoring the removal of old-growth dead brush, trees, and undergrowth and paying billions to fight fires in inaccessible terrain or to save a structure that should have never been built in a hazardous place? Union overtime to fight fires when wildfires should be allowed to burn and complete nature’s growth cycle? Allowing developers to build on scenic but dangerous sites without appropriate (and expensive) mitigation measures? Denying the media the spectacle of dramatic audience-pleasing water drops? Why are we ignoring the rising cost of disasters by ignoring hazardous sites and the political subversion of zoning regulations and building codes? The answer is political corruption.

Regulatory Failure – California’s regulatory agencies have been hyper-politicized, and many regulatory commission members are politically compromised. Appointed by politicians or entering through the revolving door from the industry they regulate.  Regulatory agencies settle fines on a “pennies on the stolen dollar” basis that makes fines for getting caught simply another cost of doing business. Likewise, the state rarely claws back funds from egregious waste, fraud, and abuse. And then there are the "wink-wink" court settlements that give the activists what they want without legislation, public scrutiny, or pushback. 

Infrastructure – California’s politicians would rather purchase votes by pandering to special interests, including businesses, unions, and non-governmental agencies, than invest in the repair, replacement, or build-out of California's decaying or dying infrastructure. When money is allocated to infrastructure, it is pissed away on nonsensical items like California’s trillion-dollar faux high-speed rail system to nowhere. When the train’s critics point out that the train is not capable of running at high speeds over existing trackage, the train’s route server virtually nobody, and the project will never reach a financial break even; the answer is to claim that whatever is being done now is a prototype test to secure operational experience. Likewise, money allocated for freeway repair is being used to build non-productive, pollution-trapping sound walls.

Deceptive Accounting – the State’s accounting system is opaque and defective by design. Restricted-use funds are “borrowed” and replaced with worthless “interest-bearing” notes, and the funds shifted to non-restricted uses. A Ponzi scheme dependent on “rolling over” debt or raising taxes to keep making “interest payments.” Unfunded pension liabilities are not properly recorded. Proper actuarial and accounting procedures are ignored or “footnoted.”

Political perversion of the law – Where do politicians have the right to claim a higher moral authority to pander to a portion of the electorate by nullifying certain state or federal laws? Invoke a moral relativism where something does not have to be factually based but can be justified by the politics of privilege or oppression? We are destroying our social safety nets with a hoard of illegal aliens who have not paid into the system or maintain the system with their taxes.

And, there is much, much more than can be said.

THE POST-TRUTH WORLD OF PROGRESSIVE COMMUNIST DEMOCRATS

The progressive communist democrats proclaim, " We are so much smarter and better informed than you, so we have the moral authority to lie about things for your own good. We lie for your benefit, so accept this without objection or opposition, and above all, just don't call us liars".

Bottom line…

With California’s infrastructure under acute stress, we are now seeing the consequences of political malfeasance (an act that is illegal or wrongful), political misfeasance (an act that is legal but improperly performed), political nonfeasance (a failure to act that results in harm) and the ravages of unnecessary waste, fraud, and abuse of public resources – and in many cases, accounting or other systems that are “defective by design.”

California’s progressive communist democrats and professional politicians must be ejected from office and replaced by  Californians who care about California.

CA EDD admits paying as much as $31 billion in unemployment funds to criminals

In an EDD conference call, Julie Su, secretary for the California Labor and Workforce Development Agency said, "Of the 114 billion dollars in unemployment paid by California since March, approximately 10% has been confirmed as fraudulent. An additional 17% of the paid claims have been identified as potentially fraudulent."

That's $11.4 billion confirmed and as much as $20 billion more in fraud. "There is no sugar coating the reality, California did not have sufficient security measures in place to prevent this level of fraud," Su said. <Source>
