KAMALA HARRIS THE TRIFECTA SENATOR: BLIND, STUPID, AND DISHONEST

Where was Kamala Harris when the House of Representatives was perverting fundamental fairness, justice, and our constitution?

Kamala Harris: Will McConnell Let the Senate Hold a Fair Impeachment Trial?
Every one of my colleagues has an obligation to pursue the truth, regardless of the politics.

Today the House of Representatives will vote on whether to impeach President Trump. If it votes yes, sometime early in the new year I will take an oath on the Senate floor to uphold the Constitution, review evidence and follow the facts wherever they lead, regardless of party or ideology. Every one of my colleagues will be required to do the same.

[OCS: And like almost every one of her progressive socialist Democrat colleagues, she will violate that meaningless oath as fast as she violated the oath of her office – clearly demonstrated by her acquiescence to her party’s ideology as they repeatedly violated the constitution during the course of her tenure in the Senate.] 

As a former prosecutor, I understand the importance of holding powerful people accountable. I know that every trial requires fairness and truth. Having worked my whole life serving the people, I know that any trial that abandons the pursuit of truth cannot be considered fair or just.

[OCS: I did not see Kamala Harris comment on the fundamental unfairness and blatant dishonesty involved in House Intelligence Committee Chair Adam Schiff’s star-chamber proceedings. I did not see Kamala Harris point out the vague, over-broad articles of impeachment which could see every president and government official impeached for what they thought, as interpreted by their opposition, not what they did as evidenced by their actions.]

But the Senate majority leader, Mitch McConnell, appears more interested in covering up the president’s misconduct than in pursuing truth and fairness. He is already trying to limit the impeachment trial by preventing witnesses from testifying, and he has all but announced a verdict. In doing so, he showed the American people that he has no intention of honoring his oath.

[OCS: Excuse me! Harris is a graduate of a prestigious law school and has spent years in the legal system, yet she seems to lack an understanding of the law. First, she is impeached by her first statement that characterizes the President’s actions as “misconduct.” So much for Harris’ impartiality and fairness. Impeachment is not a legal procedure per se, and all of the necessary witnesses should have been called in the House proceedings.

To the extent that the opposition was denied the right to call witnesses or any semblance of due process, that the Chair appears complicit in witness tampering and subornation of perjury, that the Chair deliberately withheld key witnesses using a privilege which did not apply, the entire House proceeding was corrupt. And as such, everything coming from the House should be discarded as the fruit of the poison tree.

If we were suddenly to get all legal, the Senate should dismiss all charges and demand that the House conduct a proper impeachment inquiry under the federal rules of procedure.]

Let’s be clear: Mr. McConnell doesn’t want a Senate trial. He wants a Senate cover-up.

[OCS: What the hell is Harris talking about? One, the so-called whistleblower’s complaint was based on hearsay and contained material errors. Two, the House Intelligence Committee appears to have conspired with the so-called whistleblower and others to create charges out of thin air. Three, there was only one fact witness and he admitted under oath that he “presumed” something the President said meant something different and admitted the President did not tell him anything other than to “do the right thing.”

All other witnesses were disgruntled bureaucrats who had nothing to offer except opinion, supposition, and presumption. Four, the President released the transcript of the call in question and it does not support the House’s conclusion. Both parties to the conversation said there was no offense committed. So why rush through an impeachment on zero evidence of wrongdoing except by the Democrats involved in the process?]

Fortunately, Mr. McConnell does not have the power to unilaterally undermine this trial. Every single senator will be empowered with an equal vote on how the trial will proceed. Though in just the past year, Mr. McConnell has used his position to unilaterally block legislation to restore the Voting Rights Act, lower the prices of prescription drugs and address the gun violence epidemic, he cannot wield the same authority in a Senate impeachment trial.

[OCS: By “blocking legislation,” I assume that Harris means the deeply flawed, unconstitutional, socialistic crap spewed from House Democrats who appeared to suffer from a break in reality. Nothing they propose can alter the fact that individuals commit crimes using whatever weapon is at hand and that criminals, crazies, and terrorists neither respect nor follow the law. To disarm law-abiding citizens in favor of thugs, is not only a violation of the Second Amendment, but an abridgement of our inalienable right to life and self-defense. Socialist price controls do not work and would result in negative consequences in the creation, availability, and distribution of drugs. Changing one law that permits drug manufacturers to sell directly to pharmacies without a mandated middleman would work. We need to clean up our election process – not destroy it along the lines which favor the Democrats.]

In this trial, senators will be far more than jurors. Every one of us will vote to determine the rules for the trial, decide which witnesses testify and ultimately serve as both court and jury. Each of us will be called on to uphold our oath with every decision we make. We will all be held accountable by the American people if we refuse to discover the facts relevant to the articles of impeachment.

[OCS: We saw what a House majority did and it was corrupt. Now let’s see what the Senate will do. Considering gerrymandered districts and one-party states, politicians may not be held accountable to the American people whom they often ignore in favor of their party and special interests.]

The Senate Democratic leader, Chuck Schumer, has made a reasonable request to hear from four additional witnesses with firsthand knowledge of the president’s misconduct and to review documents that shed light on why the administration initially decided to cut off military aid to Ukraine.

[OCS: Chuck Schumer is a schmuck who wants to continue the corruption that we saw in House proceedings on the hopes that they can find something, anything that will convince the American people the Democrats are anything but political lowlifes pursuing a toxic ideology – no matter what the cost to our constitution and “We the People.” Why did not Schumer stand up and say something about his party’s majority denying the opposition the opportunity to call their witnesses? Because he is a corrupt weasel.]

We need to hear from Mick Mulvaney, the acting White House chief of staff, who admitted to Mr. Trump’s bribery scheme on live television, and from the former national security adviser, John Bolton, who has been shopping stories about Mr. Trump to book publishers instead of speaking with Congress. Every senator should want to hear from anyone who can speak directly to the president’s misconduct related to the articles of impeachment.

[OCS: Has Harris never heard about the Separation of Powers, the President’s plenary powers to conduct foreign affairs, or Presidential privileges?

Why should the Senate attempt to recreate what the House clearly failed to do in a competent manner?]

Even Richard Nixon allowed the key figures behind the Watergate scandal to speak to Congress, and he eventually turned over incriminating portions of his Oval Office recordings to investigators. But Mr. Trump has stonewalled Congress and inhibited our ability to seek justice by demanding that those closest to the center of the Ukraine scandal stay silent.

[OCS: This is crap. One, Nixon was accorded due process unlike President Trump. And two, there were significant court rulings – something the Democrats refused to wait for in their rush to impeach a president so close to an election. It seems that they are afraid of what the people may decide, and that decision may be contrary to their plans for the nation.]

Senators must be allowed to subpoena relevant witnesses and submit questions to them directly. The Senate should not vote on any article of impeachment or consider a motion to dismiss the trial until we have reviewed the additional testimony and evidence that Mr. Schumer has requested.

[OCS: Sorry, that’s what the House proceedings were for – and they were botched and corrupted. No do overs.]

I have never been in a courtroom where the accused can unilaterally block witnesses from testifying or prohibit prosecutors from asking witnesses questions. No court would allow a trial to proceed this way, and neither should any member of the Senate.

[OCS: This is not a legal proceeding, it is a political proceeding as the Democrats have told us on numerous occasions. No court would allow what happened in the House of Representatives, but Harris said nothing about this sham “investigation.”]

Ensuring the integrity of this trial is a solemn responsibility for every senator, with consequences that extend far beyond any one presidency. My colleagues and I have a duty to use our voice and our vote to insist on a fair trial, rooted in the pursuit of truth. We must demonstrate to the American people that in our system of justice all are equal under the law, and that there are not two sets of rules, one for Donald Trump and another for everybody else. We must conduct the Senate impeachment trial in a way that is fair and that reflects impartial justice.

History will judge the actions taken by the United States Senate at a time when our Constitution and the rule of law were at stake. I’ll be fighting for justice and accountability, and my colleagues should too.

Nobody bought Kamala Harris as a viable 2020 presidential candidate, so she continues to audition for a vice presidency based on little more than her gender. To my way of thinking, Harris’ mistake was not finding someone like Bill Clinton to sleep with so she could become their heir apparent. and with weathervane politicians such as Kamala Harris.

CALIFORNIA: REPRESENTATIVE JULIA BROWNLEY IS FULL OF SCHIFF

As a response to my respectful letter to Julia Brownley, my representative in California’s 26th district, I received this formulaic reply that has me questioning if Julia Brownley has taken the time to read the relevant documents and actually listen to the hearings. Or, in the alternative, she is just another partisan hack full of Schiff. Referring, of course to the lying, duplicitous, douchebag that heads the House Intelligence Committee.

Here is Brownley’s pathetic response…

As you know, on December 18th, the U.S. House of Representatives impeached the President of the United States, Donald J. Trump. I know many of my constituents support that vote, and some do not.

What I can tell you is that I voted for impeachment after great deliberation, and with a deep sense of duty to the oath I took when sworn into office, that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; and that I will bear true faith and allegiance to the same.

[OCS: I wonder if she understands that the Democrat Party has been infiltrated by socialists, communists, and foreign actors who are acting as a fifth column to destroy our nation from within?]

As you know, the President was charged with abuse of power and obstruction of Congress. These are charges that our Founding Fathers spoke to specifically when they enshrined in our Constitution the right, duty, and obligation of Congress to impeach a sitting President under certain circumstances.

[OCS: No! I seem to remember that the only impeachable offenses in the Constitution are: "Treason, Bribery, or other high Crimes and Misdemeanors." Maladministration, the idea that one faction did not like the policies of the presidency, was specifically rejected as the Founding Fathers attempted to ensure that the presidency never served at the will of congress. Nowhere can you find charges of “abuse of power” or “obstruction of Congress” which are so constitutionally vague as to be meaningless.]

In this case, it is clear, by the President’s own words, corroborated by the testimony of many witnesses, that he withheld $400 million in U.S. foreign aid targeted for the specific purpose of combating Russian aggression.

[OCS: This is a lie. Other than the one fact witness Ambassador Gordon Sondland who testified under oath that the President did not specifically ask him for a quid pro quo and vehemently rejected the idea, all testimony was based on hearsay, opinion, speculation, and presumption. Even worse, the witness who supplied the precipitating complaint was never sworn nor questioned under oath. The opposition was denied the opportunity to call their own witnesses. And, most disturbing of all, it appears that House Intelligence Chair Adam Schiff and his staff conspired to tamper with witnesses, suborn perjury, and, in some cases, may have perjured themselves.]

Let me be clear. Russia is our enemy. Russia repeatedly attempts to undermine our democracy, including by interfering in our elections. Russia repeatedly threatens our national security. Russia repeatedly attempts to undermine our allies. Russia is one of the most corrupt nations in the world, led by one of the most corrupt leaders in the world.

[OCS:  It is true that Russia did try to undermine our democracy and interfere in our elections. As did China, North Korea, and a host of other nations seeking to destroy our national exceptionalism and direct our foreign policy. No surprise here.]

In short, President Trump used $400 million in US aid, intended to protect the American people from Russian aggression, to extort a democratically elected leader of Ukraine to state on CNN that he was investigating Joe Biden’s son.

[OCS: This is another lie. There is no evidence that President Trump misused any US aid to any country. In fact, it was the Democrats in the Obama Administration that withheld lethal aid to Ukraine at a time when their troops were being slaughtered by Russian-backed forced. With nary a peep out of the Congress about Barack Obama failing to protect the American people from Russian aggression.

I have not seen one example of anyone trying to extort the Ukraine President to investigate Joe Biden or his son. The fact that the Ukraine got their aid and there was no announcement of an investigation or an investigation is prima facie proof of the falsity of the charges.]

Think about that for a minute. Our President used your hard-earned taxpayer dollars -- risking the safety and security of every man, woman and child in the country -- to force an embattled leader of a foreign country to provide a sound bite on CNN so that he could cheat in the 2020 elections. I cannot think of a more troubling abuse of power than that. I cannot think of a more corrupt motive than that.

[OCS: That you cannot think should come as no surprise. Perhaps because you are so blinded by party politics or enthrall to the party’s funding of your campaign, that you cannot clearly see the truth.

Joe Biden, by his own recorded words, is guilty of extorting the former Ukraine President into firing a state prosecutor who was looking into one of the most corrupt Ukraine companies that was, not so coincidently, paying hundreds of thousands of dollars to Joe Biden’s son who lacked any qualifications to sit on the corrupt company’s board of directors. And, not a peep from the Congressional Democrats at the time. Now that is corruption: plain, simple to understand, and easy for everyone to witness without any he said/she said/they said hearsay, opinion, speculation, or presumption.

President Trump does not need to cheat in the 2020 election given the selection of radical far left Democrat candidates and their policies which would destroy America as we know it.

And as for corrupt motives, it is another Democrat projection of their actual behavior on the opposition.]

Our Constitution created Congress as a co-equal branch of government specifically so that it can act as a critical check on the President’s power. Our Founding Fathers knew that absolute power tends toward corruption. They knew that if they gave the President control of the military and the responsibility to enforce our domestic laws, that Congress must be given the responsibility and the power to be a check on the President.

[OCS: Absolutely true. But, the powers of Congress are not unlimited and do not abridge or modify the constitutional powers granted to the other branches. The duties of oversight are not unlimited and do not provide for obtaining information protected by presidential privilege or which violate the separation of powers.

And if you were intellectually honest, you would note that the absolute power of the House majority not only tends toward corruption – but perpetrated corrupt acts.]

That’s why Congress was given the power of the purse, the power to issue subpoenas and conduct oversight of the Executive Branch, and the sole power to impeach the President and remove him from office.

[OCS: Again, the power of Congress is not unlimited when it comes to the co-equal branches of government. While Congress can issue subpoenas, it remains a fact that it is up to the Supreme Court to determine if they are lawful. A process that can take months – and apparently was too long for the Democrat’s plans of an “expedited impeachment” process. Not responding to subpoenas which have been challenged is not “Obstruction of Congress,” especially since the Senate was not involved and the entire House was not consulted by a vote. If anything, it was obstruction of  a partisan House majority that was making their own rules, perverting those rules, and then ignoring those rules. The minority was denied their rights under the rules and there was no due process to be found anywhere in Adam Schiff’s secret basement star chamber. It makes one think of  legal proceedings in China or the old Soviet Union.]

Our democracy cannot endure unless the rule of law is supreme, and the rule of law cannot be held supreme unless all people, including the President, are accountable under it. The President’s oath to uphold the Constitution is an oath to respect the Constitution.

[OCS: How you can write this in good conscience is beyond me. The House Democrats destroyed the rule of law, due process, and even the basics of the code of federal regulations and court procedures. As for being above the law, surely you are joking as the Clintons, Bidens, and even Obama and high-ranking members of his administration walk free?]

In this instance, the President obfuscated and refused to comply with lawfully issued subpoenas from Congress. He ordered executive branch employees to refuse to answer subpoenas presented to them by Congress, and he refused to deliver documents subpoenaed by Congress. This is clear obstruction, and it is the type of obstruction that our founders specifically had in mind when they gave Congress the power to impeach.

[OCS: This is not obstruction. And, these were not lawfully issued subpoenas. The Supreme Court did not rule that the subpoenas were necessary, proper, and did not violate presidential privileges and separation of power. The subpoenas were so broad, it might have taken a year or more to prepare a response.

This faux obstruction does not rise to treason, bribery, high crimes or misdemeanors as they were known in the time period of the framers of the Constitution.]

The only remedy for a citizen who refuses to answer a subpoena from law enforcement is jail time, and the only remedy for a President who refuses to answer a subpoena from Congress is impeachment. There can be no rule of law if subpoenas can be ignored. Without the rule of law, our republic cannot stand.

[OCS: Again, a subpoena can be challenged and unless a court compels a response, it is the right of any subpoenaed individual or entity to resist. Then it is up to the issuer to turn to the courts. Something that was not done. In fact, when one subpoenaed member of the Administration turned to the court for guidance, the subpoena was withdrawn and the matter rendered moot.]

As you know, the President chose this path. Most Members of Congress voted repeatedly not to impeach him last year, and as recently as this summer. However, in the face of the extremely damning Muller Report, that outlined 10 instances when President Trump committed crimes, rather than reversing course and abiding by our laws, President Trump doubled-down on his obstruction and criminal abuse of power. He openly stated that he would continue to invite foreign interference in our elections, and then he did precisely that.

[OCS: Blind and stupid – what a combination. The Mueller report contained NO CRIMES. The so-called “invitation” was said as a jest. Another big lie.]

While President Trump chose this path, the only path I could choose, and stay true to my oath to uphold our Constitution, is to impeach. It was a vote as much about this President’s unlawful and immoral actions, as it was to send a message to future Presidents, Republican and Democrat, that no one is above the law, especially not the one person entrusted with the awesome responsibility to uphold the law.

[OCS: I could make the case that former President Obama and others committed actual crimes and yet not a peep out of the Democrats, or even the Republicans. Perhaps, if you understood the Constitution and the depths of corruption within your own party, you might see the error in your judgement.

Morality is subjective and not part of the Constitution or any law of the land. President Trump has not been charged with any federal crime. So there is no support for impeachment.]

President Trump’s repeated statements that he invites illegal, foreign interference in our elections and his repeated current attempts to obstruct Congress’ oversight authority, cannot go unanswered. Further, President Trump’s most recent actions to bribe a foreign government in exchange for his own political gain, using taxpayer dollars appropriated by law to protect our nation's national security, demonstrates Donald Trump's profound and continuing contempt for the rule of law, the security of the American people, and the moral authority the United States has long relied on to promote democracy around the world.

[OCS: We saw the Democrats solicit Russian interference in our election. We saw the Democrats invite Ukraine interference in our election. These are facts. As is the fact that the Democrats got caught spying on American citizens, interfered with a presidential election, and are attempting to interfere in the 2020 presidential election because they have no suitable candidates to challenge President Trump.

Bribe – you mean what Biden did, and President Trump did not do? ]

Under the Constitution, Congress was given not only the right, but the obligation, to consider impeachment should the facts warrant it, as a foundational cornerstone of this great democratic experiment. I voted to impeach Donald Trump because the evidence of his guilt is overwhelming.

[OCS: If anything is overwhelming, it is your partisanship and corruption. President Trump does not stand accused of committing a crime. There is no federal crime in the Articles of Impeachment. If Trump is guilty of anything, it is embarrassing Hillary Clinton, the Democrats, and the media.]

CALIFORNIA CRAZINESS: REBUILD STATE WEBSITE TO "REBUILD TRUST IN CALIFORNIA STATE GOVERNMENT"

You can’t make this stuff up.

The clueless progressive democrat socialists that rule California with an iron hand believe that redesigning the State’s homepage will help rebuild trust in California State government. Absolutely unbelievable, might I say delusional in this one-party socialist state where illegal aliens and gang members are treated better than ordinary law-abiding citizens, where the state imposes severe penalties on those who want to protect themselves from the armed crazies and criminals who roam our communities, released by the progressive socialist democrats as an act of compassion. Or, to be honest, to reduce the number of black and Hispanic criminals in our jails in order to cater to their political base and an upcoming election. It is like someone made a political calculation, the progressive socialist democrats are having trouble convincing Californians to adopt crazy, fantastical public policies that are destined to fail –- so change the people with individuals who lack the capacity to realize they are being scammed and deprived of their inalienable rights and freedoms.

Alpha Team’s Mission: Redesign Homepage, Rebuild Trust

The team has just weeks to design a new, user-friendly homepage for the entire state that can be adopted by other departments and agencies. But its larger goal is to help rebuild trust in California state government.         

[OCS: It is intuitively obvious that the way to rebuild trust in California State government is to reform the government’s corrupt and egregious behavior – not build a pretty website that further lulls Californians into accepting self-destructive public policies that have turned our formerly Golden State into a socialist petri dish that is rapidly approaching third-world standards.]

A small team in a nondescript office in the heart of California’s capital is looking to shake up how government interfaces with residents through a sweeping redesign of the state’s homepage, CA.gov.

The group of 10, a mix of state employees and civic tech experts, has a very small window of time — 12 to 14 weeks to be exact — to fully develop what is being called “Alpha,” a new version of CA.gov featuring better functionality and improved access to services. The site is already live, being built piece by piece with real-time feedback from real-world users.

The California team is expanding on lessons learned during the rollout of Gov.UK and the work of the United Kingdom Digital Service (UKDS), considered a gold standard for user-centered gov tech. Angelica B. Quirarte, the digital engagement lead at the California Government Operations Agency (GovOps), said the UKDS provided the fledgling team insight into how to prioritize items to meet the delivery time window.

[OCS: Has anyone noticed that the seat of California’s state government is in close proximity to Silicon Valley, the acknowledged center of the tech universe. So why would California’s political leaders want to model technology that engages citizens based on a quasi-socialist and failing country that ceded its sovereignty and rule-making authority to the unelected international poohbahs located in Brussels, Belgium?]

“At the end of the 12 weeks, I’d like to have a functional alpha website that has gone through the eyes of actual users that will allow us to tell the stories of why content design and user research matter when it comes to developing websites or just digital services in general,” Quirarte told Government Technology. “We need to move away from websites and into realizing that this is a new era in how government needs to function.” 

The new CA.gov has been designed using Bootstrap, a front-end website component library that is already in use by agencies and departments across the state. With an alpha.ca.gov for these institutions to draw from, a website standardization can be implemented across the state.

“This is part of that overall reconceptualization and reinvigorating the relationship between Californians and their government and rebasing it,” Wilkening said. “CA.gov should really be an embodiment of what that relationship looks like and it should be the place where people come to find out about California government, where they come to find out about services, how they access those services, ultimately it should be the place where they’re coming to apply for those sorts of benefits.”

[OCS: What political bullpucky. The average Californian has little or no reason to trust the progressive socialist democrats who govern California in a cloud of darkness that favors select special interests who kickback campaign funding and voter support to its favored politicians. The people be damned.]

Quirarte said even if the alpha site doesn’t function as initially imagined, the team’s work to rebuild trust between Californians and their government through an open and transparent design process will prove to be success enough. The group will have identified what Californians care about and how they want to interact with their government, she said.

[OCS: Open and transparent is always the promise of California’s political establishment. It never happens, but it does make a good talking point.]

Alpha is for learning and even if I fail, if we fail, that’s still a lesson learned and someone else can pick it up and take it forward,” Quirarte said. “... We’re in it to do the work, we’re in it to make a difference and that’s what we’ve committed to do and we’ll do our best.”

With the progressive democrat socialists, the debate is not how big government should be, it needs to be bigger; it is not about limiting government control over your lives, they need more control because they know how you should live; it is not about lower taxes, but telling you that your labor belongs to the state – and they will give you back your fair share. The 45th President of the United States, Donald J. Trump stands impeached in the House of Representatives on both counts: abuse of power (230 ayes, 197 nays, 1 present, 3 not voting) and obstruction of Congress (229 ayes, 198 nays, 1 present, 3 not voting).

This is a move that cannot be undone and shall forever stain the legacy of President Trump and the legislative legacy of the House of Representatives.

This can be summed up as dangerous and reckless lawlessness as the President has not been accused of breaking a single federal law.

CALIFORNIA CHRISTMAS 2019

For those who do not live in the People’s Republik of California, it is a one-party state dominated by progressive socialist democrats and will do everything in its power to support its corrupt special interests, the most important being the unions that control California politics with campaign funding and voter support…

The progressives at Vox Media fete the passage of AB 5 – a special interest bill that was designed to bring independent contractors in the gig economy under the control of labor unions. The original targets were Uber and Lyft, along with independent construction workers and those in the hospitality industry.

Gig workers’ win in California is a victory for workers everywhere
Millions of people have been working without basic labor protections.

After two hours of debate Tuesday, it happened: The California Senate voted on AB 5. It passed.

Democratic lawmakers applauded. Supporters of the bill cheered online.

“I have tears in my eyes and goosebumps on my limbs,” wrote Veena Dubal, a law professor at University of California Hastings.

AB 5’s passage — which Gov. Gavin Newsom is expected to sign — could easily be seen as just another progressive victory in California. But it is more than that. It is a historic moment for the US labor movement too.

By making it hard for employers to misclassify employees as independent contractors, potentially millions of California workers who’ve been kept off payrolls will get basic labor rights for the first time, like overtime pay and unemployment benefits. This includes janitors, construction workers, security guards, and hotel housekeepers — and yes, this group also includes Uber and Lyft drivers.

“Symbolically, this is huge,” César Rosado Marzán, a labor law professor and co-director of the Institute for Law and the Workplace at the Illinois Institute of Technology, told me. “The pride of California is tech. Now they’re passing a law that says these people are your employees, and you need to take care of them. It shows that labor unions and activists have a lot of pull.”

The passage of AB 5 also means millions of new workers will now have a right to join labor unions. To get a sense of how big this workforce is, consider this: When state tax investigators audited about 8,000 California businesses in 2017, they discovered nearly half a million employees had been misclassified or otherwise left off payrolls.

The rise of misclassification is one reason labor unions have been systematically weakened since the 1980s, William Gould, a law professor at Stanford University and former head of the National Labor Relations Board, told me. That helps explain why only 1 out of 10 workers are unionized today, compared to 3 out of 10 back in the 1950s.

“This legislation will, for the first time really, attack the misclassification phenomenon,” he said.

Pushing AB 5 through the legislature is perhaps one of the most significant labor wins in decades, if only because the labor movement has had very few victories in the past 40 years. But it’s particularly significant because of California’s position as one of the world’s largest economies and its outsized influence in national politics. If any state can start to reverse the trend of shrinking labor unions, it’s California. <Source>

Vox Media to Cut 200 Freelancers, Citing California Gig-Worker Law
A state law meant to target Uber and Lyft has repercussions for contributors to the sports site SB Nation.

More than 200 bloggers in California will lose regular writing gigs because of a state law meant to improve working conditions at companies like Uber and Lyft that rely on contractors rather than employees.

On Monday, Vox Media announced that it would eliminate the 200 freelance positions at its sports outlet, SB Nation, to comply with the legislation.

The affected writers are frequent contributors to the 25 SB Nation blogs focused on California teams. The team-centric sites include Golden State of Mind, for the N.B.A.’s Warriors; Conquest Chronicles, for the University of Southern California sports; and True Blue LA, which covers baseball’s Dodgers. Many of the SB Nation writers contributed dozens of posts to the sites each year for little pay, according to filings in a related lawsuit.

The law, which goes into effect on Jan. 1, “makes it impossible for us to continue with our current California team site structure,” John Ness, executive director at SB Nation, said in a post on Monday, “because it restricts contractors from producing more than 35 written content ‘submissions’ per year.”

About 20 full-time and part-time employees will replace the bloggers, said a person with knowledge of the change who was not authorized to discuss it publicly. Mr. Ness encouraged the regular freelancers to apply for those jobs

When Gov. Gavin Newsom, a Democrat, signed the bill into law in September, it was hailed as a blow against companies like Uber, Lyft and DoorDash, which will have to hire as employees many of the workers they had used as contractors to ferry passengers and food from Point A to Point B. The law is expected to affect at least one million workers.

The law also stated that any photojournalist, editor or writer who contributed to a publication more than 35 times a year would have to be made an employee. <Source>

FISA COURT NEEDS TO GET TOUGH ON IMPROPER COURT PROCEEDINGS

It appears that the Foreign Intelligence Surveillance Court that issues FISA warrants allowing the surveillance of American citizens has taken official notice of  Department of Justice Inspector General Michael Horowitz’s report detailing the abuse of the FISA process by employees of the Federal Bureau of Investigation and the Department Justice.

In an order to the Federal Bureau of Investigation, it appears that the Court is requesting more information and on reforms to prevent this type of abuse.

On December 9, 2019, the government filed with the FISC [Foreign Intelligence Surveillance Court] public and classified versions of the OIG [Office of the Inspector General]  Report The OIG Report describes in detail the preparation of the four applications for electronic surveillance of Mr. Page. It documents troubling instances in which FBI personnel provided information to NSD [National Security Division] which was unsupported or contradicted by information in their possession . It also describes several instances in which FBI personnel withheld from NSD information in their possession which was detrimental to their case for believing that Mr. Page was acting as an agent of a foreign power.

THEREFORE , the Court ORDERS that the government shall, no later than January 10, 2020, inform the Court in a sworn written submission of what it has done, and plans to do, to ensure that the statement of facts in each FBI application accurately and completely reflects information possessed by the FBI that is material to any issue presented by the application.

In the event that the FBI at the time of that submission is not yet able to perform any of the planned steps described in the submission , it shall also include (a) a proposed timetable for implementing such measures and (b) an explanation of why, in the government’s view, the information in FBI applications submitted in the interim should be regarded as reliable.

IT IS FURTHER ORDERED, pursuant to FISC Rule of  Procedure 62 (a), that the government shall, no later than December 20, 2019, complete a declassification review of the above-referenced order of December 5, 2019, in anticipation of the FISC' s publishing that order.

In view of the information released to the public in the OIG Report, the Court expects that such review will entail minimal if any redactions.

In my humble opinion, I would have liked to see a clause that put the FBI, DOJ, CIA, and other government agencies on notice that fraudulent submissions to the FISC will not be tolerated.

IT IS FURTHER ORDERED, that the government, no later than January 10, 2020, show cause why the affiant of each of the court submittals, including those who prepared the original material or we charged with vetting said material for inclusion into a “Verified Complaint” should not be held responsible for their actions with contempt of court proceedings and, if warranted, fines or other penalties.

Bottom line…

As we saw with the Hillary Clinton investigation and non-prosecution for demonstrable violations of the Espionage Act and other criminal activities including, but not limited to, perjury, the destruction of government documents and other property, and subornation of perjury, the government of all branches protects its own – and, as a matter of courtesy, ignores the transgressions of other branches.

While many people believe that the Durham Report, said to be coming this summer, will address these matters, I would not count on anybody significant about a certain level be investigated or prosecuted.

SIXTH 2020 DEMOCRAT DEBATE: THEIR PARTY, POLITICS, AND CANDIDATES STINK

Perhaps the greatest show of Democrat Party politics will not be at the sixth Democratic debate co-hosted by PBS NewsHour and Politico at Loyola Marymount University…

…but behind the scenes as approximately 150 unionized food-service workers hold the entire December 19th debate hostage to their union’s politics. All seven of the candidates will not insult the party’s largest supporters, the unions, by crossing the picket line and are willing to boycott the debate if no settlement is reached. Neither the Democrat Party nor Loyola is involved in the work action which is being taken against the campus food-services contractor Sodexo by Local 11 of Unite Here.

It should surprise nobody that the union’s iconography is like that of other socialist/communist organizations that use the fist and rose…

This frames the debate. Do you want larger government dominated by unionized employees who can eventually fund and elect their chosen politicians? Do you want open borders, a universal right to work, and a $15/hour ($30,000+) minimum wage? Do you want to support the socialists and communists who are infiltrating our government, educational, and social institutions?

Essentially surrendering all that makes an exceptional America and surrendering our nation to third-world living standards and norms? Where life is cheap and people are essentially lawless?

Want to know why college is outrageously expensive and "studies” programs turn out individuals that can mostly find work in the non-profit or government sector?

Watch these people compete to see who can destroy America in the least amount of time with their green new deal, Medicare for none, and other pie-in-the-sky programs.

IT IS YOUR DUTY TO TELL YOUR REPRESENTATIVE HOW YOU FEEL ON IMPEACHMENT

It appears that most House Democrats are not afraid of House Speaker Nancy Pelosi as much as they are unwilling to risk the loss of their cushy positions, perks, and privileges. As long as their campaigns receive Democrat Party-directed funding and union support, they do not seem to care what their constituents may think. Fearing that the Democrats themselves will try to “primary” their incumbency by supporting a rival.

However, it remains your civic duty as a citizen of the United States to let your House Representative know how you feel.

In my case, this is the respectful email I sent to my representative, followed by a phone call to both her local and Washington offices.

I will expect that you will consider the fundamental unfairness and one-sided proceedings of the House Committees that conducted the "unauthorized" House Impeachment inquiry without a vote of the full House of Representatives on the matter of seeking an impeachment inquiry and not a faux vote on procedural matters.

I will expect that you will consider that the Articles of Impeachment that were submitted by the House Judiciary Committee are constitutionally vague and unsupported by cognizable violations of specific federal law.

I will expect that you will consider the necessity to support "We the People" and the welfare of the United States over the position of the Democrat Party which appears to have acted in bad faith on so many issues involving this matter. I specifically cite the behavior and untruths from House Intelligence Committee Chair Adam Schiff.

This is probably one of the most consequential votes of your time. I expect you will do the right thing for the right reasons.

And it pisses me off that Members of Congress can shield themselves from interested parties outside of their districts and states – even though their actions as party leaders are of interest to citizens outside of their district. Perhaps this is for the best considering the messages I might have left for House Speaker Nancy Pelosi, Intelligence Committee Chair Adam Schiff, and Judiciary Committee Chair Jerrold Nadler.

MORE MEDIA MALFEASANCE? MAYOR PETE BUTTIGIEG -- IGNORES HIS COMMUNIST FATHER

If it is true that you are defined by those who raised you and your closest friends, one need only look at the media’s willful and woeful ignorance of the fact that former President Barrack Obama was raised among and counted Marxists, socialists, communists, and violent anti-America domestic terrorists among his friends.

And now the media appears to be repeating the same mistake of willful blindness with 2020 presidential candidate “Mayor Pete” Buttigieg the openly gay candidate whom they tout as being Obama-like. Even to the point of being endorses by Obama’s “body man” Reggie Love who apparently left the campaign to quell rumors of Obama’s alleged gayness and past behavior while in college.

Now we are finding, like Obama’s mentor, Frank Marshall Davis, provided much the same communist influences as Joseph Buttigieg, Mayor Pet’s communist-loving father.

Although other radical influences on Obama, from Jeremiah Wright to Bill Ayers, have been scrutinized, the public knows little about Davis, a card-carrying member of the Communist Party USA, cited by the Associated Press as an “important influence” on Obama, one whom he “looked to” not merely for “advice on living” but as a “father” figure. <Source>

While what is said about Obama’s gayness may have been political slander, what we know about his mentors and friends appears to be the corroborated truth.

Pete Buttigieg's father was a Marxist professor who lauded the Communist Manifesto

The father of Democratic presidential hopeful Pete Buttigieg was a Marxist professor who spoke fondly of the Communist Manifesto and dedicated a significant portion of his academic career to the work of Italian Communist Party founder Antonio Gramsci, an associate of Vladimir Lenin.

Joseph Buttigieg, who died in January at the age of 71, immigrated to the U.S. in the 1970s from Malta and in 1980 joined the University of Notre Dame faculty, where he taught modern European literature and literary theory. He supported an updated version of Marxism that jettisoned some of Marx and Engel's more doctrinaire theories, though he was undoubtedly Marxist.

[OCS: No matter how you paint the picture of utopia, once you start down that road, you need ever greater demonstrations of power to keep the people from revolting and overthrowing an unpopular government.]

He was an adviser to Rethinking Marxism, an academic journal that published articles “that seek to discuss, elaborate, and/or extend Marxian theory,” and a member of the editorial collective of Boundary 2, a journal of postmodern theory, literature, and culture. He spoke at many Rethinking Marxism conferences and other gatherings of prominent Marxists.

In a 2000 paper for Rethinking Marxism critical of the approach of Human Rights Watch, Buttigieg, along with two other authors, refers to "the Marxist project to which we subscribe."        

Paul Kengor, a professor at Grove City College and an expert in communism and progressivism, said Buttigieg was among a group of leftist professors who focused on injecting Marxism into the wider culture.

"They’re part of a wider international community of Marxist theorists and academicians with a particular devotion to the writings of the late Italian Marxist theorist Antonio Gramsci, who died over 80 years ago. Gramsci was all about applying Marxist theory to culture and cultural institutions — what is often referred to as a 'long march through the institutions,' such as film, media, and especially education," Kengor told the Washington Examiner.

[OCS: It appears that Gramsci was correct and now the institutions are mostly dominated by the progressive left – to the detriment of America and all Americans.]

Pete Buttigieg, an only child, shared a close relationship with his father. In his memoir Shortest Way Home, Pete called his dad a “man of the left, no easy thing on a campus ike Notre Dame’s in the 1980s.”     

Buttigieg was a founding member and president of the International Gramsci Society, an organization that aims to “facilitate communication and the exchange of information among the very large number of individuals from all over the world who are interested in Antonio Gramsci's life and work and in the presence of his thought in contemporary culture.”     

Pete Buttigieg said in an MSNBC interview on March 20 that he considers himself a capitalist but that the system needs changes.

[OCS: If you consider the end-point of socialism is totalitarianism and the end-point of capitalism is more capitalism, what possible changes can be implemented other than to support a smaller government, reduced spending, fewer taxes. and less government encroachment on your inalienable rights and personal freedoms?]

“The biggest problem with capitalism right now is the way it's become intertwined with power and is eroding our democracy,” Buttigieg said, noting the influence of big businesses in government.

A self-described progressive, Buttigieg has called to abolish the Electoral College system, supports a pathway to citizenship for illegal immigrants in the Deferred Action for Childhood Arrivals program, and thinks that climate change is a national security threat.

In another MSNBC interview in February, Buttigieg said that socialism “is a word in American politics that has basically lost all meaning” and “has been used as a kill switch to stop an idea from being talked about.”

The words socialism and communism still are tainted with the blood of millions who have died under repressive dictatorships that killed unimaginable numbers of people to make things better for the people. Other than pointing out this toxic ideology’s historical failures, the progressives re-branded lest they be associated with Marxism, socialism, and communism.]

Bottom line…

While Buttigieg, supporters, and the media wield the sword of Mayor Pete’s military service as a shield against insinuation of his anti-America bias, one need only look at the facts that Buttigieg openly speaks of the need to restructure capitalism, abandon U.S. sovereignty to open borders, and subordinate America’s national interests to the international worldview of climate change. Like Obama, Mayor Pete is well-educated (Harvard, Oxford), well-spoken, and telegenic – although I believe he looks like Mad Magazine’s Alfred “What Me Worry?” E. Neuman. And, like Obama, he has limited experience in politics and foreign affairs. Another empty suit.

When is the mainstream media going to swing towards journalism and the concept of a free press that actually speaks truth to power? Or, will they continue down the road as a media arm of the Democrat Party and actively aid and abet the fifth column seeking to destroy America from within.

We had our Obama moment and it almost destroyed the United States with its corruption, incompetence, and scandals. Can we afford another Obama?

Or, more importantly, can we afford a toxic anti-America media?
