Anne Gust Brown: California's Rahm Emanuel? Who will really lead California?

Once again, it appears that an unelected person is going to have great sway in the way California is governed. A czar-of-czars if you will. A steady hand to guide the aging hippie, Jerry Brown through the difficulties of restoring California to its formerly golden status.

Who knew that Californians elected a stealth gubernatorial candidate, one who did not appear on the ballot may affect public policy in a subtle and unaccountable manner.

As reported in the Daily Beast … 

“California voters may have turned down the applications of Whitman and Fiorina for the governorship and a U.S. Senate seat, respectively. But in the very same election, they voted to put a female corporate executive from the Bay Area in charge of their state's government.”

What? The only two women executives for top positions of power were former e-bay executive Meg Whitman and former Hewlett-Packard executive Carly Fiorina. Neither of them democrats and neither of them winning their desired office.

“The name of Anne Gust Brown, a former top lawyer and executive for The Gap, wasn't on the ballot, but it might as well as have been. She served as de facto campaign manager for the campaign of her husband of five years, the once and now future Gov. Jerry Brown. And by all accounts, she will serve as his top aide (albeit on an unpaid basis) as he runs the government.”

Perhaps it is the writer’s perception that Anne Brown should have been on the ballot – but that wasn’t the case and no Californian voted her into a position that could very well be more powerful than the state’s elected (and legitimate) second-in-command, California’s Lieutenant Governor. Additionally, while the Governor can choose anyone he so desires to serve as his Chief of Staff; or in other words, his top aide, this is a paid government position subject to the rules and regulations surrounding government employees.

The tea leaves …

“That's why no one batted an eye when Governor-elect Brown suggested this week that he may not bother appointing a chief of staff. The statement only seemed to confirm that Anne Brown will be in charge, even if she doesn't hold the title. This would be nothing new. She performed a similar role during Brown's just-completed four-year term as California attorney general.”

To hear that Californian’s have seemingly elected a co-governor without appropriate vetting or that Anne Brown may have influenced the actions of the California State Attorney General’s office is deeply troubling.

One, because it it is definitely an indication that Jerry Brown’s age, competence and judgement is being called into question and two, because the significantly younger Anne Brown may have different ideas of her future without Jerry Brown.

“Anne Brown was coy when the subject came up with reporters at a press conference this week. ‘I don't know what my role would be,’ she said. ‘I'm sure that I will be advising him closely because I have been ever since I left The Gap.’”

I do not mind that she has provided insight and guidance to him while he was running for office or struggling with the formation of policy – but I would draw the line at an unelected person making public policy using the governorship as a proxy power. Or by stating that she will be “closely” advising him.

“Her husband was more direct. In his victory speech Tuesday night, he threw off the campaign pretense that his wife was a mere fundraiser. Anne Brown, he said, was ‘the most important person of all, who really ran the whole show and kept me on track.’"

Perhaps, Jerry Brown has become an empty-suit like Barack Obama and Anne Brown is the  éminence grise behind the power somewhat like Rahm Emanuel and Barack Obama.

Which leaves me wondering, who did the people of California really elect?

What an indictment …

“Throughout the campaign, Brown made clear that he envisions his next governorship as a mom-and-pop operation. That this promise did not envision the sort of backlash that President Clinton and Hillary Clinton encountered when they made a similar promise is a testament both to the respect Anne Brown engenders among California elites—and to the lingering concerns about her husband's managerial weaknesses.”

I can hardly forget that the Clintons were majorly corrupt and spent more time pandering to the special interests and pursuing their far-left ideology than they did governing on behalf of “We the People.” Had Bill Clinton kept his pants zipped, there is no telling what our nation could have become or the damage these democrats could have done.

What I want to know is if the state’s ethics requirements apply to the governor’s wife – can she be the person who negotiates with the corrupt unions without having to disclose the existence of the conversation or the content? Does her status as a lawyer give her special privileges when it comes to withholding information from official inquiries?

And to even suggest in print, that it was known that the wife of the governor engenders respect among “California elites” and the fact that there were concerns about the perception of Jerry Brown’s managerial weakness is both troublesome and problematic.

Birds of a feather …

If one had any doubts that RINO Meg Whitman was an elitist billionaire more at home with a democrat-style philosophy of governance, the following comment is telling.

“Even Brown's GOP opponent Meg Whitman, when asked during a debate this fall what she admired most about Brown, responded: ‘I really like his choice of wife. I'm a big fan of Anne Gust.’"

It should also be remembered that Meg Whitman was also openly admiring of far-left radical, and self-described communist, Van Jones.

A marriage of convenience?

While there have always been raised eyebrows at Jerry Brown’s lifestyle, perhaps Brown found marriage necessary to complete his transformation from “Governor Moonbeam” into a serious political candidate at his advanced age.

“Ever since they married in 2005 (it was his first marriage, at the ripe old age of 67), their union has served as a political talisman, cited by Brown's supporters to reassure voters old enough to remember his failings as governor from 1975 to 1983.”

Those concerns run deep. Brown spent much of those two terms on national politics, including two runs for the presidency; now, his supporters say, he's too settled and too old for such foolishness. Brown often was unfocused in his first gubernatorial go-round; in the next, he has a corporate lawyer wife to keep him on task.

“Most crucially, supporters say that Anne Brown may counter one perceived Jerry Brown weakness: his taste for improvisation and his preference for pursuing new ideas while ignoring the crucial nuts-and-bolts of governance.

The Plan …

Even set against the background of a endlessly circulated U-Tube video where Jerry Brown claims that all politicians are lying when they say they have a plan, we find that he truly does lack a specific plan. <Source>

“During the campaign, he raised those old doubts by never offering a coherent plan for dealing with the state's deep budget crisis.”

On election night, Brown explained this by referring to his wife: ‘I don't need a plan when I have such a good planner at my side all the time.’"

Where were the journalists?

Here we find that Joe Mathews, a well-respected reporter  writing in the Daily Beast, has raised significant doubts that Jerry Brown and his style of governance may be suitable for California.

A state deeply mired in debt, mostly caused by democrats who allowed the public employee unions to run wild in good times and their emphasis on the budget-busting social policies that made California a sanctuary city for both illegal aliens and the nation’s indigent. Why California residents have to support 33% of the nation’s poor without assistance is beyond comprehension.

Which illustrates, once again, that the mainstream media simply did not do their job in vetting Brown and his wife against the requirements of a state in deep fiscal trouble. And a state with the obvious need for the public employee unions to obtain a taxpayer bailout before union members sacked the union’s corrupt leadership.

Bottom line …

We are facing another situation where the governance of California is left in the hands of unknown and unelected people.

Even though California has a relatively weak governor when measured against the power of the legislature, diffusing power at the top has a way of promoting decisions which serve the politicians and the special interests or are made solely to serve as public relations statements for the media.

When I hear that Jerry Brown is considering forgoing a traditional Chief of Staff in order to allow his wife to function as a quasi-official government official is just another example of democrat hubris and a sign of a clear and present danger to all of California.

That smart car is smarter than you think. The on-board diagnostic system that continually adjusts engine operating functions to maximize performance and captures faults within the system is also capable of reporting your driving performance to the authorities.

Answering questions that can be used against you in case of an accident. Information involving, speed, direction, throttle position, braking activities – not to mention whether you were wearing seat belts and what electronic devices (phone, radio, cd, iPod) might have been in use?

All which can be made available by subpoena in the case of a lawsuit. To be used to incriminate you; possibly to be used by your insurance company to deny you claim for damages.

Your mobile device is capturing data …

That phone or computer device is smarter than you think. Not only transmitting your location to keep you connected, but transmitting data which can place you at the scene of a crime – possibly to be interrogated by the authorities as a suspect or a witness. That is, in addition to tracking your purchases and your associations with other electronically-tethered people.

That benign game may not be so benign …

Social media activities where you broadcast your location and invite people to join you or where you broadcast your personal preferences and purchases can all serve to attract people who do not wish you well. Especially if you have just stepped out of a high-end shop with expensive electronic, jeweler or other goods.

And now your medicine may be capturing data …

According to published reports in Reuters, “Novartis AG plans to seek regulatory approval within 18 months for a pioneering tablet containing an embedded microchip, bringing the concept of ‘smart-pill’ technology a step closer.”

“The biotech start-up's ingestible chips are activated by stomach acid and send information to a small patch worn on the patient's skin, which can transmit data to a smartphone or send it over the Internet to a doctor.”

“[Trevor Mundel, Novartis Global Head of Development] said the initial project was focused on ensuring that patients took drugs at the right time and got the dose they needed -- a key issue for people after kidney and other transplant operations, when treatment frequently needs adjustment.”

“Longer-term, he hopes to expand the ‘smart pill’ concept to other types of medicine and use the wealth of biometric information the Proteus chip can collect, from heart rate and temperature to body movement, to check that drugs are working properly.”

Is the Fifth Amendment dead?

“No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”

Bottom line …

The misuse of information is becoming extremely problematical; especially misuse that goes beyond identity theft into the realm of jeopardizing your life, liberty and property. And the use of information which is extracted by your implicit agreement to drive vehicles or use modern electronic devices.

We need to adopt new privacy laws with significant penalties for all who violate our trust. Especially those in government and positions of authority who feel compelled to snoop and release the information for personal, professional or profit reasons.

So before you willingly activate that new feature, think ahead how the use of this data may affect you in the future. It is one thing to have a brilliant academic career only to be branded as a “freak” because of your social media postings when seeking employment or a position of responsibility.

Watchdog wants probe of Google's 'unusually close' ties to Obama

"The National Legal and Policy Center (NLPC), a group that advocates for a smaller and more ethical government, wrote to leaders of the House Oversight Committee this month urging them to investigate a major privacy breach by Google. It wants to know if the company's ties to the administration helped it dodge penalties after the incident."

"The group also urges a look at Google's ties to the administration more generally, pointing to what it calls 'a growing body of evidence' that shows the administration's 'unusually close relationship with Google has resulted in favoritism towards the company on federal policy issues."'

I am majorly mad at the rampant dishonesty of the government -- on both sides of the aisle.

The “Bush” Tax Cuts …

Again, believing anything “Bush” is a pejorative, the democrats want to roll back the so-called Bush tax cuts, at least on the wealthy, popularly defined as anyone making more than $250,000 ($500,000 for joint filers), and which covers 90% of small businesses whose owners file as individuals or pass-thru corporations.

But even that is being spun as a “cost” to the American taxpayer.

From the New York Times … 

Permanent cuts would bust the budget. Extending all of them would cost nearly $4 trillion over the next decade — $3.2 trillion for the so-called middle-class cuts and $700 billion for the richest Americans. There is no plausible level of spending cuts to offset the damage; the result would be chronic deficits and debilitating debt. <Source>

Citing that an extension of the Bush tax cuts would cost the taxpayers $4 TRILLION dollars over 10 years is pure and unadulterated nonsense.

One, its our money so it should be left in our pockets, to use as we see fit – and to stimulate the economy with our purchases  that not so coincidently benefit our own welfare -- which is a good thing.

Two, it amounts to about $400 BILLION per year and while that is a significant amount of money, it is $100 BILLION less than the $500 BILLION the Obama Administration gutted from Medicare to fund Obamacare.

Three, no one knows what is likely to happen with Congressional spending in ten minutes, ten hours or ten days; let alone ten years. There are too many events, too many political calculations and too many hands reaching for the pork

And four, anything that keeps the Administration and Congress – both sides included – from spending money is beneficial to the taxpayers.

Both parties claim that they are against waste, fraud and abuse of government programs, so why is so much government money missing or not subject to stringent accounting rules?

Why is it that both sides complain about the waste, fraud and abuse in the Medicare program and we are not hearing about multi-million dollar recoveries of assets? Only about the “estimated” $60 BILLION in fraud – each year! <Source>

Why are criminal defense lawyers getting rich defending criminals and corporate scumbags – acting in seeming complicity with the prosecuting government agencies?

And why is the government settling crimes with corporations who cannot go to jail and allowing their executives to pay record fines without admitting nor denying the allegations – something which can be used against them in civil suits? With all of the investigation and prosecution information flushed down the drain and unavailable to the public.

Sanctimonious politicians lying through their teeth …

Even worse is the sanctimonious nature of the politicians who complain about the American people being under-taxed or not paying their fair share. I am not talking just about the liberal Marxists politicians who are all about confiscatory tax rates and wealth redistribution, I am including the conservative politicians who talk about returning more of the taxpayers money to the public – but not necessarily those who actually paid the taxes.

Who is lying to whom?

Both parties are complicit in raping the Treasury to bring pork back to their districts – to assuage the special interests and to demonstrate to the “public” that they are actually working for the “people.”

Many government programs are nothing but employment programs to keep a certain party or politician in power. Look at the useless military bases which have little or no tactical or strategic value. Look at the vast sums spent on universities for research with little or no practical value. Look at farm price subsidies which go to corporate agribusiness or “gentlemen” farmers – with little or no real money going to family farms. All subsidies costing the consumer billions in increased prices.

The real deal …

Truth-be-told, each politician is complicit in a major fraud against the “we the people.” That they openly solicit and accept campaign donations and proffers of voter support from the lobbyists who insert loopholes, exceptions and outright favorable provisions in the tax code – something which allows American business and the wealthiest of taxpayers to skirt “their” fair share of taxes by manipulating “offshore” accounts far from the jurisdiction and inspection of the Internal Revenue Service.

Recently we found that uber-liberal Google, an ardent financial supporter of the Obama Administration was playing the very same game.

“To reduce its overseas tax bill, Google uses a complicated legal structure that has saved it $3.1 billion since 2007 and boosted last year's overall earnings by 26 percent. While many multinationals use similar structures, Google has managed to lower its overseas tax rate more than its peers in the technology sector. Its rate since 2007 has been 2.4 percent.”

All perfectly legal, Business Week explains how Google profits end up in Bermuda, and shows how multinational corporations pit national tax codes against each other.

“Google's profits travel to the island's white sands via a convoluted route known to tax lawyers as the ‘Double Irish’ and the ‘Dutch Sandwich.’ In Google's case, it generally works like this: When a company in Europe, the Middle East, or Africa purchases a search ad through Google, it sends the money to Google Ireland. The Irish government taxes corporate profits at 12.5 percent, but Google mostly escapes that tax because its earnings don't stay in the Dublin office, which reported a pretax profit of less than 1 percent of revenues in 2008.”

“Irish law makes it difficult for Google to send the money directly to Bermuda without incurring a large tax hit, so the payment makes a brief detour through the Netherlands, since Ireland doesn't tax certain payments to companies in other European Union states. Once the money is in the Netherlands, Google can take advantage of generous Dutch tax laws. Its subsidiary there, Google Netherlands Holdings, is just a shell (it has no employees) and passes on about 99.8 percent of what it collects to Bermuda.”

“Any business or small business playing by the rules in the United States has a distinct disadvantage by this global shell game on corporate profits.”

“One-third of corporate profits goes to tax havens.” <Source>

Tax reform is a joke – on the American people …

Consider for a moment that the head of the committee which writes the tax laws is a scofflaw and a proven income tax cheat. Soon to face charges before the ethics committee. Or consider the Secretary of Treasury, smart enough to assist in running our economy, but who blamed “Turbo Tax” for failing to pay his fair share of taxes. An outright lie that was accepted by the media and his fellow political hacks – even though there was sufficient proof that he was explicitly told of his tax liabilities.

Bottom line …

Now that we have come through the rigors of the 2010 election cycle when it was presumed that politicians would say or do anything to get elected … we have nothing more to look forward to -- with a lame duck congress trying to prevent its power from dissipating in a puff of smoke, and the future 112th Congress trying to force lobbyists and others to pay for the 2012 election cycle.

Reform is unlikely. The people will continue to be screwed by an unfair tax code and by both political parties who have a hammerlock on our nation’s economy.

I am thinking ahead … those who were sent to Congress, this is a warning: don’t be co-opted by your party’s leadership else you find yourself on the doorstep in the next election. Senators, watch your political backs: 1/3 of you are coming up for re-election.

But in the final analysis, we all must do what we all must do to survive in this corrupt society which would rather pander to celebrity and social causes than restore our nation and our economy to greatness. But, as my best friend Al says, “There is always hope.”

Karmic Payback: AARP forced to raise their employees insurance

All during the Obamacare debate, I cautioned readers that AARP was a snake-in-the-grass, openly supporting Obama’s healthcare agenda for the benefit of its leadership’s political ambitions rather than protecting its constituency of senior citizens. That they were more interested in promoting the profit-side of their insurance referral business selling  their medi-gap insurance rather than protecting seniors against a $500 BILLION cut to the Medicare Advantage program.

And now their employees are paying the price, suffering along with the rest of us …

According to the Associated Press …

Citing health overhaul, AARP hikes employee costs

AARP's endorsement helped secure passage of President Barack Obama's health care overhaul. Now the seniors' lobby is telling its employees their insurance costs will rise partly as a result of the law.

In an e-mail to employees, AARP says health care premiums will increase by 8 percent to 13 percent next year because of rapidly rising medical costs.

And AARP adds that it's changing copayments and deductibles to avoid a 40 percent tax on high-cost health plans that takes effect in 2018 under the law. Aerospace giant Boeing also has cited the tax in asking its workers to pay more. Shifting costs to employees lowers the value of a health care plan and acts like an escape hatch from the tax.

The big lie?

“AARP officials say the organization's public policy recommendations are made independently of other considerations, including its range of business ventures, from travel, to insurance, to publishing.”

I don’t believe this for a minute. AARP’s leadership was mostly about supporting Obama and Obamacare – and to preserve its billion dollar revenue stream from selling insurance referrals and other services to seniors. AARP’s lower-level employees seem to mean as little to AARP as do their constituency of senior citizens.

Putting tax loopholes above employee welfare and benefits?

“The 40 million-strong AARP represents people 50 and older, including retirees on Medicare and Social Security. Its endorsement of health care overhaul came at a critical time last year, days before a close vote on the House floor.”

“AARP warned its employees that more cost-shifting could be in store. "AARP intends to make similar changes, as necessary, in the future to avoid the (health plan) tax," said Hodges' e-mail.”

Bottom line …

AARP is more about selling insurance referrals and other products to seniors than it is about protecting the seniors it serves.  And it also appears that they are more willing to adopt Obama’s Marxist politics of sharing the pain and engaging in wealth redistribution than fight for senior citizen rights.

Perhaps the senior leadership of AARP has to resign or be fired in disgrace to bring transparency and accountability back to the organization.

I will have a hard time forgiving the leadership of AARP as it acted like a “Judas Goat” urging its senior citizen constituency to support Obama and Obamacare – knowing they were cutting Medicare programs and instituting a program of cost-cutting denial, delay and death specifically targeted at senior citizens.

Something to consider when dealing with AARP.

There is no doubt in my mind that the mainstream media is mainly composed of reporters who are more interested in their audience stats than they are in providing financial news to their respective audiences. Reveling in celebrity, sex and the bizarre to capture the largest possible audience share. Against this background, very few of us has the time and inclination to research arcane and strangely-worded government media releases.

Here is one  obscure Treasury Department media release which does not explain the obvious … the government is already assisting in bailing out the states – actually by encouraging even more borrowing -- and may be rewarding China in the process.

Treasury Releases New Build America Bonds Data

Recovery Act Bonds Program Provides $106 Billion Nationally to Date, Estimated to Save State and Local Governments Billions Compared to Tax Exempt Bonds

WASHINGTON – The U.S. Department of the Treasury today released its monthly comprehensive update on Build America Bonds issuances, including state-by-state data, showing $106 billion has been issued through May 31, 2010. Build America Bond issuers benefit from substantial savings in borrowing costs when compared to issuing tax-exempt debt.

The Build America Bonds program, created by the American Recovery and Reinvestment Act, allows state and local governments to obtain much-needed financing at lower borrowing costs for new capital projects such as construction of schools and hospitals, development of transportation infrastructure, and water and sewer upgrades.

Under the Build America Bonds program, the Treasury Department makes a direct payment to the state or local governmental issuer in an amount equal to 35 percent of the interest payment on the bonds.

How does it really work …

Authorized by the American Recovery and Reinvestment Act Build America of 2009, Build America Bonds, or BABs as they are colloquially called, are  municipal bonds  whose income is fully taxable to the bondholder but carry special offset tax credits for bondholders and federal subsidies to the bond issuer.

There are two types of BABs:

One, the “Tax Credit” BAB.  provides a Federal subsidy to investors equal to 35% of the interest payable by the issuer. And two, the “Direct Payment” BAB, which provides a direct Federal subsidy that will be paid to state and local governments in an amount equal to 35% of the interest.

Both types of BABs must be issued before January 1, 2011 – although the program is likely to be extended by Congress in the upcoming lame duck session. 

The Treasury Department explains …

“Build America Bonds are a new financing tool for state and local governments. The bonds, which allow a new direct federal payment subsidy, are taxable bonds issued by state and local governments that will give them access to the conventional corporate debt markets. At the election of the state and local governments, the Treasury Department will make a direct payment to the state or local governmental issuer in an amount equal to 35 percent of the interest payment on the Build America Bonds. As a result of this federal subsidy payment, state and local governments will have lower net borrowing costs and be able to reach more sources of borrowing than with more traditional tax-exempt or tax credit bonds. “

“For example, if a state or local government were to issue Build America Bonds at a 10 percent taxable interest rate, the Treasury Department would make a payment directly to the government of 3.5 percent of that interest, and the government’s net borrowing cost would thus be only 6.5 percent on a bond that actually pays 10 percent interest.”  

“This feature will make Build America Bonds attractive to a broader group of investors, and therefore create a larger market than typically invest in more traditional state and local tax-exempt bonds, where interest rates, due to the federal tax exemption, have historically been about 20 percent lower than taxable interest rates. They should be attractive to investors without regard to their tax status or income tax bracket (e.g., pension funds and other tax-exempt investors, investors in low tax brackets, and foreign investors).”

But you would never know it from the legislative language …

SEC. 54AA. BUILD AMERICA BONDS. 

(a) IN GENERAL.—If a taxpayer holds a build America bond on one or more interest payment dates of the bond during any taxable year, there shall be allowed as a credit against the tax imposed by this chapter for the taxable year an amount equal
to the sum of the credits determined under subsection (b) with respect to such dates. 

‘(b) AMOUNT OF CREDIT.—The amount of the credit determined under this subsection with respect to any interest payment date for a build America bond is 35 percent of the amount of interest payable by the issuer with respect to such date .

(c) LIMITATION BASED ON AMOUNT OF TAX.— 

(1) IN GENERAL.—The credit allowed under subsection (a) for any taxable year shall not exceed the excess of— (A) the sum of the regular tax liability (as defined in section 26(b)) plus the tax imposed by section 55, over ‘(B) the sum of the credits allowable under this part (other than subpart C and this subpart).

(2) CARRYOVER OF UNUSED CREDIT.—If the credit allowable under subsection (a) exceeds the limitation imposed by paragraph (1) for such  taxable year, such excess shall be carried to the succeeding taxable year and added to the credit allowable under subsection (a) for such taxable year (determined before the application of paragraph (1) for such succeeding taxable year).

                                 …..

(f) SPECIAL RULES.—

(1) INTEREST ON BUILD AMERICA BONDS INCLUDIBLE IN GROSS INCOME FOR FEDERAL INCOME TAX PURPOSES.—For purposes of this title, interest on any build America bond shall be includible in gross income.

(2) APPLICATION OF CERTAIN RULES.—Rules similar to the rules of subsections (f), (g), (h), and (i) of section 54A shall apply for purposes of the credit allowed under subsection (a).

(g) SPECIAL RULE FOR QUALIFIED BONDS ISSUED BEFORE 2011.—In the case of a qualified bond issued before January 1, 2011—

(1) ISSUER ALLOWED REFUNDABLE CREDIT.—In lieu of any credit allowed under this section with respect to such bond, the issuer of such bond shall be allowed a credit as provided in section 6431.

Bottom line …

More borrowing … While shrouded in governmentalese, it appears that the federal government is encouraging the individual states to encumber themselves with even more debt to both paper over existing budgetary deficits and to keep public employees working on government-controlled projects. All at taxpayer expense and without taxpayer approval.

It also appears that the largest holders of these bonds are not individuals but foreign central banks, foreign commercial banks, insurance companies and mutual funds as they are yielding 2% more than corresponding  Treasury Securities – and thus are extremely attractive to the global wealth pool seeking both safety and yield. 

In the just-passed election cycle of 2010, I urged voters to elect “honest brokers” to serve “we the people.” I now urge all taxpayers to demand that their legislators support “single-purpose” bills which do not contain loopholes, exceptions, special provisions and are not written in governmentalese.

It is our government, our money and they should be working for us – not the public employees unions and special interests.

CALIFORNIA: THE ALTERNATIVE VIEW OF REALITY

Was it the public employees, the union support and the efforts of the special interests that pushed California into  assisted suicide using liberal democrats as the weapon?

Turning the leadership of the state over to an aging hippie Marxist whose views are decidedly anti-business and pro-Marxist liberalism? Promoting population clustering, mass transit and open arms for the illegal aliens who are loudly demanding the rights of citizens, if not citizenship itself?

Replacing the current anti-business, pro-environmentalist Attorney General with one who is more anti-business, pro-environmentalist – and who believes criminals need to be treated, not punished?

Electing the very same people who made backroom deals with the unions which resulted in unsustainable costs, reduced efficiencies, poorly educated children and work rules which virtually guaranteed a lock out of innovative people and ideas? The same people who must answer to the unions when they request that the public taxpayers bail out their unfunded pension obligations which permit public employees to live the “good life” while those in the private sector pay for their pleasures?

What the hell happened to Californians?

Are most Californians so stupid as to realize that you could shut down every industry in California, plow under every crop, kill every animal and ship all of the citizens elsewhere – and it still would not have a measurable effect on the planet’s mean global temperature?

Apparently we are not alone in our delusions. It seems that Massachusetts ignored overwhelming evidence that Barney Frank played a major role in the mortgage meltdown which triggered the current financial fiasco, yet he was re-elected. And Alaska’s Lisa Murkowski, nominated to office by her powerful daddy, was returned to office by a write-in vote.   

If taxes are raised, illegal aliens are provided with the rights of citizens and global warming initiatives are enacted, one can only think that the outflow of citizens and industry to neighboring states will increase to the point of insurrection.

Bottom line …

It appears that Californians were not suffering sufficient regulatory and fiscal pain – or the majority worked for the government – to change the corrupt and chaotic political system in California.

That the Republican Party in California was so corrupt as to let a billionaire and a millionaire neophyte attempt to mount a serious political campaign – using their money to shield them from complaints that they were full of platitudes and totally bereft of solutions.

I do not know where we are going, but it is time to reassess one’s position as a native Californian and dealing with day-to-day events.

I wish you all good luck on the bumpy journey of sacrifice and deprivation we are about to encounter as the union’s remoras and bottom-dwellers starve the life out of the California political, social and financial ec0-system.

Surprisingly, as of this date, we have not heard of any indications of fraud or malfeasance in the counting process.

For governor I recommend Meg Whitman. She is more liberal than I like and smarter than the RINO (Republican In Name Only) poseur Arnold Schwarzenegger. Here I have to hold my nose to vote for Maldonado, who reneged on his “no new taxes” pledge to vote with the democrats to give California one of the largest tax increases in history. As his reward, Schwarzenegger named him as the interim Lt. Governor.

Gavin Newsom, another ultra-liberal maintained a sanctuary city, was complicit in the practice of shielding violent illegal aliens and openly pandered to the gays to maintain his position. He is responsible for the deaths of a father and his two sons at the hands of an illegal alien gang member who was processed by Newsom’s system and set free to kill again. It should be noted that Maldonado is an open borders advocate and likely to be little or no help when it comes to issues of illegal aliens. I am glad he Lt. Governor has little actual power in California.

Steve Cooley has done a credible job in Southern California and there is absolutely no way I would vote for the ultra-liberal Kamala Harris who is not only soft on crime, but believes criminals need to be rehabilitated rather than punished. Bottom Line …

Californians clearly blew one of our only chances to restore California to its golden status. But if we continue to perpetuate a one-party state, we have essentially given the corrupt and Marxist democrat liberals carte blanche to continue their turnover of this State to Mexico and to promote their anti-business global warming policies which will do nothing measurable to change our global climate.

California will remain a haven for illegal aliens and welfare recipients. As taxes continue to rise and more onerous rules and regulations imposed, more wealthy individuals and businesses will move out of state – making the financial  and social situation untenable and unlivable. Perhaps exactly what the Marxists want.

We have voted ourselves into oblivion if the democrats continue the very activities which have decimated our state treasury and wreaked havoc on our social infrastructure.

I guess the bottom line is that the pain was not great enough to overcome the democrat’s union support and dirty tricks.

2010 CALIFORNIA PROPOSITIONS–– FINAL RESULTS (100% –- 24,845 PRECINCTS REPORTING)

To all who have voted … thank you for doing your civic duty and helping to improve the governance of California.

While some of us will be disappointed with the results, such is life. It is wise to remember that our founding fathers not only provided a great guideline to an exceptional society, they also provided a way to remedy any mistakes that may have been made by the people – by simply voting in the next election.

Those who wish to check the status of their absentee or provisional ballot, it can be done by calling one of the telephone numbers listed on the California Secretary of State’s “Check Status of Your Ballot” web site. 

So for better or worse, here are the RESULTS!

Thumbs Up Clip ArtDEFEATED – CHAOTIC, POORLY WRITTEN LAW THAT WOULD HAVE BEEN CHALLENGED IN FEDERAL COURT.

Allows people 21 years old or older to possess, cultivate, or transport marijuana for personal use. Fiscal Impact: Depending on federal, state, and local government actions, potential increased tax and fee revenues in the hundreds of millions of dollars annually and potential correctional savings of several tens of millions of dollars annually.

YES -- A YES vote on this measure means: Individuals age 21 or older could, under state law, possess and cultivate limited amounts of marijuana for personal use. In addition, the state and local governments could authorize, regulate, and tax commercial marijuana-related activities under certain conditions. NO -- A NO vote on this measure means: The possession and cultivation of marijuana for personal use and commercial marijuana-related activities would remain illegal under state law, unless allowed under the state's existing medical marijuana law.

OCS -- I urge a NO vote on Proposition 19 which is little more than a ruse by the democrats to turn out the youth vote in an election with a projected low turnout. This proposition does not affect the current medical marijuana laws and will not supersede federal laws which take precedence over state law.

Even if Prop. 19 passes, federal drug laws will be 'vigorously' enforced, official says

"U.S. Atty. Gen. Eric H. Holder Jr., in a letter sent Wednesday to nine former chiefs of the U.S. Drug Enforcement Administration, wrote, 'Let me state clearly that the Department of Justice strongly opposes Proposition 19. If passed, this legislation will greatly complicate federal drug enforcement efforts to the detriment of our citizens.'"

This is nothing more than a political ploy to drive turnout. It is not a serious effort to solve the drug problem.

YES -- A YES vote on this measure means: The responsibility to determine the boundaries of California's districts in the U.S. House of Representatives would be moved to the Citizens Redistricting Commission, a commission established by Proposition 11 in 2008. (Proposition 27 on this ballot also concerns redistricting issues. If both Proposition 20 and Proposition 27 are approved by voters, the proposition receiving the greater number of "yes" votes would be the only one to go into effect.)

NO -- A NO vote on this measure means: The responsibility to determine the boundaries of California's districts in the U.S. House of Representatives would remain with the Legislature.

OCS I urge a YES vote on Proposition 20 because “we the people” are tired of being subject to the “special deals” made by state legislators to keep certain “pre-arranged” districts firmly within the party’s control. Thus our so-called legislators have been able to manipulate elections for years to insure long-term incumbencies which works against “we the people” and promotes a sense of entitlement – often combined with some degree of corruption.

As columnist George Will noted: "If Democrats lose control of the House by a small number of seats, this might be condign punishment for a practice they favor and that Republicans have cynically encouraged — racial gerrymandering. It concentrates African-American voters in majority-minority districts in order to guarantee the election of minority candidates." <Source>

Minority candidates who DO NOT represent ALL of the people -- only their minorities; viewing everything through the prism of the self-serving personal interests. The reason why local corruption blossoms.

We need to put the redistricting process back into the hands of the citizens of California.

Please note: this is one of two redistricting proposals. We also urge a NO vote on the deceptive Proposition 27 which would abolish the Citizen’s Redistricting Commission and return to control over redistricting to corrupt and self-serving legislators.

21 - ESTABLISHES $18 ANNUAL VEHICLE LICENSE SURCHARGE TO HELP FUND STATE PARKS AND WILDLIFE PROGRAMS. GRANTS SURCHARGED VEHICLES FREE ADMISSION TO ALL STATE PARKS. INITIATIVE STATUTE.

Exempts commercial vehicles, trailers and trailer coaches from the surcharge. Fiscal Impact: Annual increase to state revenues of $500 million from surcharge on vehicle registrations. After offsetting some existing funding sources, these revenues would provide at least $250 million more annually for state parks and wildlife conservation.

YES - A YES vote on this measure means: An $18 annual surcharge would be added to the amount paid when a person registers a motor vehicle. The surcharge revenues would be used to provide funding for state park and wildlife conservation programs. Vehicles subject to the surcharge would have free admission and parking at all state parks.

NO --A NO vote on this measure means: State park and wildlife conservation programs would continue to be funded through existing state and local funding sources. Admission and parking fees could continue to be charged for vehicles entering state parks.

OCS I urge a NO vote on Proposition 21. This is a legislative ploy to allow the legislature to surcharge vehicles for non-vehicle projects, thus raising vehicle registration fees to fund legislative special projects. It also serves to provide funding to unionized public employees to insure their full employment during times of budgetary crisis. Since there are other methods to fund state parts and wildlife programs, this is a sham to establish the poor precedent of allowing vehicles to be surcharge for legislative “special projects.” One such future project may involve funding medical expenses for illegal aliens hurt in vehicular accidents.

This places a burden on all vehicle owners with the promise of free admission to state parks for only a relatively few Californians.

The measure is deceptive and I urge a NO vote.

Prohibits State, even during severe fiscal hardship, from delaying distribution of tax revenues for these purposes. Fiscal Impact: Decreased state General Fund spending and/or increased state revenues, probably in the range of $1 billion to several billions of dollars annually. OCS I urge a YES vote on Proposition 23 to save California from environmentalists who have already put forth onerous rules and regulations which would cripple California’s businesses and drive both people and businesses from California to more business-friendly states.

Without discussing the scientific validity of global warming, suffice it to say that California, acting alone and in a leadership position, will have absolutely no measureable effect on the Earth’s global climate and will place California at a significant competitive disadvantage with other states and nations.

It would be folly, in these hard economic times to cripple California’s economy and raise all energy prices for California residents. Therefore, I most strongly urge a YES vote.

NO -- A NO vote on this measure means: Three business tax provisions that were recently changed will not be affected. As a result of maintaining current law: (1) a business will be able to deduct losses in one year against income in more situations, (2) most multistate businesses could choose to have their California income determined based only on a single sales factor, and (3) a business will be able to share its tax credits with related businesses.

OCS – California is not a business-friendly state, both on matters of taxation and onerous rules and regulations. Unions and their public employees want to suck every available dollar out of corporations to fund their social justice programs. Therefore, I strongly urge a NO vote on this matter lest we, once again, disadvantage California’s businesses in a competitive environment – all for the benefit of public employees. Again, I urge a NO vote.

Legislature permanently forfeits daily salary and expenses until budget bill passes. Fiscal Impact: In some years, the contents of the state budget could be changed due to the lower legislative vote requirement in this measure. The extent of changes would depend on the Legislature's future actions.

OCS – California is a one-party state run by the democrats, therefore I urge a NO vote on proposition 25 to require a two-thirds vote on budgetary items lest the democrats pass funding initiatives without regard to any opposition. Considering the past performance of the democrats who have shown little or no fiscal responsibility in funding their “social justice” initiatives to fund environmental projects and provide aid and comfort to illegal aliens to the detriment of legal California citizens, reducing the voting requirements to a simple majority would be extremely irresponsible and dangerous to California’s continuing survival.

Once more, we find our formerly golden state in jeopardy from the corrupt democrats and complacent republicans who have managed to perpetuate their one-party rule. With few exceptions, definitely not “honest brokers” to serve “we the people.”

I would be prepared to initiate a recall process involving all of our elected officials if they continue to pander to the illegal aliens and special interests who are destroying our state and pushing us ever onward towards bankruptcy.

2010 ELECTION: WINNERS AND LOSERS

Folks, in the midst of celebrating a few select political victories, I was struck by the overwhelming reality of the situation. Set against the nation’s economic and employment woes, here are some of the issues on my mind.

1.   Some of the most odious democrats  have been elected or reelected to office in both state and national races. Although the House will be in the hands of the Republicans and the changing of the leadership of committees; there is plenty of time for a “lame duck” Congress to wreak additional havoc on the United States. In some States, California in particular, democrats retained local and state control – something which speaks to continuing chaos, confusion and corruption.

2.   While it appears that angry Americans have somewhat repudiated Obama and his radical far-left policies, it appears that we will not know for some time whether or not Obama and the Congressional democrats will get the message to moderate and/or remediate their policies with respect to spending, Obamacare, cap-and-trade and the use of government funds to bailout private companies.

3.   Looming large on the horizon is the issue of national security. Foreign problems involving Iran, North Korea and Pakistan and domestic problems involving the threat of indigenous Muslim terrorism and the economic and social problems posed by illegal aliens and open borders.

4.   Also looming large on the horizon is the resolution of the nation’s two largest mortgage companies, Fannie Mae and Freddie Mac, who are associated with approximately 90% of the nation’s mortgages. Both institutions have been proven to be rife with corruption and their use as instruments of public policy by the democrats. Unless the government stops meddling in housing affairs and the real estate market is allowed to establish a true bottom, the valuation of real estate assets will continue to be suspect. 

5.   Not to forget trade issues with our foreign trading partners, specifically China. There is also clear evidence that the democrats will continue their policy of ignoring the prudent promotion of nuclear energy to achieve energy independence and their insistence on “green” energy sources that are not stable and cost-effective. All based on highly-manipulated pseudo-science. 

6.   Of course, politicians who believe that the answer to all problems is governmental intervention with legislation and the increasing federal criminalization of state issues, must repeal large amounts of existing legislation and reduce the number and complexity of proposed laws, rules and regulations. No more unread 2000+ page bills.

7.   The White House must refrain from doing an end-run around Congress using Administrative rules and unaccountable czars to promote their political agenda. 

8.   The night’s results were tempered by the inability of the Republicans to put forth a conservative narrative that provided both clear leadership and a pro-American agenda. Instead they seemed to go with the flow and let the dissatisfaction with Obama and the dysfunctional one-party-rule Congress become the narrative.

9.   The mainstream media still appears to continue sacrificing their journalistic integrity and ethics to put forward a biased viewpoint in their news and commentary.

So pardon me while I do not consider this election a historic expression of the people’s will. Even factoring in all of the procedural election problems and the maneuvering of the unions, the people’s voice remained somewhat weaker than was originally projected by the pundits. 

Bottom line …

There were clear winners and a clear loser. The winners were the political parties who survived a near-death experience and who will be plotting their come-back after they get some sleep.

And, unfortunately, the clear loser was the American public as both parties are going to concentrate on rebuilding their financial reserves by cutting even more outrageous deals with the special interests who pumped a record amount of money into the 2010 election cycle.

The fight has never been sharper.

Wall Street and the Unions will continue to fight for taxpayer assistance.

The financial institutions will continue to fight for taxpayers funding to cure technical insolvencies,  replenish their core capital reserves and work out their problematical securities and dodgy assets.

The unions will fight for legislation to grow their membership and fund underfunded or unfunded pension liabilities.

Educational institutions and scientists will fight to continue on the global warming money-train.

And the havoc wreaked by the actions of public employee unions on our nations is likely to remain unabated.

The real fight in the next two years will come in the form of redistricting; arranging the state’s political boundaries to conform to the 2010 census results which can upset the lines of power and Congressional representations.

It is expected that Obama will address the nation and call for the end of partisanship in a Rodney “Can’t we all get along” moment. Ignoring, of course, the lack of partisanship in the democrat’s administration of the stimulus, the creation of Obamacare and the formulation to create cap-and-trade legislation.

Look for higher medical insurance premiums and denials, delays and deaths caused by Obamacare as the government forces the medical industry to treat senior citizens with one eye on medicine and one eye on cost containment.

I must apologize for my cynicism and negativity, I am afraid both parties will start their maneuvering for the 2012 election cycle and the American public will remain an afterthought. And the corrupt mainstream media will continue to cover-up the flaws of the political class who directly affects their future viability and profitability.

The brightest point of light is that the wisdom of our forefathers created a political system which can withstand temporary setbacks and mistakes – with the next opportunity to redress our grievances being in 2012.

So, even in the face of continued political polarization and economic woes,  in the words of a Californian – I am sorry to harsh your mellow.

But it could get worse: let us not forget that, today November 3rd, 2010, the Federal Reserve will probably continue their “quantitative easing” program by buying approximately 1/2-TRILLION dollars worth of bonds; thus increasing the possibility of inflation and its flip-side, a decline in the dollar.

Election 2010: YOU ARE THE HEROES WHO WILL SAVE US ...

For all the patriots who will vote to end the one-party rule of the corrupt, incompetent and dysfunctional democrats … I salute you!

For helping to restore Constitutional checks and balances into the Congress.
