There are those who want to disparage the President of the United States or divert the attention of the American public from the serious scandals from the Obama era; including the violation of the Espionage Act, the mass destruction of documents, and the obstruction of justice involved in covering up various felonious acts. Thus, the progressive socialist democrats and their captive progressive media is attempting to exploit a civil – not criminal – matter involving payments accompanying a non-disclosure agreement and various other matters.
Michael Cohen Taped Conversation With Trump About Buying Rights to Playmate’s Story
Conversation occurred in September 2016, after American Media Inc. had purchased Karen McDougal’s story that she had affair with Trump
Michael Cohen taped a face-to-face conversation with Donald Trump in which the two men discussed buying the rights to a former Playboy Playmate’s story that she had an affair with Mr. Trump more than a decade ago, according to people familiar with the matter.
The conversation between the then-GOP presidential nominee and his longtime personal lawyer took place in September 2016, the people said. That was two months before the election and a month after American Media Inc., the publisher of the National Enquirer, bought the life rights to Karen McDougal’s story of the extramarital affair, which she has said began in 2006 and lasted nearly a year. Representatives of Mr. Trump have denied the affair took place.
In the conversation, Mr. Cohen told Mr. Trump about the American Media deal and suggested that they consider acquiring the rights to Ms. McDougal’s story themselves, the people with knowledge of the matter said. Mr. Trump, appearing open to the suggestion, asked how to proceed and whether he should write a check or pay in another manner, they said.

President Trump did nothing of a criminal nature. He may not have always told the truth, but what politician doesn’t lie when campaigning or about various matters after being elected. Nothing President Trump has said can be compared to former President Barack Obama telling the American public on numerous occasions that “if they liked their doctor, they could keep their doctor.” In fact, the progressive media invented the term “campaign mode” to cover the many lies of Barack Obama.
And while Michael Cohen, a self-described tough-guy, fixer, and enforcer, may be a detestable character, his alleged illegal activities occurred before Trump was elected to the Presidency.
What we know…
It appears that there is nothing criminal in Michael Cohen taping a conversation with Donald Trump because New York's wiretapping law is a so-called "one-party consent" law, making it a crime to record to record or eavesdrop on an in-person or telephone conversation unless one party to the conversation consents. (N.Y. Penal Law §§ 250.00, 250.05.) Apparently, Michael Cohen “consented,” so no harm, no fault.
It appears that there is nothing in the New York Bar Association Rules of Professional Conduct mentions any specific rule barring an attorney from recording their conversations with a client. And, it appears that the American Bar Association’s Committee on Ethics and Professional Responsibility allows that lawyers may ethically tape their conversations, with some caveats, provided the taping is not illegal in the relevant jurisdictions and the lawyer does not lie about whether the conversation is being taped, if asked about it. (ABA Formal Opinion 01-422) In reference to Opinion 01-433, the authors noted, “The Committee is divided as to whether a lawyer may record a client-lawyer conversation without the knowledge of the client, but agrees that it is inadvisable to do so.”
It appears that the real issue is the leaking of confidential information that may have been obtained during an investigation.
For those ascribing this leak to Special Counsel Mueller, it should be noted that the matter appears to be handled by the Public Corruption Unit of the Criminal Division of the Office of the US Attorney for the Southern District of New York. SDNY has a pattern and practice of leaking information to the media, which apparently included Rudy Giuliani when he was United States Attorney for the Southern District of New York during the 1980s.
President Trump was a philandering businessman before being elected and while you may condemn his behavior, it has nothing to do with his patriotism or what he has done for American and Americans.
We are so screwed if we allow the progressive socialist democrats deflect our attention from the damage they have done and are presently doing to our nation.
