Bloomberg Soda Ban in New York City: Unconstitutional and Illegal Interference with Free Trade of a Legal Substance (Updated)

Update: 3/11/13 – HOORAY! JUDGE OVERTURNS BLOOMBERG SODA BAN

New York Supreme Court Judge Milton Tingling has permanently stopped the City of New York from enforcing Mayor Bloomberg’s ban on large sugary drinks. The ban would create an administrative nightmare and is arbitrary and capricious.

Excerpts from the ruling …

However, one thing not seen in any of the Board of Health's powers is the authority to limit or ban a legal item under the guise of "controlling chronic disease," as the Board attempts to do herein.

The simple reading of the Rule leads to the earlier acknowledged uneven enforcement even within a particular City block, much less the City as a whole. Furthermore, as previously discussed, the loopholes in this Rule effectively defeat the stated purpose of the Rule. It is arbitrary and capricious because it applies to some but not all food establishments in the City, it excludes other beverages that have significantly higher concentrations of sugar sweeteners and/or calories on suspect grounds, and the loopholes inherent in the Rule, including but not limited to no limitations on re-fills, defeat and/or· serve to gut the purpose of the Rule.

The Portion Cap Rule, if upheld, would create an administrative Leviathan and violate the separation of powers doctrine. The Rule would not only violate the separation of powers doctrine, it would eviscerate it. Such an evisceration has the potential to be more troubling than sugar sweetened beverages.

Accordingly, the petitioners Notice of Verified Petition dated October 11, 2012, for an order enjoining and permanently restraining the respondents The New York City Department of Health and Mental Hygiene, The New York City Board of Health and Dr. Thomas Farley and any of their agents, officers, and employees from implementing or enforcing §81.53 of the New York City Health Code, as purportedly amended by the Department of Health in September 2012, and declaring §81.53 invalid; alternatively declaring that §§556(c)(2) and (c)(9), 558(b)
and© and/or§ 1043 of the N.Y.C. Charter are unconstitutional and in violation of the separation of powers doctrine; or alternatively, enjoining and permanently restraining the defendants and any of their agents, officers and employees from implementing or enforcing § 81.53 of the New York City Health Code, as purportedly amended by the DOH in September 2012, on the basis that it is arbitrary and capricious; and awarding such further relief including attorneys' fees and the costs and disbursements of this proceeding pursuant to CPLR § 81 01 is granted to the following extent:

The respondents and any of their agents, officers, and employees are hereby enjoined and permanently restrained from implementing or enforcing §81.53 of the New York City Health Code, as purportedly amended by the Department of Health in September 2012, and same is hereby declared to be invalid. It is high time that ‘do gooder democrats” such as Billionaire Mayor Bloomberg be taught that their privileged life and the office which they have purchased does not confer any ability to supersede State or Federal Constitutions.

On March 12, 2013, any restaurant or shop that receives a New York Health Department letter grade will be subject to a $200 fine if they sell a sugary beverage larger than 16-ounces. No more pitchers of soda at Chuck E. Cheese’s children’s birthday parties, no more 2-liter bottles of soda to be delivered with a pizza.

This is an unconstitutional, illegal and unwarranted intrusion into the lives of America citizens living in New York by liberals who believe they have some legal right to dictate the terms and conditions for living in their city – even though their power and funding comes directly from the people they are disadvantaging.

Bloomberg, himself, is exempt from the inconvenience of the rules, regulations and administrivia he promulgates. Perhaps someone should demand that the use of private helicopters to ferry any individual to an estate worth over $10 million should be banned in the name of improving air quality and noise abatement – hurting Bloomberg, a helicopter pilot, where he lives.

Bottom line …

Ignorance and apathy is allowing more government officials to take unwarranted liberties with our freedoms. Which, if unchecked, will lead to a form of totalitarianism by legislation.

OPPOSING NEW YORK "STOP AND FRISK" POLICY -- NAACP IS IN THE GRIEVANCE BUSINESS

The head of the NAACP ignores the fact that blacks commit a disproportionate number of crimes …

The head of the NAACP said Sunday that even some members of the New York Police Department oppose the city's policy of street stops, with mostly minorities being questioned.

Benjamin Jealous, president of the National Association for the Advancement of Colored People, told the congregation of the Nazarene Congregational Church in Brooklyn that the civil rights group is hearing from its members who are NYPD officers.

Addressing Mayor Michael Bloomberg, who was not present, "I ask you, before you leave, repair the damage you have done," Jealous said from the pulpit. "Kids in this city are too afraid of the very people who have sworn to respect and protect them." At his State of the City address several days ago, the mayor "felt the need to evangelize what he sees as the value of the stop-and-frisk program," Jealous said.

He said his speech Sunday was intended as a direct response to the mayor's "fear-mongering."

The NYPD's practice of stopping, questioning and sometimes frisking hundreds of thousands of people on city streets each year has received widespread criticism. Officials say the technique deters crime. Critics say the stops intimidate innocent people and raise issues of racial profiling.

There's "no statistical relationship between stop-and-frisk and New York City's steadily dropping crime rate," said Jealous, adding that there's "increasing discomfort among the rank-and-file of the NYPD about this policy." <Source>

The discussion on Saturday’s (02/23/13) Wall Street Journal Report included a segment about whether or not the lower murder rate in New York justified the current police “stop and frisk” policy which is being opposed by the NAACP because blacks are disproportionally stopped.

The best statement during the discussion came from a Black journalist noting that the Black community welcomes lower crime rates.

Jason Riley of the Wall Street Journal, speaking on the Wall Street Journal Report about New York’s “stop and frisk” policy … “But this is all based on behavior. Black behavior. That’s what [NAACP President] Ben Jealous doesn’t want to talk about. Ben Jealous and the NAACP are interested in maintaining the relevance of the NAACP. They’re in the grievance industry. And the fact of the matter is, they want to ignore the Black behavior that is driving these policies. The Blacks are only 13% of the population, Paul [Gigot, the program moderator], but they’re 50% of the people committing homicides and 90% of their victims are other black people.” 

Well said Jason!

Bottom line …

We know that President Obama and his cadre of socialist fellow travelers in Congress, notably the members of the Congressional Black Caucus, are demanding the disarming of American citizens rather than acknowledge that most of the murders and crime in the nations is committed in democrat-controlled inner cities, many of which already have the strictest gun control laws in the nation. These are the politically correct people who would rather make law abiding citizens more vulnerable to crazies and criminals than note that minorities (the democrat base) are committing the majority of crime.

Call me a racist, but profiling those who actually commit the crimes is a great policy. Political correctness does not mean we need to make ourselves more vulnerable to criminals and crazies to satisfy the feigned anger of black activists who need racial animosity to increase to personally profit from their outrage.

Begins at 2:00 AM on Sunday, March 10, 2013  (Second Sunday in March)

  Ends at 2:00 AM on Sunday, November 3  (First Sunday in November)

Daylight Savings Time is generally not observed in Hawaii and Arizona

Does Daylight Savings Time Work to save energy?

In this era of expensive energy and ever rising costs, I was wondering if the extension of Daylight Savings Time by Congress in ….actually resulted in measurable costs savings. 

In 2005 the 109th Congress enacted P.L. 109-58, the Energy Policy Act of 2005. Section 110 of this Act amends the Uniform Time Act, changing the beginning of DST to the second Sunday in March and the ending of DST to the first Sunday in November.

This change will take effect in March of 2007. The Act requires the Secretary of Commerce to report to Congress within nine months of this date on the impact of this section on energy consumption in the United States. Congress retains the right to revert the Daylight Saving Time back to the 2005 time schedules once the Department study is complete

The report results …

This report presents the results of impacts of Extended Daylight Saving Time on the national energy consumption in the United States. The key findings are:

  • The total electricity savings of Extended Daylight Saving Time were about 1.3 Tera Watt-hour (TWh). This corresponds to 0.5 percent per each day of Extended Daylight Saving Time, or 0.03 percent of electricity consumption over the year. In reference, the total 2007 electricity consumption in the United States was 3,900 TWh.
  • In terms of national primary energy consumption, the electricity savings translate to a reduction of 17 Trillion Btu (TBtu) over the spring and fall Extended Daylight Saving Time periods, or roughly 0.02 percent of total U.S. energy consumption during 2007 of 101,000 TBtu.
  • During Extended Daylight Saving Time, electricity savings generally occurred over a three- to five-hour period in the evening with small increases in usage during the early-morning hours. On a daily percentage basis, electricity savings were slightly greater during the March (spring) extension of Extended Daylight Saving Time than the November (fall) extension. On a regional basis, some southern portions of the United States exhibited slightly smaller impacts of Extended Daylight Saving Time on energy savings compared to the northern regions, a result possibly due to a small, offsetting increase in household air conditioning usage.
  • Changes in national traffic volume and motor gasoline consumption for passenger vehicles in 2007 were determined to be statistically insignificant and therefore, could not be attributed to Extended Daylight Saving Time.

The footnotes …

  • For the statistical analysis, total savings of electricity during the four weeks of EDST in 2007 was 1.2 TWh. This also corresponds to a total primary energy savings of 17 TBtu. The statistical variation on this result is ±40 percent (at a 95 percent level of confidence).
  • Based on the statistical analysis, the average daily percent savings in electricity consumption for the North were 0.51 percent, while in the South the savings were 0.42 percent.
  • There is insufficient statistical evidence that the EDST period has had any measurable impact on motor gasoline consumption for passenger vehicles or traffic volume in 2007.

Bottom line …

The above study tends to illustrate that the energy savings were minimal to non-existent and that the government’s sampling program of energy usage could statistically affect the numbers reported.

Common sense will tell you that energy savings is keyed to two major variables: the state of the economy and the local temperature. If business is booming, more energy will be used to produce goods and services. If temperatures rise, more energy will be consumed by air conditioning, and falling temperatures indicate more energy will be consumed by heating.

In today’s dismal economy, you are likely to find less energy usage as economic activity is depressed, less fuel consumption as fuel prices rise substantially above historical levels, and less use of heating and air conditioning as utility rates rise.

My conclusion, therefore, is that the extended Daylight Savings Time does not mean diddly squat and that our government’s corruption, malfeasance and incompetence has resulted in a lower standard of living while increasing government revenues. This can be best explained with an analogy based in education. More and more money is being poured into a failing educational system when any real progress is managed by dumbing-down the curriculum and the achievement tests so as to disguise the waste, fraud and abuse of the system.

So for all the rhetoric surrounding the justification for an extended daylight savings time, it appears to be little more than governmental liberal “feel good” hot air.

IS YOUR CHILD A RISK FROM AN UNQUALIFIED TEACHER?

If you are like most parents, you may assume that any credentialed teacher can legally step into any classroom and teach to a pre-determined the lesson plan? Unfortunately, you would not only be wrong, but you may have just found the reason why your child is struggling in class … because the teacher may literally know less than the children and is unfamiliar with the subject matter being taught.

Some signs of a questionable teacher may be the use of prepared handouts which are distributed without explanation, a teacher asking the children to read a chapter and answer the questions usually found at the end of a textbook chapter, or quizzed on subject material without adequate instruction or an explanation of the material. Teachers who prefer to use audio/visual materials over lecturing or refer children to online courses at the Kahn Academy or elsewhere should also be suspect.

In California, thousands of teachers missing needed credentials

Charlie Parker, a longtime biology teacher in the Los Angeles Unified School District, was assigned for two years to teach history and social studies – subjects he’s not licensed to teach. Thousands of teachers in California’s public schools every year are placed in classes they lack the credentials or legal authorizations to teach. The last time Charlie Parker took a social studies class, he was a teenager with an Afro and Jimmy Carter was president of the United States. Yet here he was, standing at the front of a classroom, trying to teach dozens of high schoolers subjects that never appealed to him when he learned them more than 30 years ago.

On his first day teaching U.S. history, world history and economics at McAlister High School in Los Angeles nearly four years ago, Parker struggled to keep his course materials straight and handed a student the wrong textbook. Some days, his students’ questions went unanswered or were directed to the Internet. Later, Parker said, when his students took state tests, their scores were low. After school, Parker said, “I was doing homework, just like the kids.”  These were not the troubles of a rookie teacher. In fact, Parker had taught for more than 20 years, including 11 at McAlister.

The problem for Parker, who taught social studies at McAlister for two years and now teaches at another Los Angeles high school, was that he should not have taught history to begin with.

Every year in California, public school administrators assign thousands of teachers to classes for which they lack the credentials or legal authorization to teach. Untrained teachers have been assigned to a variety of difficult classes, including those filled with English-language learners and others with special intellectual and physical needs. Or, in Parker’s case, to teach social studies when they’re credentialed for biology.

Perhaps you should ask more questions about teacher qualifications if your child seems to be underperforming in a class … it might be possible that a gym teacher is teaching chemistry class or a mathematics class.

Disingenuous and Disgusting: Media blame their journalistic and ethical failure on Obama

What to make of a media outlet that claims the Obama and the White House are manipulating the media coverage?

Obama, the puppet master

President Barack Obama is a master at limiting, shaping and manipulating media coverage of himself and his White House.

Not for the reason that conservatives suspect: namely, that a liberal press willingly and eagerly allows itself to get manipulated. Instead, the mastery mostly flows from a White House that has taken old tricks for shaping coverage (staged leaks, friendly interviews) and put them on steroids using new ones (social media, content creation, precision targeting). And it’s an equal opportunity strategy: Media across the ideological spectrum are left scrambling for access.

The results are transformational. With more technology, and fewer resources at many media companies, the balance of power between the White House and press has tipped unmistakably toward the government. This is an arguably dangerous development, and one that the Obama White House — fluent in digital media and no fan of the mainstream press — has exploited cleverly and ruthlessly. And future presidents from both parties will undoubtedly copy and expand on this approach.

I call bullshit! If an honest and courageous media were to print some of Washington’s dirty little secrets – apparently widely known to the media – the balance of power would shift directly to the media. The media that was known in past eras as being able to speak “truth to power” and “let the chips fall where they may.”

Notice how the author suggests that the conservatives suspect that the liberal press willingly and eagerly allows itself to get manipulated. And then goes on to say that the “master mostly flows from a White House" using old tricks for shaping coverage. This is only part of the story. The part the media wants you to believe.

I have an alternate scenario comprised of two parts.

Part one, that the government is intertwined with the business affairs of the large corporations doing business with the government – and that the corporate executives are so afraid for their bottom line and their own jobs that they “go along to get along.” I suspect this is the case with Obama cheerleader General Electric whose media outlets appeared to be all Obama all of the time. Has anyone ever provided a list of government media buys by media outlet? I think not. Has anyone ever provided a list of favorable tax rulings for media companies? I think not.

Part two, that the mainstream media companies are trying to salvage a broken business model in the day of cable news and the internet. Competition for ears and eyeballs is fierce. And, that the mainstream media which much rather have packaged stories handed to them, than spend the time, energy and money pursuing stories on their own. As long as they achieve parity with other mainstream media outlets and preserve the status quo, the appear to satisfy their corporate bosses. It’s not a case of “no guts, no glory,” but rather, “no unexplainable losses, I keep my job.”

Whining, sniveling knackers …

One need only refer to the latest whining from the White House Press Corps about the lack of Obama unavailability on his golf outing with Tiger Woods. A subject that resulted in wasted ink and electrons. The pool reporters aboard Air Force One were offered a few moments of “off the record” coverage – and they agreed. These pool reporters did not do their jobs. They should have told Obama that what he says is not only on the record, but if he did not provide substantive fare, they would simply write about Benghazi and point out the egregious lies he told his fellow Americans. That is, if they had the balls to do it – which they didn’t and apparently don’t. 

Bottom line …

 There is a reason that the mainstream media is failing to maintain their credibility and audience – they lie to the American people by proxy, carrying news coverage that is false, misleading or both. Have you ever wondered why most of the left-leaning cable and internet outlets are not bigger successes? Because Americans are tired of “doom and gloom.” Shrill lies obvious to even the oblivious among us. Calls for continual sacrifice when we see the leader of the free world spending time with celebrities and spending taxpayer’s money with impunity. Precisely the reason that Fox flourishes, Bill O’Reilly has the largest cable audience, and Rush Limbaugh is feted as the savior of AM talk radio. They may have a point of view, but they also present both sides of the story. In fact, wanting the other side to present their story so that they can make their case and point out the untruths.

So when the mainstream media tells the American people that it is Obama that is unfairly manipulating them, it is as big a lie as blaming the 9/11 attack in Benghazi on a little-watched video trailer to cover-up a covert CIA operation to allegedly transfer heavy military arms to terrorists bent on jihad.

Gun Control: Government Dishonesty and the Disarming of Law-Abiding Citizens

It appears that members of the Obama Administration and he fellow democrat travelers will do or say anything to push the tenets of international socialism and the disarming of the law-abiding Americans to reduce the threat of blowback to government tyranny and oppression.

Consider this report, “Summary of Select Firearm Violence Prevention Strategies” by Greg Ridgeway, Ph.D., Deputy Director, National Institute of Justice …

On average there are about 11,000 firearm homicides every year. While there are deaths resulting from accidental discharges and suicides, this document will focus on intentional firearm homicides.

Fatalities from mass shootings (those with 4 or more victims in a particular place and time) account on average for 35 fatalities per year. Policies that address the larger firearm homicide issue will have a far greater impact even if they do not address the particular issues of mass shootings.

This document provides a cursory summary of select initiatives to reduce firearm violence and an assessment of the evidence for the initiative.

 What?, they are suggesting that the government no stress mass shootings because it might be harder to implement draconian public policies which abridge the Second Amendment and disarm law-abiding citizens. Can you imagine how many more people might be killed by crazies and criminals if the broader population were disarmed? It certainly would be higher that 35 per year. And, yet the Obama Administration and its fellow travelers can’t quit talking about Sandy Hook – claiming we must disarm “to protect the children.” The very same children who are thrown under the bus by union domination of education which sees the bulk of our educational dollars spent on facilities and personnel, as reflected in the declining graduation of students from high school. And many of those graduating seeming to be functional illiterates.

Goal: Reduce access to firearms by incentivizing owners to dispose of their unwanted guns rather than transfer them to a more risky possessor

Evidence: Gun buybacks are ineffective as generally implemented. 1. The buybacks are too small to have an impact. 2. The guns turned in are at low risk of ever being used in a crime. 3. Replacement guns are easily acquired. Unless these three points are overcome, a gun buyback cannot be effective.

And, yet police departments continue to engage in fruitless behavior, often citing “if only one child is saved.”

Goal: Reduce the lethality of guns by reducing the number of rounds that can be quickly fired.

Program: Restrictions on the manufacture, sale, transfer, and possession of large capacity magazines (usually defined as holding more than 10 rounds).

Evidence: Mass shootings predominantly involve the use of large capacity magazines. The most lethal ones all involve large capacity magazines. In addition large capacity magazines were used in nearly 25% of all crimes in 1993 just prior to the ban. There is reason to believe that reducing the availability of large capacity magazines could have an effect on the total number of homicides.

Even if true, again, we are talking about disadvantaging a large number of law-abiding citizens by taking away their ability to defend themselves against multiple attackers or well-armed assailants. One need only look at the recent Dorner-related shooting where the police opened up on innocent citizens without warning and used over 30 rounds without killing their intended target. There are times when you need a sufficient number of rounds in a short period of time – anything less tips the battle in favor of the crazies and criminals.

Goal: Limit access to assault weapons.

Program: Ban the manufacture, sale, transfer, or possession of assault weapons.

Evidence: Guns are durable goods. The 1994 law exempted weapons manufactured before 1994. The exemption of pre-1994 models ensures that a large stock, estimated at 1.5 million, of existing weapons would persist. Prior to the 1994 ban, assault weapons were used in 2-8% of crimes. Therefore a complete elimination of assault weapons would not have a large impact on gun homicides.

Bottom line …

When will the honest and courageous members of Congress, if there are any, stand up and explain to the American people that we have a crime control issue, not a gun control issue and that the majority of inner city crime is related to minority gangs preying on other gangs and that much of the perceived outrage is collateral damage from a gang initiations, enforcement of turf and/or retaliations. Obama’s big lie will result in more dead Americans than lost in the Afghanistan war – don’t believe me – it is already true with last year’s Chicago murder rate.

CONGRESSIONAL BLACK CAUCUS IS BOTH RACIST AND CORRUPT -- SO WHY DO THEY EXIST?

With the indictment, conviction and sentencing of Jesse Jackson, Jr., we are once again reminded that there is no reason, other than political correctness, that the Congressional Black Caucus should exist within an American institution.

  1. Many members are openly racist – existing only to promote the aspirations of blacks over others in American society, certainly not favoring the U.S. Constitution and equality under the law.
  2. Many members are supportive of an anti-America, anti-White, pro-socialist viewpoint – serving as representatives of a fifth column serving international socialism.
  3. Many members are disproportionately corrupt. According to statistics, “In 2009, all eight lawmakers under ethics investigation were African-American.”
  4. Many members include some of the most ignorant, unprepared and moronic people in Congress, and were it not for their special interest supporters and gerrymandered districts, would not be in Congress at all. I use as a measuring stick, the arguably most ignorant member of Congress, my California Senator Barbara Boxer. Consider Congressman Hank Johnson from Georgia who worried that too many Navy personnel based on Guam might cause it to tip over. In a Congressional hearing with Admiral Robert Willard, head of the U.S. Pacific Command, Johnson opined “that the whole island will become so overly populated that it will tip over and capsize.”
  5. Had there been a Congressional “White Caucus” the charges of racism would be flying and the press would be in a state of high dudgeon.

A prime example of my disdain for the Congressional Black Caucus can be found in Representative Maxine Waters – who somehow managed to slip the bounds of the ethics committee when she, as a member of Barney Frank’s House Finance Services Committee, put forth efforts to obtain special consideration for a financial institution associated with her husband. Coincidently, it was Barney Frank who helped bring down the Government Sponsored Entities which were the proximate cause of the financial institution’s troubles.

Bottom line …

Perhaps, what irks me the most is the CBC member’s sense of entitlement – as if they should be elevated to the Parthenon and allowed to indulge in their petty corruptions as if somehow we should excuse that behavior because white politicians have been getting away with the same corruption for years. And, while that may have been true – or is still true, I prefer that honest people represent “We the People.” As my Mother taught: two wrongs do not make a right and you don’t excuse bad behavior by pointing to other bad behavior.

Ask yourself, how do these people suddenly get wealthy without working in the private sector? How do they account for the fact that members of Congress have exempted themselves from the very laws which would send ordinary people to jail for trading on insider information? Our America is in rapid decline – and it appears that it is driven by corrupt politicians and their special interests.

Don’t get me wrong, I think all of the special interest caucuses should be disbanded. Members of Congress no longer work for ALL constituents, only those constituents who can provide campaign funding, special perks and privileges and the causes that turn out voters.

Time to throw the bums and their organizations out.

Look around you. Our government’s leadership appears to be both corrupt and incompetent. With the mainstream media focusing on President Obama’s golf outing with a philandering Tiger Woods rather than on the President’s continued lies on important economic and military affairs. Does the President get a pass for lying to the American people about the 4 Americans, Ambassador Stevens included, in the 9/11 attack in Benghazi.?

It’s all trivia and distraction today.

Questions that Obama will never ask, nor answer, about education ...

What is the purpose of education?

A. To develop a self-sufficient, self-sustaining citizen.

B.  To provide financial support to the socialist unions.

C.  To develop obedient, well-trained workers for our industrial society.

D.  All of the above.

If increased taxpayer dollars do not result in increased graduation rates, why will more money equate to more educated students?

A.   More money will NOT result in more educated students.

B.   More money will allow the hiring of better qualified teachers.

C.   More money will allow for the building of modern educational institutions.

D.   All of the above.

If education begins with parents, why are parents not held accountable for the discipline and educational of their children?

A.   They are too busy earning a living, so they cannot be held accountable.

B.   They do not have the requisite education level to help their children, so they cannot be held accountable.

C.   They must turn to government to accept some of the responsibility.

D.    All of the above.

Can the government insure equal opportunities for students?

A.   The government is a dysfunctional, self-serving bureaucracy that cannot mange their own affairs.

B.    The government needs to create unionized work for lower-achieving students to assure equal outcomes.

C.    The government needs to regulate industry to insure they pay higher wages, provide more healthcare benefits, and create pensions for everyone.

D.    All of the above.

The most apt analogy that can be given:  the government should legislate hollowed-out dumbells and weights for gym class so those who cannot lift the weight, feel better about themseves, their school, their teachers, and their government.

Bottom line …

A federal governments obligations to “We the People” are well-defined in the United States Constitution. While the federal government is responsible for the safety and security of the nation, and the overall health of the economy, there is no legal basis for using the taxpayer’s money to produce an equality of outcome rather than an equality of opportunity. There is no legal basis for the federal government to control education. But, there is a legal requirement that the federal government enforce equality under the law, not creating any favored class for political purposes.

So the first thing an educated person might determine is that our government has gone beyond their enumerated powers and that the self-serving corruption of our politicians is destroying our nation.

No wonder they talk about education and do very little to really improve a student’s knowledge of the things that count most in life; self-sufficiency and the ability to live in a self-sustaining manner without government intrusion.

Two people are being questioned in the shooting death of a Janay McFarlane, who was shot to death in North Chicago hours after her little sister sat just feet away as President Barack Obama spoke in Chicago Friday about the violence plaguing the nation. Woman killed in North Chicago was innocent victim of gang violence says dad

Janay McFarlane, 18, was killed late Friday just hours after her younger sister was among a group of teens who were onstage as President Barack Obama gave a speech in Chicago on violence.

The father of an 18-year-old woman shot to death in North Chicago said Sunday he believes the crime was gang-related and that his daughter was an innocent victim. The victim’s father, Joe McFarlane, said police told him the assailant was aiming for a man who was walking with his daughter to a store. He said Janay was in North Chicago to visit relatives and to attend a cousin’s performance with a dance group.

“I’m from the streets and from what I can gather, this was definitely gang-related,” McFarlane said. He said his daughter was not in any gang.  <Source>

When will Obama and his fellow democrat travelers declare gangs as domestic terrorists and purge them from America? You can survive being called the N-word, but you cannot survive a gang bullet.
