Day + 18, and the focus has shifted from potential election fraud to denigrating Trump’s legal team…
For those shouting “show me the evidence of election fraud…”
(1) Evidence that is acceptable to the courts comes in five basic forms: physical evidence consisting of objects pertinent to the allegations; documentary evidence pertinent to the allegations and considered to be equivalent to physical evidence; oral testimony under oath pertinent to the allegations; and affidavits pertaining to the allegations which are taken under penalty and considered to be the equivalent of oral testimony. In some cases, the results of expert experiments and demonstrations may also considered evidence.
(2) All evidence is subject to admissibility rules and subject to challenge by the opposition or the judge.
(3) Any attorney or legal team does not owe anything to the media, the general public, nor their opposition to disclose details of future or pending cases. Their duty is to represent their clients and present their case in a court of competent jurisdiction at an appropriate time, mindful of any deadlines that would render their efforts moot and unacceptable to the court.
What is being described as the Giuliani press conference was only meant to counter 24/7 negative media narratives and present a glimpse of the evidence; much in the manner of an opening statement, which is used to describe the case and what the attorneys hope to prove using the evidence that will be presented. The sworn affidavits are evidence. It is up to the opposition and a judge to challenge their truthfulness and applicability before deciding what remedy, if any, can be applied to redress the situation.
It is not over until it is over…
Famed attorney and former Harvard Law School professor Alan Dershowitz has noted that a challenge of all the rules created by election officials and judges, without corresponding actions by state legislatures, may be subject to successful challenge as being unconstitutional. Article II Section I of the U.S. Constitution gives each state the authority to create election rules and to appoint its electors in whatever manner the state Legislature directs -- and not necessarily based on the popular vote. That is assuming there are no “faithless electors” who will vote their conscience and refuse to take orders from the state legislature.
The key goal of Trump’s team would be to deny Biden 270 electoral votes and for the matter to be thrown into the House of Representatives where Trump has a relatively small chance of prevailing. There is no certainty of any outcome.
Where is the media?
For four long years, the mainstream media has published leaks, rumors, and random information about a non-existent Trump/Russia hoax. Actual evidence was either ignored or mischaracterized. One might think that honest journalists working for credible media outlets would be asking their own questions, interviewing participants, and investigating claims of fraud. Most government and large commercial buildings have camera systems. Why has nobody mentioned looking at records that might show the middle-of-the-night vote delivery?
No matter who you are or who you represent, there are so many anomalies and strange happenings that there is a certain circumstantial weight to the plausible assumption that something went very wrong and all major errors benefited Biden.
Personal smell test: I have a hard time believing that a candidate who couldn’t get fifteen people to attend a rally would get millions of more votes than Obama and a guy that packs stadiums. All the votes went in the right direction, in the right places, and at the right (same) times – even while losing large percentages of his core minority constituency groups. And that election officials knew that they would get only a slap on the wrist for breaking the rules.
Even if the allegations that the 2020 election were stolen by an evil cabal of progressive socialist democrats and an evil collection of international leftists who manipulated vote tabulating software to flip millions of votes from Trump to Biden are wrong, any intensive investigation and forensic examination of software would be beneficial to allaying future suspicions and ensure election integrity
We should pay attention to those Republicans who refuse to stand up for the party at this crucial time and given them basement closets for offices, no committee appointments, and no party funding.
