CONFIRMED: EBOLA IN DALLAS -- OBAMA'S POLITICS AND INCOMPETENCE TO BLAME?

In the days of Skype, e-mail, and instant messaging, there are few reasons for people to travel outside quarantined areas – oh wait – Obama’s people at the CDC and the TSA did not think there was any real risk of an outbreak in the United States and did not make the call to quarantine visitors with suspicious travel histories. Now, for the first time, we have an Ebola disease vector in the heartland of America.

Confirmed: Ebola In Dallas, Texas …

CDC Confirms Patient In Dallas Has The Ebola Virus

Officials with the Centers for Disease Control have confirmed that a person in Dallas definitely has the Ebola virus. Tuesday’s official determination makes the Dallas patient the first diagnosed Ebola case in the United States.

CDC Director Thomas Frieden related the information that the individual had traveled to Liberia. The person left Liberia on September 19, and arrived in the United States on September 20 with no virus symptoms. Frieden said it was four or five days later that the patient, who is believed to be male, began developing symptoms and was ultimately admitted to Presbyterian Hospital in Dallas on Sunday, September 28.

“We received in our laboratory today specimens from the individual, tested them and they tested positive for Ebola. The State of Texas also operates a laboratory that found the same results,” Frieden said. After the confirmation statement Frieden went on to stress that the testing for Ebola is very accurate, saying that it’s a PCR test of blood.

Now that the virus is confirmed Frieden said the next steps are three-fold. “First, to care for the patient… to provide the most effective care possible, as safely as possible, to keep to an absolute minimum the likelihood or possibility that anyone would become infected. And second, to maximize the chances that the patient might recover.”

Frieden said another important step would be to identify all of the people who may have had contact with the patient while he could have been infectious.

Frieden did state with emphasis that Ebola DOES NOT spread from someone who is not infectious. “It does not spread from someone who doesn’t have fever and other symptoms,” he said. “So, it’s only someone who is sick with Ebola who can spread the disease.”

Officials said once those who had contact with the patient are identified they will be monitored for 21 days after exposure, to see if they develop fever. Frieden said, “If they develop fever then those same criteria are used to isolate them and make sure that they are cared for as well as possible, so that they maximize their chances [for recovery] and to minimize or eliminate the chance that they would infect other people.”

While Ebola has not yet mutated into an airborne virus, the infectious waste from any infected Ebola patient can infect others. And since there are no cures, outside of intensive medical intervention and life support, the probability of accessing life-saving medical care should the virus spread domestically is not good. Add to the commercial airline vector, those who sneak across our borders and you have a recipe for a pandemic disaster.

Cynicism on display …

I am just cynical enough to believe that the progressive socialist democrats will act upon the current crisis and implement some forms of public policy that will enlarge the size and scope of government -- following the counsel of Rahm Emanuel and never letting a crisis go to waste.

Isolation and Quarantine

Isolation and quarantine are public health practices used to stop or limit the spread of disease.

Isolation is used to separate ill persons who have a communicable disease from those who are healthy. Isolation restricts the movement of ill persons to help stop the spread of certain diseases. For example, hospitals use isolation for patients with infectious tuberculosis.

Quarantine is used to separate and restrict the movement of well persons who may have been exposed to a communicable disease to see if they become ill. These people may have been exposed to a disease and do not know it, or they may have the disease but do not show symptoms. Quarantine can also help limit the spread of communicable disease.

Isolation and quarantine are used to protect the public by preventing exposure to infected persons or to persons who may be infected.

In addition to serving as medical functions, isolation and quarantine also are “police power” functions, derived from the right of the state to take action affecting individuals for the benefit of society.

Federal isolation and quarantine are authorized for these communicable diseases:
  • Cholera
  • Diphtheria
  • Infectious tuberculosis
  • Plague
  • Smallpox
  • Yellow fever
  • Viral hemorrhagic fevers
  • Severe acute respiratory syndromes
  • Flu that can cause a pandemic

Federal isolation and quarantine are authorized by Executive Order of the President. The President can revise this list by Executive Order.

Federal Law

The federal government derives its authority for isolation and quarantine from the Commerce Clause of the U.S. Constitution.

Under section 361 of the Public Health Service Act (42 U.S. Code § 264), the U.S. Secretary of Health and Human Services is authorized to take measures to prevent the entry and spread of communicable diseases from foreign countries into the United States and between states.

The authority for carrying out these functions on a daily basis has been delegated to the Centers for Disease Control and Prevention (CDC).

CDC’s Role

Under 42 Code of Federal Regulations parts 70 and 71, CDC is authorized to detain, medically examine, and release persons arriving into the United States and traveling between states who are suspected of carrying these communicable diseases.

As part of its federal authority, CDC routinely monitors persons arriving at U.S. land border crossings and passengers and crew arriving at U.S. ports of entry for signs or symptoms of  communicable diseases.

When alerted about an ill passenger or crew  member by the pilot of a plane or captain of a ship, CDC may detain passengers and crew as  necessary to investigate whether the cause of the illness on board is a communicable disease.

State, Local, and Tribal Law

States have police power functions to protect the health, safety, and welfare of persons within their borders. To control the spread of disease within their borders, states have laws to enforce the use of isolation and quarantine.

These laws can vary from state to state and can be  specific or broad. In some states, local health authorities implement state law. In most states, breaking a quarantine order is a criminal misdemeanor.

Tribes also have police power authority to take actions that promote the health, safety, and welfare of their own tribal members. Tribal health authorities may enforce their own isolation and quarantine laws within tribal lands, if such laws exist.

Who Is in Charge

The federal government
  • Acts to prevent the entry of communicable diseases into the United States. Quarantine and isolation may be used at U.S. ports of entry.
  • Is authorized to take measures to prevent the spread of communicable diseases between states.
  • May accept state and local assistance in enforcing federal quarantine.
  • May assist state and local authorities in preventing the spread of communicable diseases.
State, local, and tribal authorities
  • Enforce isolation and quarantine within their borders.

It is possible for federal, state, local, and tribal health authorities to have and use all at the same time separate but coexisting legal quarantine power in certain events. In the event of a conflict, federal law is supreme.

Enforcement

If a quarantinable disease is suspected or identified, CDC may issue a federal isolation or quarantine order.

Public health authorities at the federal, state, local, and tribal levels may sometimes seek help from police or other law enforcement officers to enforce a public health order.

U.S. Customs and Border Protection and U.S. Coast Guard officers are authorized to help enforce federal quarantine orders.

Breaking a federal quarantine order is punishable by fines and imprisonment.

Federal law allows the conditional release of persons from quarantine if they comply with medical monitoring and surveillance.

Federal Quarantine Rarely used

Large-scale isolation and quarantine was last enforced during the influenza (“Spanish Flu”) pandemic in 1918–1919. In recent history, only a few public health events have prompted federal isolation or quarantine orders.

The commerce clause that was considered by our founding fathers to allow the government to set standards of trade, remove interstate tariffs, and to promote trade and commerce has been used by the government to confer powers that would be prohibited to the federal government and are reserved to the states and the people.

The Commerce Clause refers to Article 1, Section 8, Clause 3 of the U.S. Constitution, which gives Congress the power “to regulate commerce with foreign nations, and among the several states, and with the Indian tribes.” <Source>

There is nothing in this clause that would convey to the federal government or, more specifically, the President of the United States to be able to override the Constitution of the United State and deprive citizens of their constitutional rights for an unspecified period of time and no judicial review or access.

Bottom line …

Both the CDC and the TSA could have imposed travel restrictions an in-country certified quarantines for travelers coming from areas known to have been contaminated by Ebola.

Be safe and demand that your elected officials do their duty to keep America and Americans safe. As we have seen, the diseases of Central America have been introduced to the continental United States by our elected officials who have dispersed children and adults throughout the United States without notification to the cities, counties, and states involved. A potential ticking time bomb has been planted in many communities by Barack Obama and his illegal and lawless immigration programs.
