The "Chimp" bill -- illustrating what's wrong with politicians ...

First and foremost, politicians are media whores – using any national news event to secure media “face time” so they can appear to be doing their jobs on behalf of the American people whom they allegedly represent.

Second, politicians believe everything can be fixed with legislation, especially legislation which creates controversy and encourages lobbyists to pony up large campaign contributions.

Third, politicians never consider previous laws or legislation because it often does not have their name attached to the bill or because amendments, technical corrections and supplements are just not worthy of major media time.

So it should come as no surprise that Congress will act to introduce and pass a bill that would stop interstate commerce in primates destined to become pets. H.R. 80, known as the Captive Primate Safety Act, is just another nonsensical application of a sledgehammer to swat a fly.

This is a states rights issue – and should not become a federal matter …

Yes, several people have been horribly maimed by Chimpanzees which become increasingly hard to control after they reach puberty. But, with all of the turmoil surrounding the current problems in both our domestic and foreign policies, would it not have been simpler just to add the Chimpanzee to the list of animals requiring a “zoo” permit to purchase and keep as a pet? Problem solved without making it a federal matter.

Where in the United States Constitution does it say that the federal government has the right to control pet animals? I wonder if there is a separate bill for lions, tigers, crocodiles and other dangerous game. So why not just amend the law to add primates to the list of controlled animals.

Yes, legislators can control the interstate commerce procurement, sale and transfer of dangerous animals, but that is stretching the powers of the federal government very thin – especially when one considers exactly how few people have been hurt and the additional expense of creating and enforcing legislation.

Oh, I forgot, legislators have all the time in the world. Especially when they are not required to read the very laws that they vote on. Especially with all of the time saved from reading the stimulus bill. I wonder if Congress has exempted themselves from this act – because, judging from the quality of their work,  most of them must have a cadre of chimpanzees in the back room cranking out conflicting, confusing and controversial legislation. (Whoops – strike that politically incorrect example lest we be accused of racism by Al Sharpton and his corrupt cronies who see everything through the prism of race.)

Chuck DeVore: A leader without supporters?

UPDATE: 05-09-10 I ENDORSE CHUCK DEVORE FOR 2010 SENATE RACE TO REPLACE BARBARA BOXER

I have examined all of the facts and have decided to endorse Chuck DeVore for the 2010 Senate Race to replace Barbara Boxer. I believe Carly Fiorina is a RINO who will bring us more Bay-area liberal nonsense (like Feinstein) and that Tom Campbell appears to be a supporter of radical Muslim causes and therefore cannot be trusted with high office.  -- steve

Original blog post ...

Screwed by Schwarzenegger and the legislature …

Any of my regular readers knows that I strongly believe that the California legislature has screwed California by passing an outrageous “tax and spend” budget which ratifies the profligate spending of our legislature on themselves, government employees, illegal aliens, unions, and the special interests.  I also believe that our RINO (Republican In Name Only) Governor, Arnold Schwarzenegger was also complicit in this outrage – serving as a cheerleader promoting “post-partisan” compromise between those who wanted pure tax hikes without spending cuts and those who wanted spending cuts without tax hikes.

All symptomatic of an incompetent and corrupt government which has spun out of control by their inability to overcome their liberal democrat tendancies to create coalitions of victims – and then to apply legislative remedies to win voters and secure additional campaign funding.

Devore’s attempt to stop the acceptance of this outrageous budget …

According to the Sacramento Bee …

“DeVore fails in push for Villines' ouster”

“The first GOP leadership challenge resulting from the budget negotiations came and went Saturday night as Assemblyman Chuck DeVore, R-Irvine, moved unsuccessfully to unseat Assembly GOP leader Mike Villines.”

“In a closed-door Republican caucus before the marathon floor session, DeVore made a motion to remove Villines as GOP leader (known as ‘vacating the chair’ in Capitol-speak). None of the other 28 Republican Assembly members seconded the motion.

" ‘The discussion was a credit to the caucus. Nobody raised their voice, everything was logical, people made their case and I lost,’ said DeVore, who is plotting a 2010 run for U.S. Senate.”

No on-the-record supporters?

“DeVore's motion was not seconded despite the fact that all of his Assembly GOP colleagues have endorsed him* in his bid to unseat Sen. Barbara Boxer, including Villines himself.”

“The leadership challenge came a day after a supposedly private e-mail from DeVore to Villines was publicized on the John and Ken radio show in Los Angeles.”

“In the e-mail, DeVore wrote that ‘for the caucus, for the party and for the upcoming elections, if this is the final (budget) deal and you believe it to be good...then I think you need to resign or be replaced the day of the vote,’ according to the radio show.”

“DeVore confirmed the authenticity of the e-mail, though he denied that he leaked it to the conservative radio shock jocks. Only a day earlier, John and Ken had blasted DeVore on air for not challenging Villines' leadership more directly.”

Plausible deniability or planned leak?

“How then would a private e-mail between the two become public?”

“DeVore said he had forwarded the e-mail to ‘some of my members, colleagues’ -- at their request -- ‘because it contained kind of a logical rundown of why I thought what we were about to do was in error.’"

" ‘Clearly, I should not have sent that to anyone else other than Mike Villines, because obviously the last paragraph was kind of a bombshell,’ he said, suggesting someone else forwarded the e-mail to the radio hosts.”

A dramatic, but meaningless gesture?

“In the end, instead of Villines resigning, DeVore did.”

“He announced on Saturday night that he would give up his post as a GOP whip. DeVore had been one of 14 members of the 29-person caucus to technically serve in Villines' leadership team.”

“DeVore said he couldn't remain a part of the team ‘in good conscience.’ He said he feared voting for tax hikes to solve California's massive $40 billion budget deficit would "be very harmful to the cause of limited government.’"

" ‘I think it is going to discourage our base,’ he said. ‘I think that no good thing will come from it.’"

Conscience or convenient campaign ploy?

With the budget fight apparently lost, what is the possibility that a pragmatic legislator would seek to make the best of the situation by making a dramatic gesture which could be exploited for his upcoming Senate race?

Tyranny by incompetence and corruption?

There is not doubt that the members of California’s legislature have, over the course of the last ten years,  wreaked havoc on our economy and infrastructure. Representing themselves, the special interest friends and their ideology before the legal citizens of the State.

So what really happened?

So what are we to make of a legislator who is ostensibly supported by his fellow Republicans, but cannot muster their support and second his motion to remove the current leadership which negotiated the budget compromise in secret and without the input of his caucus?

And what are we to make from a planned advertising campaign that not only cites his “resignation” but also raises the spectre of the opposition boogeyman; or should I say bogeywoman – Barbara Boxer, arguably the dumbest member of Congress?

Capture2-22-2009-3.16.26 PM

From a paid advertising campaign …

Last week the only man standing between Californians and $70 billion in new taxes was Chuck DeVore.

In a principled stand, Chuck decried massive tax hikes on hard-working families in the Golden State, resigned his leadership position in protest, and blasted the Assembly's deal:
"This proposed agreement strikes at the heart of our longtime opposition to tax increases. Excessive taxation both harms the economy and robs hardworking Californians of a portion of their liberty. Placing our Caucus squarely in line with tax increases also demoralizes our supporters - people who were counting on us to hold the line.
"For these reasons, I believe it is appropriate for me to resign as Chief Republican Whip, effective immediately. I can no longer participate as a leader on a team that is preparing to make a fundamental mistake of colossal proportions. For the sake of California I hope I am wrong - however, I fear I am right and that this tax increase and budget deal will result in more harm to the Golden State than good."'

Chuck DeVore showed his true colors, as a Republican who places principle above position. He marked himself as one of the emerging bright lights of the next conservative ascendancy. In stepping down, he stepped up -- and it won't be the last time.

This past week President Obama signed into law a massive "stimulus" package, passed by partisan liberals in Washington, that jeopardizes our fiscal future and squanders our children's inheritance. We can't afford to take a chance on tepid and untried leaders.  We need real conservatives with resolve who will represent us in Washington.  We need Chuck DeVore in the United States Senate.

Please consider making a donation to the Chuck DeVore campaign today and help unseat Barbara Boxer.

Thank you,
The Chuck DeVore Campaign

Can we trust our legislators?

Considering that our local, state and federal legislators have indulged in an orgy of self-interested promotion of their own special interests and ideology – can we regard Chuck DeVore’s actions as a principled statement against a bad situation or merely another self-serving and premeditated political gesture to capitalize on a bad situation and further promote his upcoming candidacy for federal office.

Consider the number of times we have elected leaders who turned out to be nothing like their carefully crafted persona – Arnold Schwarzenegger comes immediately to mind, as Barack Obama.

As for DeVore, we should watch him very carefully before we decide to trust him as a “conservative” representative of the Republican party. It seems Orange County (California) conservative Republicanism is no longer a given.

Personally my position can be summed up simply as …

Capture2-16-2009-6.02.35 PM

What can YOU do?

Be extremely wary of any politician who professes to be a “conservative” but also appears to be a “go along to get along” type politicians. Check their supporters.

Do not believe the often manufactured media hype and self-serving statements of any politician. Note which politicians are hyped by fellow politicians who happen to be “career” politicians – flopping from job to job as the wend their way up the crooked chain of political life.

Look around you and consider the great amount of real damage which has been caused by so-called “principled” politicians who listen more to the special interests which can provide bloc votes and campaign finances rather than the real wants and wishes of their constituents.

Be sure before you vote!

Take care of yourself and your family first. Be well and be safe.

Why John McCain SHOULD NOT be re-elected!

Bad news …

Dear Fellow American,

Being the Republican nominee for President was one of the great honors of my life and an experience I will never forget. Some have wondered, after my hard fought presidential campaign, if I plan to run for re-election to the United States Senate.

I want you to know that I do intend to seek re-election. The magnitude of the financial crisis that many American families are facing makes it clear to me that I want to continue to serve the people of Arizona and our country in the Senate.

Today, I'm asking you to join my campaign by making a generous contribution so I may continue my service to our great nation.
John McCain

Re-electing a loser …

I have never been a big John McCain fan, but did support him as the best of two evils. Now that he is running for re-election to the Senate, I am forced to urge my fellow Americans and blog readers to  vote for someone else, preferably another Republican or Libertarian. It is my personal opinion that anybody would be preferable to John Mc Cain. While I honor him for his past sacrifice as a prisoner of war in the service of our nation, McCain is worthless as a conservative republican legislator. He appears to be more like the liberal socialist democrats than a principled conservative Republican.

Just three of my reasons for not re-electing John McCain …

1.   He has ignored his own constituency and has allowed Phoenix, Arizona to become the second largest kidnapping target after Mexico City.

“In what officials caution is now a dangerous and even deadly crime wave, Phoenix, Arizona has become the kidnapping capital of America, with more incidents than any other city in the world outside of Mexico City and over 370 cases last year alone. But local authorities say Washington, DC is too obsessed with al Qaeda terrorists to care about what is happening in their own backyard right now.” <Source>

2.  McCain has sold out his party and his nation by jumping across the aisle to co-author some of the most destructive legislation ever authored in modern times.

McCain-Feingold – a campaign finance law that allowed radical leftists and others to pump unlimited amount of money into our elections to subvert the very nature of the election. While its intent may have been noble, it execution and effects have been disastrous.

McCain-Kennedy – comprehensive immigration reform which was little more than amnesty for the illegal aliens who are destroying our healthcare, education, judicial, retirement, social and cultural infrastructure. It also created a class of super-citizens who no longer needed to be bothered by the consequences of disobeying the law.

McCain-Lieberman – a legislative fix for so-called global warming which would do little or nothing to affect the global climate change other than to enlarge government, raise taxes and reduce our personal freedoms.

3.  McCain is an unstable and unknown quantity which cannot be trusted in a time when liberal democrat socialists rule the  nation.

My personal paradox …

While I do believe it is critical to elect a republican majority in Congress to mitigate the growing toxic effects of the far-left liberal democrat socialists, I am extremely loath to condone the re-election of those republicans that provided aid and comfort to the democrat party – and are thus complicit in creating the meltdown we now face.

The OLD idea of party support should be abandoned. Just what has the Republican (or democrat) party visited on the American people except inept and corrupt candidates whose policies have led us to the brink of fiscal disaster. Why would anyone consider rewarding either one of these shameful parties with re-electing their chosen candidates is beyond me.

I would much prefer a rookie republican legislator with potential be elected in place of an ineffective and toxic career politician  like John McCain. Let him retire to his multiple homes in honor. But do not re-elect this sham politician to office.

For those who believe that he needs to be re-elected to preserve seniority in committee assignments and other such folderol … just consider what his aisle-hopping legislation means for the nation. Nothing good can come from McCain’s re-election. We need to go beyond party politics and send conservatives (rather than faux conservatives like McCain) to Congress to redeem our America and reestablish our conservative Republican party.

An example of John McCain's knowledge ...

When queried on the healthcare provisions of Obama's stimulus bill, McCain replied "I don’t know frankly enough about that provision to give you an informed comment." Honest, but unacceptable since McCain is a member of the Senate Committee on Health, Education, Labor and Pensions. <Source>

Sell-outs … all of them!

The democrat way: only tinged, not tainted, with corruption -- Locke proposed for Secretary of Commerce?

Isn’t it amazing that the Obama Administration can’t seem to find an unblemished candidate for their Secretary of Commerce?

According to the Associated Press…

“President Barack Obama's likely third pick for Commerce secretary is former Washington Gov. Gary Locke, a senior administration official said Monday.”

Locke was briefly linked to the scandal over foreign contributions to President Bill Clinton's 1996 campaign. In July 1998, he gave a deposition to the House Committee on Government Reform and Oversight about his relationships with questioned Clinton donors. But the committee subsequently said the deposition produced no evidence that Locke knowingly accepted illegal campaign donations.”

“Locke denied any wrongdoing, and he subsequently returned some checks tied to people implicated in the fundraising scandal, including $750 from John Huang. The former Commerce Department official was the Democratic Party's chief fund raiser for the Asian-American population in the 1996 elections, and he became one of the central figures in the national Democratic Party fundraising scandal.”

“Also, in December 1997, Locke's political committee was fined a maximum $2,500 by state regulators after it admitted breaking campaign finance laws during two out-of-state fundraisers in 1996.”

“And in March 1998, state investigators cleared Locke of wrongdoing following complaints that he unlawfully took $10,000 in campaign contributions from members of a Buddhist church.”

Problem?

“Since leaving office he's been working for the Seattle-based law firm Davis Wright Tremaine on issues involving China, energy and governmental relations. He argues that global engagement is a way to improve China's human rights record and deal with piracy of intellectual property.”

I am extremely wary of any candidate for a high-level position who may have had a prior working relationship with foreign nations who were complicit in illegally trying to subvert a United States election.

“The 1996 United States campaign finance controversy was an alleged effort by the People's Republic of China to influence domestic American politics during the 1996 federal elections. The issue first received public attention in early 1997, with news that a Justice Department investigation had uncovered evidence that agents of China sought to direct contributions to the Democratic National Committee (DNC) in violation of U.S. laws regarding foreign political contributions. The Chinese government denied all accusations. Twenty-two people were eventually convicted of fraud or for funneling Asian funds into the United States elections, and others fled U.S. jurisdiction. Several of these were associates of Bill Clinton or Al Gore.” <Source>

Perhaps Obama is blind to corruption?

Having started his political career in the house of  unrepentant domestic terrorists (William Ayers and Bernadine Dohrn) and being associated with political crooks like Tony Rezko and the corrupt Chicago and Illinois political machines, perhaps Barack Obama is really blind to political corruption, campaign funding irregularities and the manipulation of voting that is the hallmark of the democrat party?

Is this the best the Obama Administration can do? Or perhaps are they sending a welcoming signal for the Chinese to financially participate in the 2010 and 2012 election cycles?

OUTRAGEOUS: $900 MILLION TO KILLERS IN GAZA; WHY NOT SPEND THE MONEY TO CURTAIL THE KILLERS IN MEXICO?

Outrageous …

I find it outrageous that our elected officials would pledge more than $900 million to an anti-American regime which is openly hostile to their neighbor state of Israel and which continues to lob rockets into unarmed populated areas.

According to Reuters …

U.S. plans ‘substantial’ pledge at Gaza meeting

“The United States plans to offer more than $900 million to help rebuild Gaza after Israel's invasion and to strengthen the Western-backed Palestinian Authority, U.S. officials said on Monday.”

Why?

Why would the elected officials of the United States, in the throes of an unprecedented financial crisis and whose citizens are suffering under a government which has brought about the partial collapse of the current financial system, pay money to a foreign entity which is not only a bad actor on the world stage – but is thoroughly corrupt and will probably spend a portion of these funds on weaponry.

Corruption compounded …

In addition to providing the money to a hostile sovereign state whose laws codify human rights violations and repress fundamental freedoms, the money must also pass through the corrupt United Nations which has been proven to be impotent, inept and corrupt when it comes to handling large sums of money.

“The money, which needs U.S. congressional approval, will be distributed through U.N. and other bodies and not via the militant group Hamas, which rules Gaza, said one official.”

" ‘This money is for Gaza and to help strengthen the Palestinian Authority. It is not going to go to Hamas,’ said the official, who asked not to be named as Secretary of State Hillary Clinton planned to announce the funding at a donors' conference in Egypt next week.”

Wasn’t the Palestinian Authority the same government group where Yasser Arafat siphoned off billions for his personal use and the use of his “special” friends.

The Hillary factor?

AHA! Hillary Clinton is involved. Which makes me believe that we are buying a “public relations” feel-good publicity release. Is anyone watching Bill’s Foundation for donations by the Palestinian Authority, its legal representation, its lobbyists, its neighboring states and/or its public relations counsel? Or perhaps monitoring the foundation’s Internet contributions arising from outside the United States?

Why am I opposed to this money?

“Neither the United States nor Israel have direct contact with the Islamist Hamas movement which runs Gaza and remains formally committed to the destruction of the Jewish state.”

Why are we supporting people who want to kill their neighbors and deny their own people the common freedoms which we take for granted?

“The official said the pledge was a mix of money already earmarked for the Palestinians and some new funding.”

Humanitarian aid without conditions is not a good idea …

“In December, the former Bush administration said it would give $85 million to the U.N. agency that provides aid to Palestinian refugees in the West Bank, Gaza, Jordan, Lebanon and Syria.”

Rebuild the infrastructure of the United States before assisting those who do not wish us well …

“The March 2 donors' conference in Egypt's Sharm el-Sheikh resort aims to raise humanitarian and rebuilding funds for Gaza after Israel's invasion last December to suppress rocket fire against its cities.”

Resort? Of course, diplomats the world over are treated as pampered guests: the best lodging, food and travel destinations.

This is self-inflicted!

“Preliminary estimates put damage from the offensive, in which 1,300 Palestinians died, at nearly $2 billion.”

Yah Think?

“Clinton's bid to get "substantial" funds could face an uphill battle in Congress because Hamas continues to rule Gaza and the U.S. focus is on its own souring economy.”

BOOST FOR ABBAS

“Part of the goal of the new funding is to boost the Palestinian Authority of President Mahmoud Abbas, which controls the occupied West Bank.”

“The United States wants Abbas's PA to play a central role in the reconstruction effort in Gaza, hoping this will increase its influence in the Hamas stronghold. Washington is also putting pressure on other donors to bolster Abbas.”

Excuse me – isn’t this the same Obama Administration which criticized former President Bush for interfering in the affairs of sovereign nations and engaging in “nation building.”

Trying – or buying – a meaningless peace accord?

After attending the conference in Egypt, Clinton is expected to go to Israel and the West Bank -- a public demonstration of Obama's promise to make Arab-Israeli peacemaking a foreign policy priority.

“Clinton's special envoy to the region, George Mitchell, will be there this week trying to revive stalled Palestinian statehood talks complicated both by Hamas and political uncertainty in Israel after last week's election.”

The region has not known peace for a long time. It remains the task of the affected nations to solve their own problems. We cannot force Israel to accept a solution which increases their risk of annihilation. Why the rush?

And I am not pleased that our government is planning to spend the taxpayer’s hard-earned money on an attempt to buy little more than a public relations coup which can be used to enhance democrat chances in the 2012 election cycle. Perhaps the democrats in the government see $900 million as a paltry sum now that they are throwing around billions of dollars to the banks, to the stimulus and to their pet causes?

Want to spend $900 million on a foreign sovereign nation?

How about spending the money on law enforcement in Mexico which remains a clear and present danger to American citizens?

THE OSCARS: WHAT'S WRONG WITH THIS PICTURE?

For most people, the annual OSCAR’s telecast is entertainment …

Another chance to see narcissistic actors (no more actors and actresses now, they are all politically correct genderless “actors”) and the people who create their fantasy lives involved in a real-life soap opera.

For some, a chance to worship celebrity, the so-called “American royalty where name and face recognition is more important than the acts that propelled them to the stage. An intersection between the sane and insane, the famous and the infamous.

Another chance for social interaction where people discuss the odds of this or that person (or film) winning the prize. To see how people looked on the red carpet. Waiting in anticipation for the faux pas or gaffe – and perhaps a full meltdown or wardrobe malfunction.

And some actually believe that the night is not just another Hollywood self-celebratory congratulatory “see and be seen” affair and is about rewarding actual achievement.

But the truth is far different.

First and foremost, this is a money-spinning venture that helps to fund the Academy of Motion Pictures Arts and Sciences. The worldwide television rights to this event are expensive – and do not, as many believe, flow to fund charities.

Second and even more important, this is a mass-marketing event; a chance to further publicize the wares of those who inhabit the “fictional” Hollywood. To create additional buzz. To drive people who would not normally patronize the movies to see films which are hardly worth the $100 or so it takes to go to the movies today. (With the cost of tickets, parking, popcorn, dinner, baby-sitter, etc.)

Why else would studios, production companies and the performers themselves spend great sums of money promoting their performance and product? Answer: for commercial advantage, of course. Just another night of worldwide publicity to hawk their wares.

But it is all Hollywood smoke and mirrors …

Hollywood is a mythical place. Where smoke and mirrors create bankable illusions. Where you are what you say you are and personal and professional re-invention and rehabilitation after a major stumble is de rigueur. Where your house, car, clothes and accessories are only props to move your personal story forward to capturing more money, sex and power.

Hollywood is a state of mind that really does not exist. Twentieth Century Fox is in West Los Angeles. MGM is in Culver City. Disney is in Burbank. Only Paramount and Universal actually are in and around the old Hollywood. In actuality, Hollywood was a dirty, grimy place where streetwalkers openly plied their trade and tourists came to marvel at the facade the was said to be famous. Now, through the help of your tax dollars, Hollywood is making a comeback, it is being re-vitalized into another money-making tourist trap for those who want to believe. But the famed studios themselves are controlled by large conglomerates and filming takes place far away from the fabled studio lots of yore.

But it is even worse than you might imagine …

Hollywood represents the home of the politically correct. The multi-millionaire limousine liberals who own multiple mansions, cars, yachts and planes and who want to tell you how to live in order to preserve the planet. The people who need to dictate how we live to give their own lives relevance and meaning – perhaps to convince themselves that they are actually worth the millions they are paid for whatever talents they need to mouth the words of others with enough sincerity to make them believable. And, for the more cynical among you, another chance at self-promotion – to be seen doing “good works” and becoming a beloved ambassador to the world’s potential audiences. These are the far-left, liberal democrats who fund the causes that are moving American life beyond the bounds of main street America. Unless you have grown up in this atmosphere, it is unlikely that you will see reality in exactly the same way that people from Manhattan to Malibu see it: special privileges for those who are wealthy, famous or simply powerful because of their current position as the head of this or that studio.

An assault on our freedoms …

Truth be told, Hollywood is not as much about preserving our freedoms, as it is about converting our freedoms into their own special privileges. In the guise of fighting content piracy, Hollywood has pursued draconian laws which now impact almost every citizen in the United States.

How many people realize that recording and motion pictures are internally coded with identifying information? And that your computer and electronic devices which read and/or reproduce this content are forced, by law, to have circuitry and software which recognizes this coding and responds accordingly – tagging each copy you make with your identifying information along with the original source of the content?

For many years, you could not purchase a digital recorder in this country – until these recorders contained the requisite safeguards against content counterfeiting.

How many people realized that each blank CD contained a hidden royalty that was paid into a fund that was to compensate artists for purloined content and which was divided up among the big record producers and others who could exert a claim on these funds in proportion to the creative product they produced?

How many people realized that Hollywood, more than any other party, sought to nullify the original copyright compact that was made by the American people: a monopoly on profiting from your content in exchange for putting the work into the public domain after a specific period of time?  With Hollywood pushing the time for monopolistic exploitation further and further out – primarily to keep commercially profitable works from falling into the public domain.

And when that was not enough, to institute the Digital Millennium Copyright Act (DMCA) which criminalized the breaking of the electronic wrapper protecting any content – even that content which was already in the public domain.

How many people realize that Hollywood attempted to subvert the Justice Department into becoming its investigatory and prosecution arm to ferret out and punish content piracy – shifting the burden of these commercial and civil costs to the American people?

I, for one, am not willing to exchange a few moments of diversion or pleasure for a reduction in my freedoms.

As a content creator, I have seen my work reproduced and handed out by people in the government who should have known better. It is a fact of life that there will be those who want to use your product or services without payment. In some instances, personal use, not mass sharing or commercial distribution, some exchange of materials is to be permitted and even encouraged.

Think of buying a book and loaning it to your friend. Perfectly acceptable. Especially considering that I donate my unwanted books, CDs and DVDs to my local library.

Now consider re-printing the digital version of the book and distributing it to all your friends: definitely not cool. And if you do it for some form of profit – you should be prosecuted.

But, that is not to say that I am willing to allow big brother to monitor my actions and invade my privacy just to prevent this from happening. In this regard, I support the closure of mass file-sharing systems and the protection of digital content. All with due process. And, hopefully under an international law which supports my ownership claims. But I draw the line at the invasion of my privacy – just to prevent a “potential occurrence of copyright infringement.”

Bottom line ..

So before you worship that character and/or the actor who might play a cool part – consider that it is all smoke and mirrors. The actor is not the person they are portraying. Minus the script, many of these actors are unbelievably stupid or naive. Others are downright self-absorbed and narcissistic while others are self-loathing, paranoid or extremely fragile in terms of self-esteem. Not exactly your everyday, hard-working, tax-paying citizen whose collective services are crucial to the survival of the world -- the unsung heroes who defend our country and keep the wheels of commerce moving.

So, should you want to maintain the proper perspective on Hollywood and its denizens, just remember the answer to a simple riddle.

When is a star not a star?

The answer says it all: when there is a bigger star in the room.

Take care of yourself and your family first. Be safe and be well.

OBAMA STIMULUS: COMPROMISING YOUR HEALTH RECORDS FOR POLITICS AND PROFITS

There is no doubt in anyone’s mind that the healthcare industry is a prodigious lobby and provides campaign contributions to all politicians and potential politicians to advance their own self-interests. While there is nothing wrong with the healthcare industry exercising their  First Amendment rights, there is the continual push for the industry to obtain access to individual health records which can be used not only to set rates, but to deny claims on the basis of prior conditions. Mostly by proving that the consumer, forced to fill-out a questionnaire in an extremely limited time frame, omitted a pre-existing condition which would have materially affected the consumers rate or even their ability to get insurance.

Now we find that, hidden in the bowels of the so-called stimulus package, is the beginnings of a national healthcare system and the authorization for another nationwide database – put in place without safeguards for the protection of non-public personal medical information – and severe penalties for the disclosure of this information to unauthorized third parties.

For those who believe that HIPAA (Healthcare Insurance Portability and Accountability Act) contains these protections, one need only consider the recent breaches of medical information by authorized healthcare or government workers to the media. Or the potential use of these records for embarrassment, blackmail, extortion or other coercive practices. It should be noted that President Clinton and Obama both declined to release their medical records to the media even under media pressure.

An assault on consumer privacy …

While I have openly warned against the use of private medical records repositories supported by Microsoft, Google and others – claiming that their user agreements provided little or no protection to the consumer against data breaches, that the information may, in fact, be sold to third-parties in an aggregated form without personally identifying information or be used by the repository for its own purposes, I have not issued a similar warning about government databases. I now am issuing the very same type of warning.

Without stringent data collection and usage guidelines that contain no exceptions and with strict penalties for the inadvertent or deliberate security breaches and/or unauthorized release of consumer health information, these databases pose a clear and present danger to the privacy rights of consumers. No large-scale government information system is secure as most breaches are perpetrated by those who have been trusted with the keys to the kingdom and who may be personally vulnerable to coercive outside influences. Witness the number of spies who have revealed information, not for ideological reasons, but for personal reasons involving sex, money and position.

The devil is in the details …

In spite of democrat protestations to the contrary, and who can believe hyper-partisan politicians, the stimulus bill contains the seeds of the destruction of personal privacy with regard to your confidential healthcare information.

According to CNSNews.com …

‘Exceptions’ in Stimulus Bill Allow Sale of Health Records

“It could become easier to sell and exchange the health information of Americans under the economic stimulus package that awaits President Barack Obama’s signature Tuesday.”

“The $787 billion American Recovery and Reinvestment Act that passed Congress last week allocates $19 billion to establish centrally linked health data infrastructure to contain the health information of ‘each American’ by 2014 and to set up the new office of the ‘National Coordinator for Health Information Technology.’”

Saying one thing and doing another?

“Though the legislation says there is a ‘prohibition on sale of electronic health records or protected health information,’ there are five pages of exceptions to the prohibition that include research, treatment of an individual, or a decision by the Secretary of Health and Human Services to waive the prohibition.

“One exception listed in the legislation is if, ‘The purpose of the exchange is for public health activities.’ Another exception is apparently to ensure the data – if sold – are not for commercial reasons, saying, ‘The purpose of the exchange is for research and the price charged reflects costs of preparation and transmittal of the data for such purpose.’
Another exception is rather broad saying, ‘The purpose of the exchange is otherwise determined by the secretary in regulations to be similarly necessary and appropriate’ in accordance with the other exceptions.”

Orwellian provisions …

Once again, we encounter the introduction of Orwellian language where up is down, right is left and good is evil.

“Further, one of the exceptions seemingly states the government can obtain an individual’s health information for the purpose of protecting an individual’s privacy. It reads: ‘The purpose of the exchange is for treatment of the individual, subject to any regulation that the secretary may promulgate to prevent protected health information from inappropriate access, use or disclosure.’”

“The legislation also says that the prohibition will be reviewed after 18 months. The review will further explore whether the government ‘may further restrict the exception described in paragraph (2)(A) to require that the price charged for the purpose described in such paragraph reflects the cost of preparation and transmittal of the data for such purpose, if the secretary finds that such further restriction will not impede such research or public health activities.’”

What does this mean? I pride myself on my ability to read original legislation and I have no clue to the meaning of this particular provision and the unintended consequences it might spawn.

“Some of these exceptions are already in the Health Insurance Portability and Accountability Act (HIPAA), a law with privacy provisions.”

“But the exceptions on exchanging or selling information could be more problematic to privacy if health records are digital, said Sue Blevins, president of the Institute for Health Freedom, a group that advocates health privacy issues. ‘Digital records without consent is a recipe for invasion of privacy,’ Blevins told CNSNews.com Monday. ‘Consent was gutted with HIPAA, but it is really hard to get out paper records. When they are made electronic, you can share data with a click of a mouse.’”

Those who could be able to sell the information would be health care providers, insurance companies and other entities that collect the data.”

Bullshit from the Senate Finance Committee …

“A statement by the Democratic majority on the Senate Finance Committee says the information will not be used to influence treatment and that ‘Federal law makes your medical records--whether they’re on paper or in a computer--confidential to you and your health provider.’”

If this were literally true, there would be no objections by consumer privacy groups and the provisions would be clearly spelled out in plain English.

“However, some Republicans in Congress have questions about the government gathering the health care information of individuals, and what will be done with that information.
‘Making sure that providers can share information on a patient, making sure we can do that effectively and efficiently is a good thing. Having government decide about the course of treatment is not a good thing,’ Rep. Rob Wittman (R-Va.) told CNSNews.com.”

Our healthcare system is fundamentally flawed …

It is one thing for the government to cede unprecedented control to the insurance companies and subcontractors to manage the billing and payment systems, but it is a major systemic flaw when these private for-profit commercial enterprises are also allowed to restrict and/or re-direct your treatment modalities based on costs rather than medical efficacy.

“It goes right back to the government’s role should be between a patient and a provider. That information needs to be there for the patient and the provider to make decisions about their health care -- not for government to intercede.”

Robert Gibbs, the inarticulate bozo who provides the press briefings weighs in with politico-babble …

“White House Press Secretary Robert Gibbs said spending more on health information technology creates jobs, saves money, provides less bureaucracy and will save costs for small businesses.”

“If you go to the bank on the way home and take out your ATM card and get $25 out of your account to use this weekend, the transaction costs the bank – in many cases – half a penny. A medical transaction of your records from you doctor in Bethesda to an emergency room in Washington costs $10,” Gibbs said Friday.”

This bozo does not understand either the volume nor the complexity of the information being transmitted – so to make this comparison marks Gibbs as just another stupid political hack with little or no understanding of what he is speaking about. Especially considering that the data format for dealing with credit card data is uniform across the hardware platforms and there is no such mandatory standards for those currently using proprietary medical systems which may not even be able to communicate with each other, let alone in a secure manner.

“ ‘The president believes that by implementing health care technology, we can save billions of dollars in health care costs we see skyrocketing every year, putting more and more business out of business and is blamed repeatedly for patient safety and patient death,’ said Gibbs.”

Another stupid statement. Your medical records do little or nothing to prevent your nurse from giving you the wrong medication, the wrong dose or even giving you a transfusion during an operation which will be instantly fatal. I personally observed a nurse walk into a room, check the patients wristband, check the label on the medication – and then hang the wrong medication on the infusion rack. Only the protestations of the patient – which were received as being hostile and argumentative – saved the day as a doctor arrived to re-check the medication and noticed the error. That is not to say that records should not be cross-checked, but one might find that most medical errors (like the amputation of the wrong foot) are human errors and that medical systems have little or no effect at stopping these problems from occurring.

Here are the words of some democrats who voted for this bill ...

"Meanwhile, members of the Senate told CNSNews.com that they were unaware of these health-care provisions included in the 1,071-page legislation."

I have not looked at those particular provisions as much as I have on the general effectiveness [of the stimulus],” Sen. John McCain (R-Ariz.) told CNSNews.com on Friday. “I don’t know frankly enough about that provision to give you an informed comment.”  McCain is a member of the Senate Committee on Health, Education, Labor and Pensions.

I don’t know,” Sen. Charles Schumer (D-N.Y.) told CNSNews.com, when asked about the provision.  “I haven’t thought about it.” <Source>

Serious about healthcare?

Want to really reduce the cost of healthcare, jail those who defraud the system rather than slapping them on the wrist or settling restitution claims for pennies on the dollars. Put in place a decent payment schedule which does not force the doctor to break a procedure into many little components and find ingenious ways to code the charges so as to earn a fair payment.

But, if you are really serious, stop treating medicine as a factory process that requires a doctor to see a patient every ten minutes. With this type of time-pressure, no doctor will have the time to peruse a patient’s history – computerized or not.

It is time that doctors; not administrators, doctor-administrators, nurse-administrators or clerical people manage the delivery of healthcare. And as for saving billions of dollars, do you want to bet that the savings goes to the bottom line of the health insurers and the profligate salaries and bonuses that are paid to health company executives.

What can YOU do?

Demand that healthcare be returned to doctors instead of clerks. Demand that insurers make available group pricing to all who wish to purchase insurance without regard to employment or employer. The purpose of a group policy is to spread the risk across the group – so as not to burden individuals who might suddenly be unable to afford insurance and turn to government assistance. Make healthcare affordable by removing the government from the process.

Treat those who offer to store your personal healthcare information free or for a fee with great suspicion until you can rest assured that your information will not be misused for commercial purposes or be released into the wild by evildoers.

Consider joining the Electronic Frontier Foundation (www.Eff.org) to support their advocacy of consumer privacy rights.

Be well and be safe.

Slimeball Soros -- continuing to create havoc in the political and financial markets for profit?

According to Reuters …

Soros sees no bottom for world financial 'collapse'

“Renowned investor George Soros said on Friday the world financial system has effectively disintegrated, adding that there is yet no prospect of a near-term resolution to the crisis.”

“Soros said the turbulence is actually more severe than during the Great Depression, comparing the current situation to the demise of the Soviet Union.”

“He said the bankruptcy of Lehman Brothers in September marked a turning point in the functioning of the market system.”

" ‘We witnessed the collapse of the financial system,’ Soros said at a Columbia University dinner. ‘It was placed on life support, and it's still on life support. There's no sign that we are anywhere near a bottom.’"

Why should we believe anything that Soros says?

First, Soros is a financial freebooter – profiting from the turmoil in the marketplace. Especially in the area of currency speculation. Now that he is a major player in the markets, his quotes are seen by some to be sage comments on today’s political and financial situation. However, others, myself included, see him as a self-serving spokesman for his own personal interests and agenda. He has every reason to talk down the marketplace as that’s where he is likely to make significant profits.

And two, Soros appears to be someone who would like to see the present American political system crater in favor of some form of socialistic “open” government.

Hiding behind tax exempt foundations and charitable organizations, Soros is attempting to reshape the dynamics of current political interaction.

“About OSI and the Soros Foundations Network”

“The Open Society Institute works to build vibrant and tolerant democracies whose governments are accountable to their citizens. To achieve its mission, OSI seeks to shape public policies that assure greater fairness in political, legal, and economic systems and safeguard fundamental rights. On a local level, OSI implements a range of initiatives to advance justice, education, public health, and independent media. At the same time, OSI builds alliances across borders and continents on issues such as corruption and freedom of information. OSI places a high priority on protecting and improving the lives of people in marginalized communities.”

“Investor and philanthropist George Soros in 1993 created OSI as a private operating and grantmaking foundation to support his foundations in Central and Eastern Europe and the former Soviet Union. Those foundations were established, starting in 1984, to help countries make the transition from communism. OSI has expanded the activities of the Soros foundations network to encompass the United States and more than 60 countries in Europe, Asia, Africa, and Latin America. Each Soros foundation relies on the expertise of boards composed of eminent citizens who determine individual agendas based on local priorities.” <Source>

After reading a number of Soros documents, I have come to the conclusion that, like all far-left liberal democrats, he wants to build the “perfect world” where he can exert the greatest influence to game the system.

Amazingly, the article quotes Paul Volker …

“His comments echoed those made earlier at the same conference by Paul Volcker, a former Federal Reserve chairman who is now a top adviser to President Barack Obama.”

Volcker said industrial production around the world was declining even more rapidly than in the United States, which is itself under severe strain.

" ‘I don't remember any time, maybe even in the Great Depression, when things went down quite so fast, quite so uniformly around the world,’ Volcker said.”

But how many people know that Former Federal Reserve Chairman Paul Volcker wrote the foreword of Soros' book The Alchemy of Finance?

“George Soros has made his mark as an enormously successful speculator, wise enough to largely withdraw when still way ahead of the game. The bulk of his enormous winnings is now devoted to encouraging transitional and emerging nations to become 'open societies,' open not only in the sense of freedom of commerce but—more important—tolerant of new ideas and different modes of thinking and behavior.” <Source>

As I see it, Paul Volker is a fellow traveler and comments should be weighted accordingly.

Considering Soros’ participation as a former board member of the Council of Foreign Relations and one of the major funders of the Center for American Progress, I sincerely believe that Soros’ ideal governmental structure is some form of “multi-national collective” society” ruled (yes, ruled) by a benevolent corporate board.

One need only consider who is heading the Center for American Progress and the picture seems clear.

The Center for American Progress is a liberal political policy research and advocacy organization. Its website describes it as "... a nonpartisan research and educational institute dedicated to promoting a strong, just and free America that ensures opportunity for all."

Non-partisan, my fat ass! They are some of the most hyper-partisan, ideologues to be found in the democrat party.

“Its President and Chief Executive Officer is former lobbyist John Podesta, who served as chief of staff to then U.S. President Bill Clinton.”

“Located in Washington, D.C., the Center for American Progress has a campus outreach group, Campus Progress, and a sister advocacy organization, the Center for American Progress Action Fund.”

And they want to control what and who you listen to …

One need only consider their “report” which made the case for bringing back some form of the fairness doctrine in the form of controlling the ownership of stations and managing the public airwaves.

Center for American Progress: The Structural Imbalance of Political Talk Radio

“Among radio formats, the combined news/talk format (which includes news/talk/information and talk/personality) leads all others in terms of the total number of stations per format and trails only country music in terms of national audience share. Through more than 1,700 stations across the nation, the combined news/talk format is estimated to reach more than 50 million listeners each week. As this report will document in detail, conservative talk radio undeniably dominates the format.” <Source>

John Podesta's Media Matters is paving the way for the resurgence of the Fairness Doctrine. Podesta, a co-chairman of President-elect Barack Obama's White House transition team, and former chief of staff in the Clinton administration, was a critical player in the startup of this Far Left ‘media monitoring’ website. Media Matters is actively pushing to reinstate the Fairness Doctrine that would essentially silence talk radio. <Source>

A clear and present danger?

“Citing the significant number of its staff and former staff that have been appointed to positions in the Obama Administration, Time magazine recently declared that there is "no group in Washington with more influence at this moment in history.” <Source>

My problem is that I see a clear and present danger in the nation. The very same democrat people who forced key rules and regulations on the banking system which resulted in unsound and imprudent lending are now in charge of trying to “fix” the mess by plunging this nation into greater uncertainty and chaos.

Fronted by an empty suit – a political “Ted Baxter” type …

Headed by an telegenic, well-spoken (with TelePrompTer) empty suit, these people appear to be playing political power games with our nations finances in order to move their self-interested agenda forward. And as I see it, a toxic agenda that will be contrary to the very principles that our founding fathers set forth for this nation.

On their way to their goals …

The democrats seem to have subverted two branches of government and co-opted the mainstream media. They are about to co-opt the third, the Supreme Court, sometime in the near future.

Uncharted waters …

Folks, as I see it, we are in uncharted waters. Facing a crisis of Constitutional proportions. A situation which may very well result in the breakup of the United States or its transformation into a European-style union. Definitely un-American. Unless I am totally wrong and am misreading the current political climate, I cannot see how the liberal democrat party gained so much power when their history of corruption and malevolence is there for all to see. Even Barack Obama’s origin and background is suspect.

How could this happen?

As I observe the American political scene, my only answer is that, due to the continual barrage of mainstream media stories, those that hated George Bush and those who were voting “black” provided a great enough block to secure the election. For this I blame both a rather inarticulate George Bush who failed to move beyond his Reagan-like Presidential Posture and engage the democrats full force – and a Congress where self-interest corruption has been institutionalized to an unhealthy degree.

The future …

First, it is hard to dismiss a Soros who seems to be willing to spend money on media and politicians to advance his own causes.

Second, it is hard to dismiss the collapse of the journalistic ethics which would have exposed this perfidy in the making and provided fair coverage of the campaign and politicians involved.

And third, it is hard to imagine the damage that is being done to our country by the far-left democrat party who is attempting to use the stimulus package to reward their friends and build a loyal base of supporters who can trade their votes for a guaranteed package of entitlements.

One need only look at the relatively few days which have passed since the January 20th inauguration of Barack Obama. The chaos and the bold implementation of life-changing legislation. And they are not finished yet. They are still in campaign mode: with a tightly controlled press, with an outside list-maintenance contact operation and never-ending fundraising. If we thought that a two-year Presidential campaign was bad, we are about to see a four-year campaign unfold before our very eyes.

I see nothing good coming of this democrat Administration where a weak and inept Barack Obama is rolled by such poor political players as House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid. This is a government which will be operated by a tight cadre of on-message political operatives – often known as the Clintonistas. Of course, Barack Obama’s nomination of a few Republicans to serve as Judas goats is much more than a symbolic gesture – I believe he believes that he can use these republicans to keep the Clintonistas at bay. Something which I believe will not happen.

What can YOU do?

Do not let yourself be sucked into a maelstrom of inaccurate media reports that feature people who are disposed to changing the American way of life.

Do not elect or re-elect people who are corrupt and can be rolled by those with no principles.

Do not vote for any candidate or current politician who is willing to subvert the safety, security, sovereignty and economic strength of the United States or limit an individual's right of self-defense for their personal philosophy, power, prestige or profits.

Look out for yourself and your family first. Be well and be safe.

Schwarzenegger sells out "the people" to make sure his political "verkers" have guaranteed jobs, outrageous salaries and health and retirement benefits beyond what is customarily available in the private sector. (Updated)

UPDATE: 02-21-09 SCHWARZENEGGER LACKS THE BALLS TO APPEAR AT THE GOP CONVENTION -- PREFERS OTHER GOVERNORS, OBAMA AND APPEARANCE ON TV PROGRAM -- more  GIRLY MAN DODGES CONTENTIOUS SESSION!

Capture2-21-2009-2.57.31 AM

RINO (Republican In Name Only) Governor Schwarzenegger signs California’s $130 BILLION budget containing unprecedented TAX HIKES; failing to control the very spending that he promised to curtail when he was elected to replace another tax-and-spend governor, Gray Davis.

It appears that the people were overwhelmed by his celebrity and the Hollywood Smoke and Mirrors campaign that he ran. Now, he only pretends to play the Governor as he poses and runs off to high-profile media events. In his own words, Schwarzenegger claims that he is always looking for his next goal. And that he is a "post-partisan" politician working ONLY for the people. Truth be known, he is working for himself -- the people are incidental to his plan.

Let’s hope that he is actually signing his political death warrant which will preclude any run at becoming a United States Senator. Perhaps this post-partisan schmuck will turn into the liberal democrat he appears to be and make us all happy by retiring.

Bottom line: we are all working harder to support the politicians, the government workers, the unions, the illegal alien lobby, the gay lobby and the special interests which are bleeding our state dry and pre-conditioning the battle field for the upcoming Mexican revolutionary takeover. Notice that there are no ordinary “non-connected” citizens standing behind him as he signs the bill.

Notice: he did not simply restrict California’s social benefits to those who are legal residents of California!

All because the Governor lacks the smarts and the balls to do the job he promised. All because he has morphed into a fat-cat democrat “Teddy Kennedy-like” liberal who has raised fundraising to a new art – making the shameless former governor look like an amateur.

SCHWARZENEGGER IS A FAUX REPUBLICAN BUM AND NEEDS TO BE THROWN OUT OF POLITICAL LIFE

I enjoy his movies and think he is an OK guy – but as a politician, it’s all cigar smoke and posing mirrors.
