As much as Hurricane Katrina highlighted the shameful performance of the government at local, state and federal levels, there has been little mention of the fact that the New Orleans' Police Department, in an unlawful and unconstitutional manner, illegally confiscated the legal, registered weapons of legal, law-abiding citizens who had done nothing more sinister than possess the weapons in their own homes. Considering that this was the same police force whose members displayed extreme cowardice during the emergency and simply fled their duties and the jurisdiction, I wonder exactly what protection the police were planning to provide when law and order ceased to exist? There are some who believe that the police were responding to orders from the city's administration to confiscate the weapons to encourage those who wanted to protect their lives and property to leave New Orleans during a city-wide evacuation.
As egregious as this New Orleans behavior has been, it is rivaled by the officials in the District of Columbia who, for years, have denied its citizens the right to protective arms.
A ban which led to armed criminals preying on ordinary, law-abiding citizens while the a-hole politicians in Washington called for further restrictive gun legislation for the country. With a staggering crime rate (including violent murder, assault, rape, burglary), the Firearms Control Regulations Act of 1975 prohibited residents from owning handguns, excluding handguns registered prior to February 5, 1977. Other local laws prohibit carrying guns (concealed or not), and all guns and ammunition must be registered.
Six legal, law-abiding residents sued the district in order to purchase and maintain handguns for self-defense. The original trial court upheld the District's gun ban and the matter was appealed to the United States District Court of Appeals for the District of Columbia Circuit. The three-panel judges, in a 2-1 decision, ruled that portions of the Firearms Control Regulations Act of 1975 were unconditional and violated the Second Amendment of the Constitution.
Of course, the city's mayor, a weasel named Adrian Fenty has insisted that the appeal court's ruling be challenged which sets the stage for the first Supreme Court battle over the Second Amendment in 70 years -- IF THE SUPREME COURT DECIDES TO HEAR THE CASE!
What can YOU do?
The Supreme Court was designed to be beyond the influence of the voter -- and certainly lives in an isolated world of their own, ostensibly to insure that their deliberations are based solely on their interpretation of the law. It should be noted that George Bush deserves much credit for persevering in his nominations and appointment of Supreme Court Justices who were said to be "strict constructionists;" that is, they believed it was the duty of the court to rule on the constitutionality of the laws passed by Congress and not serve up their judicial opinions to make law where none existed as do "activist" judges. Therefore, while you can respectfully send a request to the individual justices to hear the case, they are unlikely to be persuaded by any consideration other than those presented by their "law clerks" who do much of the actual research and preliminary drafting of cases.
However, you can make your opinions on overly restrictive gun control laws known to your elected officials. Again, respectfully request that they uphold the Constitution of the United States and enact "crime control" laws that punish felons who use weapons when perpetrating their crimes. Let them know you demand no "charge reductions," plea bargains, or "good behavior" sentence reductions. You demand "weapon enhancements" and all time to be served in full. Anyone who believes "gun control" works over "crime control" needs to be shown the error of their ways.
Do not vote for judges and other elected officials who do not respect your legal rights as a law-abiding citizen.
And for those of you who are squeamish around weapons, may I suggest you take a NRA-sponsored "gun safety" class or visit your local firing range. The friendly rangemaster would be pleased to introduce you to someone who can explain gun handling and proper safety procedures.
Realize, not everyone who owns a gun is a "gun nut." Some like to hunt, target shoot, and be able to protect themselves and their families in times of natural disasters or civil disturbances.
Your right to keep and bear arms was provided by the fathers of our Constitution both as a means of self-protection and against the tyranny of an unjust government. The argument against the Second Amendment by those who state that it only covers "state militias" is dead wrong: state militias are part of the government to which the founding fathers sought an ultimate means to seek redress.
Study your Constitution and give thanks and praise to those troops who are serving to keep your freedoms and the pursuit of your individual happiness alive.
