In response to Representative Louie Gohmert’s (R-TX) lawsuit (Case 6:20-cv-00660 Document 1 Filed 12/27/20) asking a federal judge to rule that Vice President Mike Pence had the “exclusive authority” to decide which electoral votes to count before a joint session of Congress on January 6, 2021, Vice President Mike Pence requested that the judge reject the lawsuit (Case 6:20-cv-00660-JDK Document 18 Filed 12/31/20). Pence, through his counsel, argued that he was not the “correct defendant,” and there are numerous other issues with the legal action.
The issue arises from the interpretation of the 12th Amendment, “Under the 12th Amendment, the vice president, in his constitutionally prescribed role as president of the Senate, is granted the sole power to ‘open’ the electoral vote certificates and ‘count’ them at the joint session of Congress.” Whereas, the “Electoral Count Act of 1887 contravenes the 12th Amendment—by imbuing (federal) senators and representatives with power that belongs, in the first instance, solely to the vice president, and, once a dispute emerges, solely to the House of Representatives.”
“Plaintiffs’ [Gohmert et al.] suit seeks to empower the Vice President to unilaterally and unreviewably decide objections to the validity of electoral votes, notwithstanding the Electoral Count Act. Plaintiffs are thus not sufficiently adverse to the legal interests of the Vice President to ground a case or controversy under Article III.”
“The relief requested by plaintiffs does not properly lie against the Vice President, and plaintiffs’ suit can be resolved on a number of threshold issues. For the foregoing reasons, the Court should deny plaintiffs’ request for expedited declaratory judgment and emergency injunctive relief against the Vice President.”

In an order of dismissal, U.S. District Judge Jeremy Kernodle ruled that plaintiffs lack standing to bring the legal action that would prevent Pence from confirming Joe Biden’s electoral victory.
"Because neither Congressman Gohmert nor the Nominee-Electors have standing here, the Court is without subject matter jurisdiction to address Plaintiffs’ Emergency Motion or the merits of their claim. HSBC Bank USA, N.A. as Tr. for Merrill Lynch Mortg. Loan v. Crum, 907 F.3d 199, 202 (5th Cir. 2018). The Court therefore DISMISSES the case without prejudice." Other than Senator Josh Hawley (R-MO), Senators Ted Cruz (R-TX), Rick Scott (R-FL), Kelly Loeffler (R-GA), and Rand Paul (R-KY), and Senator-elect Tommy Tuberville (R-AL) ONLY “remain open” to supporting Representative Mo Brooks (R-Al) and others willing to bring electoral challenges before the joint session of Congress on January 6th. All of the Senators are facing increasing pressure from Senate Majority Leader Mitch McConnell, whose family fortunes appear tied to the Communist Chinese government.

The reality: Georgia Senate Subcommittee just passed a motion to request Fulton County Board of Elections makes all absentee ballots cast in Fulton County available for inspection by the Jovan H Pulitzer's group.
What is likely to happen: The Fulton County Board of Elections is expected to run out the clock and render the audit moot while they wait for a court directive.

In short, politicians and others in government lie, omit, and distort the facts as they are rarely held accountable for their actions. If they are caught, they tend to cite systemic problems, unanticipated anomalies, or only human error. My rule is simple unless they are testifying under oath, in a court of competent jurisdiction, anything they say is self-serving and should be subject to investigation and independent validation using multiple unaffiliated sources. And, unlike past times, the media is so thoroughly corrupt that they will hide, omit, or distort demonstrable facts like they did regarding Hunter Biden’s laptop before the 2020 presidential election.
Georgia election officials: Conspiracy claims in presidential vote unfounded
Georgia election officials are offering verified explanations for what they say is innocent behavior — and not misconduct — by ballot counters as viewed on surveillance camera video on Election Day.
[OCS: There is no such thing as a “verified explanation” unless one produces credible evidence of who and how the information was verified and the limits of that verification effort.]
“There are so many things wrong about that news report,” said the elections official, who asked not to be named.
[OCS: As we have seen over the past few years, anonymous sources lie, speculate, and in some cases, knowingly falsify information.]
The bottom line, the source said, based on an internal investigation: Elections officials conducted a statewide bipartisan hand count of every ballot. If a machine had been fed the same ballot multiple times, the scanner’s count would not have matched the hand count, signaling some type of human or mechanical failure. But the recount of each individual paper ballot did confirm the machine numbers, the official said, meaning conspiracy claims are unfounded.
[OCS: Where is the official report and sworn attestations? Feeding counterfeit ballots through the counter will produce a matching count. Without matching the ballot information to the code used to input the tally and verifying the result you have another potential fraud factor. Given the vagaries of human behavior, especially tired individuals doing repetitive handwork, there are bound to be honest discrepancies – again, we need to see the report. What a programmable machine actually does is not always what it is supposed to do – hence the terms “glitch, bug, or anomaly.]
Mr. Trump and his legal team have alleged fraud in the Nov. 3 voting. They claim there was doubling-voting, underage voters and other illegal methods to deliver victory to Mr. Biden in a normally red state that is changing demographically in the Democratic Party’s direction.
Those ballot integrity issues are separate from how the machine count was conducted. To prove a massive illegal vote to change the election, Trump supporters would have to scour individuals ballots, signatures, registration rolls, addresses, ages, citizenship — a task that would likely take months, well into 2021.

Like the national vote, Georgia saw a huge increase in mailed or dropped-off paper ballots due to COVID-19 fears and a big Democratic Party vote drive. Democrats have urged mail voting and worked to remove or reduce integrity requirements, such as signature match, to reduce rejection rates. <Source>
[OCS: The goal of the rules changes had nothing to do with rejection rates and everything to do with enabling systemic ballot fraud.]
Georgia hand tally of votes is complete, affirms Biden lead
While not formally a recount under the letter of state law, the hand tally conducted to complete the audit was effectively a recount in practice. No available evidence suggests a machine recount of ballots already reviewed by hand will result in a different outcome.
The presidential race was selected by Secretary of State Brad Raffensperger for review under a new state law that says one race in the general election must be audited by hand to check that machines counted ballots accurately. Raffensperger said the tight margin of the presidential race meant a full hand count of ballots was necessary to complete the audit.
Votes that hadn’t previously been counted were found in several counties during the audit, which required recertification of the election results in those counties.
In Floyd County, more than 2,500 ballots were discovered during the audit that hadn’t previously been scanned, and the secretary of state’s office had called for the firing of the county’s chief elections clerk, Robert Brady. The county elections board on Thursday voted to issue a written reprimand to Brady and, because it was his second written reprimand within six months, to fire him in accordance with county policy, board member Melanie Conrad said in an email.

Democrats Have Objected to Electoral Vote Certification For the Last 3 GOP Presidents
Democrats are outraged that Republicans are planning on objecting to the certification of electoral votes. It’s “conspiracy and fantasy,” says Senate Minority Leader Chuck Schumer.
“The effort by the sitting President of the United States to overturn the results is patently undemocratic,” the New York Democrat said. “The effort by others to amplify and burnish his ludicrous claims of fraud is equally revolting.”
“This is America. We have elections. We have results. We make arguments based on the fact and reason—not conspiracy and fantasy,” he added.
There’s only one problem with Chucky’s “argument based on fact and reason.” Democrats have been challenging the electoral vote certification for 2 decades.
The last three times a Republican has been elected president — Trump in 2016 and George W. Bush in both 2000 and 2004 — Democrats in the House have brought objections to the electoral votes in states the GOP nominee won. In early 2005 specifically, Sen. Barbara Boxer, D-Calif., along with Rep. Stephanie Tubbs, D-Ohio, objected to Bush’s 2004 electoral votes in Ohio. <Source>

House rules package affirms power to subpoena Trump after he leaves office
House Democrats’ rules package for the next Congress affirms language authorizing committees to subpoena any current or former president and vice president, as well as current and former White House staffers.
The package, released Friday, will set the rules of the road for the House in the 117th Congress if lawmakers vote to ratify it after the new Congress convenes on Sunday. <Source>

My mantra for 2021: If nothing happened and all is well, let third-party independent inspectors review the disputed equipment, ballots, and procedures without interference.
