California A.B. 460: Poorly crafted bill provides fertility treatments to unmarried couples and gays

California medical insurance costs are going up again. This time driven by the gay agenda that sponsored legislation demanding that insurance companies cover infertility treatments for gays without any commonsense safeguards to protect against program abuse. 

ASSEMBLY BILL NUMBER: A.B. 460  -- An act to amend Section 1374.55 of the Health and Safety Code, and to amend Section 10119.6 of the Insurance Code, relating to health care coverage.

Health care coverage: infertility.

(1) Existing law, the Knox-Keene Health Care Service Plan Act of 1975, provides for the regulation of health care service plans by the Department of Managed Health Care and makes a willful violation of the act a crime. Existing law provides for the regulation of health insurers by the Department of Insurance. Existing law also imposes various requirements and restrictions on health care service plans and health insurers, including, among other things, a requirement that every health care service plan contract or health insurance policy that is issued, amended, or renewed on or after January 1, 1990, offer coverage for the treatment of infertility, except in vitro fertilization, under those terms and conditions as may be agreed upon between the group subscriber or the group policyholder and the plan or the insurer, except as provided.

This bill would require that the coverage for the treatment of infertility be offered and provided without discrimination on the basis of age, ancestry, color, disability, domestic partner status, gender, gender expression, gender identity, genetic information, marital status, national origin, race, religion, sex, or sexual orientation. Because a willful violation of the bill's provisions by a health care service plan would be a crime, the bill would impose a state-mandated local program.

About the A.B. 460 author, Tom Ammiano …

Tom Ammiano (born December 15, 1941) is an American politician and LGBT rights activist from San Francisco, California. Ammiano is a Democrat who has served as a member of the California State Assembly since 2008. He had previously been a member of the San Francisco Board of Supervisors and had mounted an unsuccessful bid for mayor of San Francisco in 1999.

Ammiano was in a 16-year domestic partnership with a fellow schoolteacher, Tim Curbo, who died of complications from AIDS in 1994. He has one daughter and is now a grandfather. Aside from his teaching and political careers, Ammiano has been a stand-up comedian since 1980. Ammiano portrayed himself in the 2008 film Milk. He is a member of the California Legislative LGBT Caucus. <Source>

There is little doubt that Ammiano is a San Francisco militant gay activist.

After Ammiano dissed then Governor Schwarzenegger at a high-profile democrat event, shouting “You lie!" and walking out while stating that Schwarzenegger could "kiss my gay ass," Schwarzenegger was so angered that he vetoed one of Ammiano’s bills in an infamous acrostic memo where the first letter of each sentence spelled “F**K YOU.

Bottom line …

Notice that A.B. 460 does not require a couple to be in a committed relationship as expressed by a marriage or civil union or the actual finding of infertility; nor does it require anyone to attempt conception by conventional means, natural or artificial. Therefore, A.B. 460 provides open access to infertility treatments, artificial insemination, and surrogacy births for people who are not in a committed relationship, or are capable of giving birth by conventional means. This poorly crafted bill needs to be re-written so that already skyrocketing medical insurance costs are not unduly forced upward for the purposes of political pandering to a vocal, wealthy and media-savvy voting block. 

Whereas gay marriage via civil union is just and appropriate, it appears that society is not benefited by allowing unrestricted access to healthcare benefits without conventional safeguards such as an existing civil union and a good-faith attempt at conventional means to bear children before investigating further expensive treatments. In an age where treatments for senior citizens may be delayed or denied on a cost basis, I find that the provisions of this poorly written bill to be unconscionable.

Even worse, consider that policies that are adopted in California are often introduced on the national stage. In this case, look for Health and Human Services’ Secretary Kathleen Sebelius to use Administrative Rules and Regulations to add this poorly-crafted provision to Obamacare prior to the 2014 congressional election cycle as a demonstration of democrat/gay relations.

It appears that gays do not want parity, equality or justice – they want rights that exceed the rights available to non-gay citizens.
