After the healthcare vote: Frank Bell is sick!

After the passage of Obama’s self-described “historic” healthcare legislation in the House of Representatives, our articulate friend, Frank Bell, is sick. As are all of us who have watched while the far-left socialists have infiltrated the democrat party and have taken money from socialistic evildoers such as George Soros in return for pushing an anti-American agenda on “we the people.”  There is no doubt in my mind that Soros and others are attempting to game the American political system to generate profits and gain political power.  All aided and abetted by corrupt politicians who are willing to sell out their country in return for political contributions which keep them in office.  

What’s on Frank Bell’s mind …

Yesterday is probably the most sickening day of my life; not because of the passing of Obamacare but rather because the democrats-progressives-liberals in the legislative branch of this government have proven themselves to be in deep accord with the philosophy of our President Obama and his plan to “socialize” the United States of America. The really sad part is that he is implementing his plan not because he thinks it is best for our country but because he hates this country and what it stands for and will do anything he can to punish our country.

All one has to do is honestly look at his association with Mr. Wright, Mr. Ayers, Mr. Van Jones, Ms. Browner, Mr. Emanuel, Mr. Jennings, Mr. Geithner, Mr. Holder, Mr. Sunstein et al. Can you imagine a more pitiful bunch to be advising the President of the greatest country in the world? I saw through Mr. Wright and understood Mr. Obama as soon as I heard Mr. Wright “preach” the gospel of the Lord. Anyone who did not see what he was simply wasn’t paying attention or just didn’t care.

Because they ignored the obvious about Obama and because they continue to ignore the messages so clearly coming their way, democrats in congress refuse to believe the contempt with which the American people hold them. Gallup shows congressional approval ratings in the teens and headed downward. Gallup also found that "more Americans believe the new legislation will make things worse rather than better for the U.S. as a whole, as well as for them personally."

Democrats are in much worse shape than in 1994 when they lost power, and the opposition is far more energized. Once voters have a chance to tell the most irresponsible government in American history that enough is enough, the Democrats' brief reign will expire, and be deemed death by suicide.

I want to thank you for standing up for what is right for this country and I want you to know that I am prepared and am preparing to do anything to defeat anyone and everyone who voted for this disgusting, pitiful piece of legislation (most specifically, see the cc: list below). At the top of my list is that whack-job Pelosi. She comes from California so I shouldn’t be surprised that she is certifiable and should be locked up somewhere.

Because you showed courage in voting against Obamacare, I want to commend you (whatever your reasons were) for standing up to what must have been unbelievable pressure. Mr. Obama came to your meetings on Saturday and pleaded with you not to contribute to the ruination of his presidency. He actually believes that this is all about him. He doesn’t own this country, I do. He is the President of the United States of America – HE IS NOT A KING!

Anyone who doesn’t see him for exactly what he is in that action is either brain-dead, thinks exactly like he does and wants to see the USA fail, or simply doesn’t understand what is happening to this country and as such shouldn’t be an elected official of this country.

When the will of the governed is trampled on by cheap politicians, it is time to change the government. Every one of those who voted for Obamacare did so against the will of the people and they will pay the price. They can pack their bags; they are going home.

Unfortunately, I believe that even those democrats who voted against the bill did not do so out of conscience, but because they were allowed to by their party’s leadership. Mostly because they face a tough re-election campaign come November. The fact that they voted against the bill does not hold any weight in my eyes – and they should be targeted for defeat when “we the people” remember their party’s egregious actions to subvert the will of the American people and place our collective feet on the path towards Soviet-style, centrally-planned,  socialism.

The die is cast and it is plain for all to see that the democrats are now on the wrong side of history. It is not that the American public is against the need for healthcare reform, it is that “we the people” see absolutely no reason to destroy the entire system which serves 85% of our population to accommodate additional millions without an increase in doctors, nurses, medical facilities and available medical diagnostic tools.  Or enlarges government with thousands of new highly-paid, unionized workers who do little more to remedy the medical situation in America other than to dictate how “we the people” should be treated and push paper not pills.

The bogus accounting, the outrageous promises and the outright lies of our president about increasing private sector jobs and reducing our deficit make me sick.

Here is a man who is unable or unwilling to share the critical documents surrounding his life, but wants to build a massive database containing the medical, financial and employment data on every citizen in America – all controlled by a new government-issued  biometric identification card.

This legislation must be stopped or repealed. Those who perpetrated this fraud must be thrown out of office – especially before they assume control over our economy by regulating the energy producers and users. Before they mandate controls over free speech and our ability to protest.

The fact that the generational contracts involving Social Security and Medicare, which are said to be going bankrupt, have been breeched by Obamacare is enough to demand the resignation of every politician in America.

It is time to join Frank Bell and countless others to throw these bastards out of office come November.

THE DIE IS CAST -- DEMOCRATS DECLARE WAR ON AMERICAN PUBLIC!

The democrats have issued a declaration of war against the American people with legislation designed to insinuate the government into each and every healthcare issue. All enforced by the Internal Revenue Service and governed by a board which will determine which healthcare will reimbursed by insurance companies.

Adverse consequences …

The Constitution has been breached – now that the government can demand that American citizens purchase goods and services from private third-parties, enforced by government agencies such as the Internal Revenue Services, there does not appear any limit on government’s power over American citizens.

The bond between patient and physician will be broken forever as the physician becomes an agent of the government. Will the relationship between a client and their lawyer will also be breached in the near future?

Your retirement is now endangered. The generational contract which has been funded by years of individual payroll deductions to guarantee a retirement safety net is now at risk.

Social Security and Medicare are at more risk for failure. It is an undeniable fact that more funds will be required to sustain government programs. Social Security and Medicare are said to be fast-approaching insolvency. And this new healthcare initiative will hasten the process. Continuous tax increases – now that the nation has accepted the idea of government-regulated healthcare, it must be funded with tax continual increases. 

America’s sovereignty will be ignored. Immigration reform – it is now in the best interests of the nation to extend healthcare to illegal aliens to prevent the spread of disease in the general population.

Second Amendment will be gutted  by additional rules and regulations – it is not in the best interests of the nation to curtail the purchase and use of firearms to prevent unnecessary medical costs relating to weapons-related deaths.

Because of the timeline and all of the political manipulation will take place over the coming months and years, the look and feel of this healthcare bill will be different as time passes. There is no guarantee that congressional corruption will not continue to prevail, turning the American citizen into the funding source for a new privileged political class and their special interest friends.

We have no choice but to fight against those politicians who have placed America at risk.

Obamacare: the face of democrat corruption ... (Updated)

America is faced with a democrat-crafted plan for healthcare reform that does not reform healthcare, destroys a working healthcare system which supports 85% of the population, is filled with special deals and unknown pitfalls ... and is dishonestly being promoted as the largest jobs creation and deficit reduction program in the history of the United States. Both demonstrable lies.  So in consideration of the potential passage of this bill, I decided to pick out the person who I believe typifies the type of fraud, corruption, special dealing and arrogance of the democrat party. A man whose jovial character and articulate ability to discuss the matters of the day mask a dark and dangerous political philosophy.

If I had to pick one single democrat that represents the face of the current democrat party, I would select Alcee Hastings …

To me Hastings is the poster boy for democrat corruption and special dealing …

A Representative since 1993 and a Democrat, Hastings was previously a lawyer and judge. He spent ten years as a federal judge (1979–1989), but was impeached and removed from office for corruption and perjury. He was the sixth federal judge to be impeached and removed from office in American history.

Perhaps Alcee is unaware of the current polling which shows that the vast majority of Americans want healthcare reform – they just do not trust or want the democrat’s vision of Obamacare. Or perhaps, Alcee is unaware that the great deal of Americans hold Congress in contempt, rating it below the favorability ratings of used car salesman.

 Bottom line …

We need honest brokers to represent the people’s interests at a time when we are fast reaching a tipping point when political corruption is enabling those with a toxic political ideology and agenda to advance legislation that will severely impact the character of America and impose greater burdens on American citizens.

And before anyone cries “racist” and “bigot” because this fine, upstanding member of the Black Caucus is being attacked – let me remind you that I am against political corruption no matter what its color, race, gender or political ideology. In this case, Alcee Hastings represents, at least to me, the very worst of a corrupt democrat-led institution and the sheer ignorance and stupidity of those who voted this man into office.

P.S. Someone asked me who my second choice was. It is my own representative in California, Henry Waxman, whose hyper-partisan contentiousness made it an easy choice. But Alcee took the prize for his prior impeachment on charges of corruption and perjury.

As we approach the vote which may lead to the destruction of the America we know and love ... one of my boyhood heroes passes away

I grew up with Davy Crockett, played by American actor Fess Parker who died a few days ago on March 18, 2010. A true conservative who believed in American and the resilience of the American spirit.

Yes, the program presented a distorted version of history, especially as related to the Indians. But this was a different era and the program reflected the values of the time. So before you start with your claptrap – shut the eff up!

The intrusion of reality …

There is no doubt in my mind that Fess Parker was an actor playing the role of an American icon. But, in real life, he talked the talk and walked the walk. I have met a number of  performers, from major stars to bit players, I can tell you he was polite, gracious and humanly real. He was not a conflicted, approval-seeking individual who would say or do anything to gain fame and fortune. Like Ronald Reagan, he was an authentic person concerned about his fellow man and his country. But, in the final analysis, he was an actor, a conservative and a man who inspired me as well as others to be courageous enough to act on our convictions.

Lessons from the real Davy Crockett, member of Congress from Tennessee and who died defending his beliefs at the Alamo in Texas  …

Let’s take a moment and consider the real Davy Crockett. Who exhibited the same courage and conviction at a time when such behavior was more common – but still outstanding enough to attract attention and inspire confidence. Bottom line …

Where the hell are men like this? Men who would stand up to their party’s leadership and do the right thing; for their conscience and for the American public.

Look at the corrupt political leaders of today – pandering to the special interests to maintain their life of privilege. Not doing an honest day’s worth of work in the pursuit of the American dream, but pursuing their own self-interest in gaining and maintain political power.

We need to find old-fashioned conservatives. To fight on against anyone and everything that stands between us and the America we know and love. We may lose but no one cannot say that we did not fight the good fight – and those who have taken America off the path of freedom into the netherworld of socialism and political domination will eventually be damned and then forgotten.

Obamacare: Help me understand: How can they?

It’s everywhere I turn, the news of the democrat’s willingness to lie, cheat, steal, beg or borrow to pass President Obama’s healthcare initiative.

It is not that they cannot see that the President, in concert with Congress, is twisting the arms of legislators who owe a duty to their constituents to carefully consider legislation before them and act in accordance with the law and the best interests of those whom they represent.

How can they turn their back on their constituents who have besieged them with mail, telephone calls, faxes, e-mails – all asking them to reconsider voting for Obamacare?

It’s not that they cannot see that the leadership of Congress has promised key legislators exemptions, carve-outs,  earmarks, better offices and committee assignments for their affirmative vote on Obamacare.

How can they condone this form of legal bribery; which if it happened in an American corporation, might be grounds for prosecution under civil and criminal statutes?

It’s not likely that they have read the entire healthcare bill, both the House and Senate versions and all of the offered amendments in order to understand what it is they are voting on.

How can they vote affirmatively for a legislative initiative which affects one-sixth of the American economy without reading and understanding the bill?

While the non-partisan Congressional Budget Office is trustworthy and produces a work product based on the exact legislation provided to them, it appears that there are several blatant accounting tricks used to keep the bill’s cost under $1 TRILLION.

How can they continue to carve out significant costs and place them in a second bill – so as to produce lower overall costs?

How can they hide the actual costs of the bill by ceding implementation power to the Secretary of Health and Human Services without defining or enumerating what these actions may be or cost?

How can they jigger the numbers by collecting taxes for ten years and providing only six years of services in order to show a lower overall cost of the proposed legislation?

How can they include non-healthcare items such as the Student Loan Program in the legislation to allow the projected cash-flow to lower overall costs to make the legislation less costly?

How can they further decimate Social Security by removing $500 BILLION from the program to pay for this folly?

How can they cut special deals with the very same people they demonize (the drug industry, the insurance industry, the makers of medical devices and supplies) to show non-existent cost savings and tamp down legitimate opposition?

The truth is that the final bill has not been written, nor costed. The actual costs as determined by the CBO cannot be calculated until the final bill is submitted and includes all of the supplementary programs anticipated by the Secretary of HHS.

How can they attempt to use a stealth means of passing this legislation when it appears that such a method might be unconstitutional and is sure to generate a Supreme Court challenge?

But most importantly, how can they decimate a working medical delivery system that serves 85% of the population for an unknowable, unworkable system which adds and additional 12-15 million people into the system?

And how can they, with good conscience, claim that they can serve millions of more healthcare recipients with the same number of doctors, nurses, facilities and medical devices without some form of healthcare denials, rationing or increasing delays for services? 

The answer is simple …

WE LET THEM GET AWAY WITH THESE SHENANIGANS AND VERY RARELY SEEK REDRESS OR REVENGE AT THE BALLOT BOX!

Bottom line …

It is now time to hold the democrat party accountable for the dishonesty contained within the healthcare reform legislation – which they themselves created behind closed doors.

It is now time to hold the democrat party accountable for their refusal to bow to the will of “we the people” when the overwhelming majority of legal American citizens has expressed approval for healthcare reform – but massive disapproval of President Obama’s version of healthcare reform.

It is now time to hold all of the politicians and their special interest friends for the corruption, chaos and downright destruction of the American dream. For all of their actions, overt or covert, that has put our nation at significant risk. Both parties indulged in the pork and the Rockefeller-style Republicans from the Ivy League schools and Northeastern corridor were complicit in pandering to the special interests as well ask shirking their duties when it came to the regulatory oversight of the financial markets and the pursuit of a rational foreign policy.

Now is the time to take action. Before they takeover our nation and form a critical mass of unionized bureaucrats and entitlement recipients that will continue to take more and more out of the United States until all that is left is a third-world Banana Republic.

Vote as if your life and the lives of your family depended on it – because in the next three elections it does. What you vote today will determine your life tomorrow.

Frank Bell Follow-up on Obamacare!

As Obamacare nears a vote – or a perversion of the voting process – we, once again, are reminded that a majority of United States taxpayers and citizens are dead set against Obamacare. These are the same people who openly embrace the topic of healthcare reform – but believe, as I do, that the 2000+ page Obamacare bill is more about enlarging government and creating a perpetual ruling political elite than it is about healthcare. It is more about subverting one-sixth of the United States economy to pursue a political agenda leading our great nation towards socialism and government central planning of our lives.

If Obamacare were not so disingenuous, they would simply extend Medicare or the Congressional health insurance program to all citizens. Oh, I forgot – they are telling us that the government-run Medicare system is dysfunctional and nearly bankrupt. So what makes them think this ill-conceived Obamacare plan is any better – especially when it guts existing Medicare by at least $500 billion? Truth-be-told, this legislation is a death warrant for many senior citizens. Not to mention destroying a functioning healthcare system that serves 85% of the population for an unknown system which might, and I say might, serve an additional 12%. Adding millions of people into the system without increasing doctors, nurses, facilities or diagnostic testing equipment.

My only conclusion is that this is a bad plan by bad people.

Barack Hussein Obama would not be pressing and pushing for OBAMACARE unless he were convinced that it is the gateway to fulfilling his warped vision of "social justice" and "wealth distribution" that comes straight out of the Communist Manifesto.

As a patriotic American, my goal is to see the President and the leftists in Congress so politically damaged and weakened as to be rendered impotent for the remainder of their terms. Then, vote him out along with whoever remains after this year's election. President Obama has declared ideological war on the American people. Now they must teach all of you what happens when a politician shakes the fist of power in our faces and defies us to do anything about it. This is a fight for the very soul and future of our country. I must stay in this battle for my values and freedom!
You and Obama have wasted a year of my valuable time pushing a healthcare takeover that I do not want, while the economy and our foreign policy are in tatters. Your priorities are the opposite of the American peoples'.

President Obama is willing to sacrifice not only the Blue Dog Democrats, but any legislator, and even his own re-election---so his "healthcare legacy" will pass!!!  Basically, take away all the hype---Mr. Obama is telling his fellow Democrats: "SACRIFICE YOURSELVES!"

True democrats - regardless of party - understand that they are not in office to fulfill their own wishes. They are there as the representatives of the people. They must stand up to do the right thing and protect all Americans. Democrats, who choose to follow Obama and Pelosi, in defiance of their constituents, are showing a true lack of character and should be removed from office.

Obama and his family or those in Congress for that matter, will never be subject to the rotten health care proposal and he will be out making $100,000 on speaking engagements while I am sitting in my doctor’s office wondering if I will get to see him today, tomorrow or next week.

You know this is not good for the country. If it was you would have passed it months ago. As it is, you can’t get it done even though you have control of the House, Senate and White House. That has to tell you something about the quality of your Obamacare. It simply isn’t there.

Doesn’t it show you something that the difficulty Pelosi is having in finding the votes for passage, is causing her to float the idea of avoiding a direct vote in the House and merely "deeming" that the bill has passed when the House adopts a rule allowing it to vote on the Senate bill and the reconciliation bill in the same package.

Everything about Obamacare and about how you all are attempting to get it passed is totally and completely unconstitutional. So you have broken the sacred oath you took when you entered your office; the oath to uphold and protect the Constitution of the United States of America. Shame on all of you.

This week, NBC News and The Wall Street Journal released poll results that are disturbing but by no means surprising. The March 11th - 14th poll of 1000 American adults showed that only 17% of respondents approve of the job Congress is doing in Washington. And as bad as that number is, the reason why Congress' approval rating is so low is even more disturbing: a full 76% of Americans simply do not trust the U.S. Congress. Why do you suppose this is?

Frank has it right. Our government is out of control and we need to vote these people out of office as soon as possible. We gave the democrats their shot and they have returned the favor by attempting to subvert the Constitution and move our nation towards socialism. It is now time for change. This is the man who is not the elder statesman he pretends to be, but a democrat party hack who, as the Mayor of Oakland, has done little or nothing to cleanup the cesspool of crime, decay and poverty in his own city – and we cannot expect much more should he get his hands on the governorship of California.

Considering the majority of the legislature, both the Assembly and the Senate consists of Brown’s far-left fellow tax and spend travelers, there would be few checks and balances that would keep California from being destroyed.

The case against the Fed as an "honest broker" in regulatory matters ...

1. The Federal Reserve is not a government institution …

The Federal Reserve is NOT a government institution as many believe. It is a PRIVATE organization owned and operated by its member banks for the purposes of insuring the profitability and welfare of its shareholders. That the Fed has a Congressional Charter to serve as the Nation’s Central Banker does not supersede the  Fed’s duties to its owners. Even their name, “Federal Reserve” implies a relationship with the government which is non-existent.

2.  The Federal Reserve is not transparent or accountable to the Administration nor the Congress …

The Federal Reserve is a power unto itself. There is no Federal Reserve oversight committee and most Congressional and Administration activities are “consultative” in nature.

3.  The Federal Reserve has failed its basic mission of preventing boom/bust cycles  …

The primary reason for the creation of the Federal Reserve was to eliminate the “boom and bust” cycles which resulted in severe national depressions. Their other stated goals of regulating inflation, enhancing economic growth and stimulating employment are all secondary to their prime mission of acting as the nation’s central bank.

Many can argue that the Federal Reserve has violated its basic mission and is the proximate cause for the last major boom/bust cycles with its money policy that favors the large financial institutions and not the American people. Arguments that the abnormally low interest rates put in place by Fed Chairman Alan Greenspan to assist in the recovery of the .dot com recession led to the current crisis in the mortgage meltdown.

4. The Federal Reserve has failed to be an adequate regulator, especially in the areas of controlling systemic risks …

There is no doubt in anyone’s mind that the Fed did not recognize or attempt to control the looming systemic risks of the major financial institutions. The Fed did not exhibit any interest in the derivatives market nor did they attempt to examine how derivatives were used to buffalo the regulators in a post-ENRON era. They also took little or no interest in the ratings agencies who, encouraged by those financial institutions which paid them for their ratings advice, rated junk bonds as triple-A investment grade securities and this spread the contagion to pension funds and other pools of investor’s hard-earned money. 

5.  The idea of the Federal Reserve being a regulator of Financial Institutions or as a safeguard of consumer affairs is a violation of the fundamental principles of good control and governance.

Simply stated, the governed can not govern themselves, the regulated cannot regulate themselves. Just as it is a major control violation for the same person to handle the money in the bank and then attest to the accuracy of the count, a similar case can be made for a non-government institution owned and operated by its member banks for regulating their own activities without some form of independent and external oversight. The fact is that the Federal Reserve is not an “audited” financial institution and its activities are opaque to the government and the people of the United States. Of course, the Fed argues that they cannot fulfill their sensitive mission as the nation’s banker if they were open and transparent. Which I find to be a specious argument because I am hard-pressed to see where Federal Reserve policies negatively impacts those financial institutions that own and operate the Federal Reserve.

6.  The monetary policy of the Federal Reserve, based on the fractional banking system, guarantees that the value of money is automatically inflated as it is generated …

It has been a long time since our money supply has been backed with a tangible asset such as gold. In fact, banks are only required to maintain reserves of approximately ten percent of the money that is being circulated – so we have an inherent inflation factor of 90% before a single dollar starts its circuitous route around our economy.

Did Ben Bernanke shade the truth when he testified to Congress about the Fed’s capabilities and effectiveness? Here we will report and let you decide …

In a speech before the House Committee on Financial Services, Bernanke testified on the Federal Reserve’s role in bank supervision. So with the benefit of 20-20 hindsight, do the following statement ring somewhat hollow?

The Federal Reserve's involvement in regulation and supervision confers two broad sets of benefits to the country. First, because of its wide range of expertise, the Federal Reserve is uniquely suited to supervise large, complex financial organizations and to address both safety and soundness risks and risks to the stability of the financial system as a whole. Second, the Federal Reserve's participation in the oversight of banks of all sizes significantly improves its ability to carry out its central banking functions, including making monetary policy, lending through the discount window, and fostering financial stability.

The first statement appears to be demonstrably false as the Federal Reserve did not see the accumulating systemic risk at the major financial institutions. And the second statement rings hollow as the Federal Reserve’s monetary policy is what set the stage for the crisis and the Fed’s solution was to pump billions of dollars into the large financial institutions which did little or nothing to foster financial stability on main street. 

“Promoting the safety and soundness of individual banking organizations requires the traditional skills of bank supervisors, such as expertise in examinations of risk-management practices; the Federal Reserve has developed such expertise in its long experience supervising banks of all sizes, including community banks and regional banks.”

Citibank was a large bank, thought by many to be on the brink of insolvency. Washington Mutual was a large bank, which finally imploded. So one may ask; where was the Federal Reserve and their examination of risk-management practices?

No other agency can, or is likely to be able to, replicate the breadth and depth of relevant expertise that the Federal Reserve brings to the supervision of large, complex banking organizations and the identification and analysis of systemic risks.”

It appears to me that the Federal Deposit Insurance Corporation (FDIC) with its CAMELS ( Capital adequacy, Asset quality, Management, Earnings, Liquidity and Sensitivity to market risk) rating system is more than adequate to supervise large and small financial institutions. Again, if the Fed had this great expertise, why are our financial institutions struggling – needing special accounting rules to produce the appearance of profits – and our economy is in the tank?

“We have also been taking the lead in addressing flawed compensation practices by issuing proposed guidance to help ensure that compensation structures at banking organizations provide appropriate incentives without encouraging excessive risk-taking.”

Let me see if I understand the situation correctly. The Federal Reserve’s monetary policy provided billions of dollars at little or no cost to financial institutions which then used that money to embark on a spending spree – with little or no restrain because the total institutional risk of success seemingly outweighed the risk of individual project failure. Prudent underwriting criteria for loans was almost non-existent because financial institutions did not need to prioritize their invested capital into the best investments; as they would have normally done had the cost of capital been more expensive. But through the Federal Reserve’s easy money policy, the financial institutions thought they could bet on everything in sight. And now the Fed wants to exert control over those who earned a significant amount of money playing the Fed’s easy money game?

Less formally, but equally important, since 2005 the Federal Reserve has been leading cooperative efforts by market participants and regulators to strengthen the infrastructure of a number of key markets, including the market for securities repurchase agreements and the markets for credit derivatives and other over-the-counter derivative instruments.”

Here I must call bullshit! By less formally, I would think Bernanke meant nonexistent. There was no indication the Federal Reserve or any other regulatory agency had supervisory oversight of the derivatives marketplace and that, even today, there is no oversight over repurchase agreements, derivatives, the derivative’s marketplace and the “dark pools” where securities and derivatives may be traded electronically among counterparties without any market recordation or notice.

It was the use of derivative products which caused much of the growing risk to be hidden from regulators in “off balance sheet accounts.” In one case, a very large financial institution had leveraged its portfolio in such a manner that a relatively mild 5% market downturn exceeded all of the institution’s equity and rendered the institution technically insolvent. Had it not been for the Administration’s political involvement and the availability of billions in taxpayer funds, this signature institution would be as dead as Lehman Brothers.

Admitting the failure of their previous system?

“To improve both our consolidated supervision and our ability to identify potential risks to the financial system, we have made substantial changes to our supervisory framework. So that we can better understand linkages among firms and markets that have the potential to undermine the stability of the financial system, we have adopted a more explicitly multidisciplinary approach, making use of the Federal Reserve's broad expertise in economics, financial markets, payment systems, and bank supervision to which I alluded earlier.

Yada, Yada, Yada. Same old. Same old. Nothing new here except “we have these new systems and maybe they will work this time?”

“Many of these changes draw on the successful experience of the Supervisory Capital Assessment Program (SCAP), also known as the banking stress test, which the Federal Reserve led last year.”

Many economists and others believe that the stress tests were unrealistic and highly manipulated to produce pre-ordained results. “A major problem with the ‘stress test’ is it depends on modeling and it’s the precise practice responsible for much of this economic and financial mess. It’s extraordinary that so many people believe that the Fed and Treasury, after missing the financial disaster, housing debacle, recession and derivative implosion, can now extrapolate economic conditions and resultant financial affects from its models. How did all that rocket-science modeling for subprime defaults and securitization workout? Yet many people already forget or ignore this reality. <Source>

“In summary, the Federal Reserve's wide range of expertise makes it uniquely suited to supervise large, complex financial institutions and to help identify risks to the financial system as a whole. Moreover, the insights provided by our role in supervising a range of banks, including community banks, significantly increases our effectiveness in making monetary policy and fostering financial stability. While we await enactment of comprehensive financial reform legislation, we have undertaken an intensive self-examination of our regulatory and supervisory performance. We are strengthening regulation and overhauling our supervisory framework to improve consolidated supervision as well as our ability to identify potential threats to the stability of the financial system. And we are taking steps to strengthen the oversight and effectiveness of our supervisory activities.”

Bottom line …

The Fed’s “easy money” monetary policy was the proximate cause of the mortgage meltdown and their lack of real supervision over financial institutions led to these institutions acting egregiously and putting the entire United States economy at risk.

How we can allow a PRIVATE institution, owned and operated by the MAJOR FINANCIAL INSTITUTIONS, regulate themselves is beyond the “best practices” of a separation of control between the regulators and those that they regulate.

After all, didn’t the Fed allow the large investment banks to covert themselves into depository institutions so they could access funds through the Fed? An after-the-fact decision that did much to help these firms avoid insolvency and retain their billion dollar bonus structure. All using the taxpayer’s funds.

Didn’t the Fed also conspire with the Treasury Department to insure that AIG was bailed out with taxpayer money – and that AIG’s debts to Goldman Sachs and a few other large institutions were paid off at 100-cents on the dollar; especially when such debt was highly suspect and worth far less. Doesn’t sound like a prudent move to me? Maybe to the top men in the Fed and the Government who came from Goldman Sachs?

My suggestions is that we debate the usefulness of the Federal Reserve and its governance policies before  extending any more power to this private institution.

OBAMA: Pre-emptive policing using DNA ...

We have seen numerous television crime shows where a DNA sample freed a wrongfully accused suspect; and others where the DNA results turned the suspicion on another family member. So it behooves us to ask …

Can a family member of a suspect legally provide a DNA sample to the authorities which can then be used as probable cause, based on similarities, to seek a court order to obtain the DNA of a suspect who has not been charged with a crime?

And what to make of the wide-spread collection of DNA from citizens – who have been arrested, but not charged or convicted of a crime? Could this lead to bogus arrests of suspects on trumped-up charges in order to obtain the suspect’s DNA? Or be used to compromise other family members? Or prosecute cases for which that statute of limitations has already run its course?

Will your rights to a fair and impartial trial be compromised by DNA found at the scene by a savvy criminal who took fibers and DNA-laced evidence and dropped it about as he prepared to exit the area? Not unheard of since the advent of television crime shows which often serve as a video instruction manual for crooks smart enough to “game the system.”

The Chicago Way: why we should be concerned about big brother/big sister/big transgender …

We should be extremely concerned when anything impairs our freedoms and rights to a fair and impartial trial. One need only consider Senator Roland Burris, the controversial recipient of former Senator Barack Obama’s Senate Seat. Here is a man who knowingly allowed a man to stay on death row for political reasons. His chief investigator and Deputy Attorney General resigned rather than be a party to his corrupt behavior.

“While state attorney general in 1992, Burris aggressively sought the death penalty for Rolando Cruz, who twice was convicted of raping and murdering a 10-year-old girl in the Chicago suburb of Naperville. The crime took place in 1983.”

“But by 1992, another man had confessed to the crime, and Burris’ own deputy attorney general was pleading with Burris to drop the case, then on appeal before the Illinois Supreme Court.”

“Burris refused. He was running for governor.”

“Deputy attorney general Mary Brigid Kenney agreed, and eventually resigned rather than continue to prosecute Cruz.”

“Kenney was not alone in her beliefs. Prior to Cruz’ 1985 trial, the lead detective in the case resigned in protest over prosecutors' handling of the case, according to news reports at the time.”

So without honest brokers in the Administration and the Judiciary, why should be think that our safety is being protected when we can clearly see that political considerations weigh heavily on decisions made in relation to high profile crimes and cases. Especially when people convicted prior to DNA testing are routinely denied the very DNA tests that would prove them innocent – whether to support a corrupt prosecution or increase the state’s cost; this seems to violate one of the most fundamental of human rights – the right to justice above everything else.

“Obama Supports DNA Sampling Upon Arrest”

“Gerstein posts a televised interview of Obama and John Walsh of America’s Most Wanted. The nation’s chief executive extols the virtues of mandatory DNA testing of Americans upon arrest, even absent charges or a conviction. Obama said, ‘It’s the right thing to do’ to ‘tighten the grip around folks’ who commit crime.”

“Now there’s DNA sampling. Obama told Walsh he supported the federal government, as well as the 18 states that have varying laws requiring compulsory DNA sampling of individuals upon an arrest for crimes ranging from misdemeanors to felonies. The data is lodged in state and federal databases, and has fostered as many as 200 arrests nationwide, Walsh said.”

Perhaps Obama was grandstanding for the cameras, but we need to take him at his word. This might be a very dangerous precedent in the hands of an unscrupulous government and its corrupt representatives.

It’s technical …

We have all been led to believe that DNA is an infallible indicator of guilt or, at the very least, presence at a crime scene. However, it is not so cut and dried. It often depends on the number of DNA elements that are matched and are required before they can be entered as evidence. It also depends on the quality of the DNA; with highly degraded DNA being next to worthless. It also depends on the honesty of the laboratory and technicians performing the testing. And we have seen indications of fudged test results which were produced to ensnare individuals who the prosecutors thought were guilty.

And it goes far beyond simple identification …

The government is desirous of producing tamper-proof identification which cannot be compromised. It is in the government’s best interest to use DNA for this purpose – and which presents a whole new challenge to your Constitutional liberties and your right to remain private and anonymous. Not only does DNA identify an individual, it may also identify family members, the state of your health and some propensity for violence and addictions. In the hands of a healthcare provider or insurance company, DNA could be used to adjust premium levels or deny coverage. In the healthcare realm, it can potentially identify people for whom additional treatment may be denied based on medical condition predispositions and other factors.

The law regarding the collection and use of DNA is still unsettled in various states …

A recent case argued before the State Supreme Court involved a prisoner who was tested while in custody and found guilty of having committed another crime. The attorney argued that the DNA should have never been collected and the evidence suppressed because the state acted improperly and egregiously in collecting the DNA sample. Should a federal law supersede state law, there would be no such arguments and another one of your constitutional rights may be compromised. 

State shenanigans?

Contained in the reference links section below  is a court case where the State of California tried to hold open a case beyond the statute of limitations by seeking an arrest warrant for an unknown suspect with a particular DNA. Only when a recent DNA match was made, was the suspect placed at jeopardy. The question of whether or not the suspect's legal rights were violated was at the core of the case.

Bottom line …

We have seen overzealous investigators and prosecutors bend and break the rules with relative impunity. Including manufacturing and submitting false and misleading evidence as well as withholding and suppressing exculpatory evidence from the defense and the Court.

I have often wondered about the relationship between your Fifth Amendment right against self-incrimination and the routine collection of DNA would play out in the courts.

Let’s hope that our legislators come down on the side of individual freedoms and do not take that very next step on the slippery slope of turning the United States into another government-dominated police state.

The ONLY hope we have of preserving our Constitution is to elect honest brokers who will pursue the rights of individuals over the rights of the collective, as one finds in socialist and communist countries. We can not stand idly by while our institutions are corrupted by those currently in power as elected officials.

Vote in 2010 and 2o12 for honest representatives of “we the people.”

Court weighs fairness of 'cold hit' DNA in '76 case

“Several justices of the California Supreme Court suggested Thursday that a defendant's right to a fair trial is not violated when he is charged with a crime that occurred decades earlier based on new DNA evidence.”

The Court’s verdict …

The DNA arrest warrant in this case was not a true warrant, because it did not authorize the arrest of anyone. It was a shell, a clever artifice designed to satisfy the statute of limitations so the criminal investigation could continue indefinitely until the perpetrator was identified. Message to President Obama and the Congress ...

Perhaps Obama and our Congress needs to understand what the Tea Party movement is all about … what makes America great and what the political consequences of moving our nation  to a failed Soviet-style centrally-planned economy.
