This morning the California Supreme Court took action which has the effect of abolishing all of the Redevelopment agencies in California. This is outstanding news. We have featured a lot of content on the FlashReport about the many property rights abuses and crony deals associated with RDA's. Here is a column I penned on this topic. Ashley Titus: There Is A Historic Opportunity To Abolish Redevelopment Agencies - Seize The Moment!

The column begins... "It is ironic that a year ago community redevelopment agencies were high-fiving over California voters' approval of Proposition 22, thought at the time to be the agencies' saving grace from repeated raids of their funds by the state. Today, the California Supreme Court issued an opinion invalidating the agencies' life-line from extinction, finding the Legislature's scheme unconstitutional under a provision added to the Constitution by Proposition 22. As a result, community redevelopment agencies are set to be dissolved on February 1, 2012."

Bottom line …

For decades the special interests, notably property owners and developers have poured millions into political campaigns to allow the use of public money into what is essential a private project or that benefits private interests.

With the Supreme Court’s Kelo ruling, politicians no longer had to worry about confiscating the private property of a private individual to give it to another private individual to use in any manner they decide as long as there was a public benefit such as increasing tax revenues. This was an egregious ruling beyond the original intent of the law; to allow property to be taken (with fair compensation) for public use such as roads, schools, firehouses and similar public needs. This enabled corrupt third-parties to convince politicians, often by way of campaign funds, perks and privileges, to provide windfall profits to developers and others who knew how to manipulate the system.

Thankfully, at least in California, that might be coming to an end.
